RESOLUTION #005-2026
APPROVAL OF AGRICULTURAL LEASE AGREEMENT WITH
JACK KING FOR THE KELSEY DRIVE CONSERVATION SITE
WHEREAS, the attached Agricultural Lease Agreement for the harvesting of the existing
hay crop at the land designated therein, has been reviewed by the Finance Committee
and has been recommended for approval.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby approve the
Lease Agreement with Jack King for lease of the Kelsey Drive Conservation Site
commencing on March 1, 2026 and ending on December 31, 2027.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute the Agreement
and the City Attorney is authorized to make substantive changes as may be necessary
in order to preserve the general intent thereof.

AGRICULTURAL LEASE
THIS AGREEMENT is made between the City of Muskego, Lessor, and Jack King, Lessee.
The property which is the subject of this lease is described as follows, to -wit:
ricultural Lands on the Kelsev Drive Conservation Site. Tax Kev Number: MSKC 2280.998.003
TOTAL AREA TO BE LEASED IS APPROXIMATELY 3.5 ACRES AS DEPICTED ON EXHIBIT A, AND ACCORDING TO
THE FOLLOWING CONDITIONS:
RENTAL: Rent will be $55.00 per acre per year. The rental of said property shall be for the term of two (2) growing
season(s), commencing on March 1, 2026 and ending on December 31, 2027. Renewal of this lease will be at the
discretion of the Lessor.
SPECIAL CONDITIONS: This lease is for harvest of the existing hay crop only. Land may not be planted with any "row"
crops (corn, soybeans, wheat...) under this agreement.
LIABILITY INSURANCE: Lessee shall, at his own expense and at all times during the term of this lease, maintain in force
a policy or policies of insurance, written by one or more responsible insurance carriers, which will insure Lessor against
liability for injury to or death of persons or loss or damage to property occurring in or about the demised premises. The
liability under such insurance shall not be less than $1,000,000 for any one person killed or injured, $1,000,000 for any
one accident and $1,000,000 property damage. A certificate of insurance by endorsement naming Lessor as an additional
insured must be on file with the City Clerk prior to entering said property.
RIGHTS AND PRIVILEGES: The Lessor or anyone designated by them shall have the right of entry at any reasonable
time to inspect their property and/or the farming methods being used.
If this lease is terminated before the end of the normal production year, the Lessee shall have the right of entry for the
purpose of the annual harvesting of crops seeded before the termination of the lease in accordance with normal farm
practices, or to sell his interest in such annual crops whether to the Lessor or to the succeeding Lessee provided the
Lessee does not interfere with normal field operations of the succeeding season.
If this lease is terminated before the Lessee shall have obtained the benefits from any labor or formerly agreed upon
expense he incurred in operating the land during the current lease year, the Lessor shall reimburse the Lessee for such
labor or expense. The Lessee shall present, in writing to the Lessor, his claim for such reimbursement within thirty (30)
days of the termination of this lease.
INDEMNIFICATION: Lessee agrees to indemnify, defend and hold harmless the Lessor from and against any and all
suits, actions, claims, damages of whatsoever kind caused by reason of any act, omission, fault or negligence of Lessee
or anyone acting under its discretion or control unless liability results from the sole negligence of lessor. This indemnity
provision shall survive the termination or expiration of this Lease Agreement.
ASSIGNMENT: This lease shall not be assigned by the Lessee without the expressed written consent of the City.
RENEWAL: This lease is not subject to automatic renewal.
Pursuant to Resolution #005-2026 passed and approved on February 10, 2026 by the Common Council of the City of
Muskego, this lease is hereby executed this day of February 2026.

agricultural crops. No other uses of the land are conveyed by this agreement.

time to inspect their property and/or the farming methods being used.
If this lease is terminated before the end of the normal production year, the Lessee shall have the right of entry for the

practices, or to sell his interest in such annual crops whether to the Lessor or to the succeeding Lessee provided the

RESOLUTION #008-2026
EXPENDITURE APPROVAL FOR PURCHASE OF 2026 PLOW TRUCK
WHEREAS, the 2026 Public Works Capital Budget included an authorized purchase of a plow
truck; that payment for the truck will be made in phases based on production; and
WHEREAS, the Department of Public Works and Development received the attached invoice
for the first payment due on the plow truck from Lakeside International LLC; and
WHEREAS, additional invoices will be presented to the Common Council for approval as
production of the truck progresses; and
WHEREAS, the Finance Committee has reviewed the Lakeside International LLC invoice and
recommends payment of the same which is within the approved Capital Budget.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego,
upon recommendation of the Finance Committee, does hereby approve payment in the
amount of $144,023.00 for the first invoice due on the plow truck and authorizes the
Department of Public Works and Development to pay said invoice upon certification of this
Resolution by the City Clerk.

Ruekert & Mielke includes information regarding the bids received; and
WHEREAS, the three bids received are as follows:

Ruekert & Mielke letter and recommends awarding the base bid to Sabel Mechanical for the
Agate Lift Station in the amount of $271,175.75; and
WHEREAS, the Finance Committee reviewed the recommendation to accept the bid submitted
by Sabel Mechanical for the Agate Lift Station in the amount of $271,175.75 and recommends
approval to the Common Council.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon
the recommendation of the Finance Committee, does hereby accept and approve the bid
submitted by Sabel Mechanical for the Agate Lift Station in the amount of $271,175.75.
BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to sign the Contract
in the name of the City and the City Attorney is authorized to make substantive changes to the
Contract as may be necessary in order to preserve the general intent thereof.

The City received three bids on January 22, 2026 at 2:00 pm for the above project. The bids are listed on
the attached Bid Summary. The apparent low bidder is Sabel Mechanical. Ruekert and Mielke, Inc.(R/M)
has checked with Sabel Mechanical, and they have indicated they have all worked included in their
bid. They stated they also have insurance and bonding in their bid as well. Pieper Electric is their
electrical subcontractor.
Sabel Mechanical has successfully completed other similar projects in the last 10 years according to our
direct project experience with them.
R/M recommends that the City award this project with the base bid to Sabel Mechanical. We recommend
that none of the alternates are accepted.

223). PE-223 establishes the deadline for submitting the final TID accounting to

APPROVAL OF FIRE PROTECTION SERVICES AGREEMENT WITH
TESS CORNERS VOLUNTEER FIRE DEPARTMENT
WHEREAS, it is necessary that the City of Muskego and the Tess Corners Volunteer Fire
Department enter into an Agreement for fire protection for the City's residents; and
WHEREAS, an Agreement between the parties was recommended by the Finance Committee
and passed by the Common Council at its meeting of December 16, 2025; and
WHEREAS, subsequent to said meeting, Tess Corners Volunteer Fire Department retained legal
counsel to review the Agreement; that Tess Corners Volunteer Fire Department requested
modifications to the Agreement, the most significant of which is the removal of the paragraph
requiring Tess Corners Volunteer Fire Department to provide the City with all past and future
donations it receives on a yearly basis; and
WHEREAS, the Common Council reviewed and discussed the modifications at its regular meeting
of February 10, 2026, and approved the Agreement as proposed by Tess Corners Volunteer Fire
Department.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, does
hereby approve the Revised Agreement for fire protection services between the Tess Corners
Volunteer Fire Department and the City of Muskego for the period January 1, 2026, to December
31, 2027.
BE IT FURTHER RESOLVED that this Resolution will nullify Resolution #090-2025, approved by
the Common Council on December 16, 2025, relating to the Fire Protection Agreement between
the City of Muskego and the Tess Corners Volunteer Fire Department.
BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized to sign the
Agreement and the City Attorney is authorized to make substantive changes to it as may be
necessary to preserve the general intent thereof.
BE IT FURTHER RESOLVED that the Mayor is authorized to sign such substantive changes
made by the City Attorney.

The Agreement between the City and TCVFD for fire protection expired on December 31, 2025.
The new Agreement covering January 1, 2026, to December 31, 2027, was presented to
Council at its meeting on December 16, 2025. Discussion amongst Council members resulted in
approving the Agreement with the following changes.
1. Add a paragraph for TCVFD to provide its financial documents, including but not limited to,
its financial statements, to the City on a quarterly basis for each year of the contract.
2. Add a paragraph for TCVFD to provide the City with the gross amount of total donations it
has received per year from 2021 through 2025 with any single donation exceeding
$5,000.00 to be named and itemized separately. Additionally, TCVFD must provide a list
of all donations it receives in 2026 and every year thereafter, no later than December 31 st
of each calendar year that the Agreement is in place.
3. Any capital expenditure requests from TCVFD that exceed $50,000.00 shall be brought to
Council and approved at its annual Capital Budget Meeting. The prior amount was
$500,000.00.
4. Add a paragraph that TCVFD agrees to wholly participate with the City's consultant in the
evaluation of current fire protection services and participate in the discussion process
relating to recommendations regarding future fire protection services for the City.
Subsequent to the December 16, 2025, Common Council meeting, all of the above terms and
conditions were incorporated into the Agreement and sent to TCVFD for its review and signatures.
On January 29, 2026, 1 received correspondence from Curt Walther of Godfrey and Kahn,
TCVFD"s Attorney, proposing modifications to the Agreement. A copy of the Agreement is
attached with Attorney Walther's proposed deletions appearing in red highlight and additions
appearing in blue lettering.

Most of TCVFD's modifications are acceptable because they are simply rewrites to what is already
in the Agreement, keeping the overall intent the same. The major change, however, is paragraph
five (5) of the Agreement whereby TCVFD struck out the entire paragraph dealing with the
requirement for TCVFD to provide the City with information regarding past and future donations
received on a yearly basis.
TCVFD wishes for donations from individuals and entities to remain confidential. In some
instances, it was a requirement of the donation.
A Resolution has been prepared and attached as if Council were to approve the Agreement with
the modifications as proposed by TCVFD, however, this was only done for getting the issue on
the floor and can easily be modified with whatever Council ultimately decides regarding the
Agreement.

report shall include the currently available report that shows incident number, unit, date, alarm and arrival
time and response time. Specific individual response times and locations within the quarterly report may be
requested by the Committee from time to time for the purpose of clarifying the individual specific response
times.
TCVFD assumes all liability for damages caused by the negligent operation of its fire trucks or equipment,
and agrees to obtain automobile liability insurance covering the operations of its trucks said insurance to
have a minimum liability for bodily injury in the amount of $2,000,000.00 Combined Single Limit. TCVFD
shall provide separate written Endorsements to its General Liability Policy of Insurance for the following;

Naming the City as an Additional Insured, Waiver of Subrogation, Primary and Non -Contributory Insurance
Coverage and Thirty (30) Day Notice of Cancellation. A Certificate of Insurance along with said

requirements. Providing a Certificate of Insurance by itself or in lieu of the required written Endorsements,
which states that the Endorsements apply to the policy, is not acceptable.
The City, recognizing the value of mutual aid agreements between fire departments, agrees to permit
TCVFD to continue with such agreements. TCVFD needs to remain in compliance with the Department of
Commerce standard requirements for Comm. 30 to continue receiving the 2% Fire Insurance Entitlement
Dues.
TCVFD agrees to indemnify, defend, and hold harmless the City, its elected and appointed officials, officers,
employees, agents, representatives and volunteers, and each of them, from and against any and all claims,
demands, damages, suits, and actions, including attorney's fees, caused by reason of any act, omission,
fault, or negligence, whether active or passive, of TCVFD or of anyone acting under its direction or control
or on its behalf. The obligation to indemnify, defend, and hold harmless the City, shall be applicable unless
liability results from the sole negligence of the City, its elected and appointed officials, officers, employees,
agents, representatives and volunteers.
TCVFD agrees to wholly participate with the City's consultant in the evaluation of current services and
participate in discussions relating to the advice and recommendations of said consultant regarding future
fire protection services for the City.
Each party agrees to provide notice to the other party at least sixty (60) days prior to the expiration of this
agreement if any contract terms other than term and payment are expected to be different than as described

Either party can terminate this Agreement for any reason upon providing ninety (90) days' written notice to
the other party. In the event of termination, TCVFD shall be paid for its services as defined in this Agreement
