PUBLIC WORKS AND SAFETY Minutes 11032025Unapproved CITY OF MUSKEGO PUBLIC WORKS AND SAFETY COMMITTEE MINUTES 11 /03/2025 5:00 PM Muskego City Hall, W182 S8200 Racine Ave CALL TO ORDER Alderperson Madden called the meeting to order at 5:00 PM. PLEDGE OF ALLEGIANCE Those present recited the Pledge of Allegiance. ROLL CALL tie C4 of iTSKEGO Present: Alderpersons Madden, Duelge and Decker; Scott Kroeger and Director of Public Works and Development Absent: None STATEMENT OF PUBLIC NOTICE The meeting was posted in accordance with open meeting laws on October 31, 2025. APPROVAL OF MINUTES Approval of Minutes of 10/28/2024; 01/20/2025; 04/14/2025; 07/21/2015 and 10/20/2025 Meetings. Alderperson Duelge made a motion to Approve the Minutes engross. Alderperson Decker seconded. Motion Passed 3 in favor. STATUS OF PROJECTS Discussion update. No formal action may be taken on the following: UNFINISHED BUSINESS Discussion update and possible action may be taken on any or all of the following: NEW BUSINESS Discussion update and possible action may be taken on any or all of the following: Possible Reconsideration of Golf View Estates Development Request for Ditches vs. Curb and Gutter Alderperson Duelge made a motion to Possibly Reconsider the Golf View Estates Request for Ditches vs. Curb and Gutter. Alderperson Decker seconded. Director Kroeger began by re -explaining the basics as to why the City would prefer curb and gutter in this area instead of ditches. He also referred to the map and more recent areas of development near the Golf View area that all have curb and gutter. The only current areas with ditches are Madyson Ct and Baseler Ct. It is a cleaner look and less to maintain in the future. He then told the Committee they need to decide if they want to see a rural or urban cross-section with this new development. Alderperson Duelge questioned the part of the process where this will be turned over to the owners of the property/HOA in the future to maintain. Dir. Kroeger stated it will include the grass, drainage, trees, etc. in this area. Aid. Duelge didn't realize how problematic this could be in the long-term future. Dir. Kroeger explained with curb and gutter, the City just takes care of the issues on our own. The problems usually occur further into the future when areas/trees are overgrown, drainage issues, HOAs are defunct or have no money to fix problems. Our complaints, City-wide, are on the rise, and some are in areas where no one knows whose responsibility it is to maintain. Requiring curb and gutter, we as the City, will take care of any future issues. Mayor Petfalski stated you can put into any Developer Agreements that ditches must be maintained, but legally how do we enforce that in the future, when the ditches are technically in the City Right -of - Way? This is only enforceable until someone in the future decides to challenge the DA. Aid. Decker asked about the history and re -zoning of this property. Dir. Kroeger briefly explained the history of the development, but reminded Aid. Decker that the only item presently being discussed is ditches or curb and gutter. The developer could re -zone again, but it won't change this current discussion. Aid. Madden stated she stands by her original vote of requiring curb and gutter. She also had residents reach out after the last meeting that they wanted curb and gutter in that area as well. Mayor Petfalski stated he also stands by our City standards of requiring curb and gutter for this type of subdivision. It's cleaner looking and possibly functions better than ditches. He stated the developer was given a chance to ask for a waiver and now a decision needs to be made. He also worries about setting precedence for future subdivisions that want to utilize ditches. Developer, Brian Schoenleber, spoke regarding the type of cliental building more expensive homes in this area on slightly larger lots, with lower density and the fact that the current code would allow ditches. He doesn't believe these future owners with big, beautiful houses and manicured lawns, would allow their ditches to become unsightly. Aid. Duelge asked if this would be going on to Common Council for final approval. Mayor Petfalski stated that because this item is basically a waiver, it only needed to come before this Committee. He continued that he was more concerned about the functionality, not the aesthetics, of the ditch line over time. Our DPW (Public Works) spends a lot of time digging out and regrading ditch lines for drainage to continue flowing properly. The Mayor also helped the Committee with the technicalities of the reconsideration of the motion. Following a Roll Call vote, the Motion Failed 3 opposed. Mr. Schoenleber asked again what the difference is between his development and Baseler Ct. Dir. Kroeger stated that Baseler Ct is in a completely rural area and no one has curb and gutter. Madyson Ct is similar with the entire area being ditches and large lots. He continued that Golf View Estates is being built in an area with many surrounding subdivisions that have curb and gutter.
