CITY OF MUSKEGO Staff Report to Public Works and Safety Committee To: Public Works and Safety Committee From: Scott Kroeger, PE, PLS, Public Works and Development Director Subject: Request by Golf View Estates. Date: October 20, 2025 Golf View Estates development is located on the north side of Ryan Drive approximately 200 feet east of the intersection of Brookview Court and Ryan Drive. I have included an aerial map to provide you reference. This development's preliminary plat was approved by Common Council in February 2024 as a 19-lot conservation subdivision. The lot sizes were all under an acre. The Public Works and Safety approved this plan in April 2025. The developer wants to go back to their original yield plan 15 lots that are 44,000 sf. I have attached their yield plan. On behalf of the developer, they would like to pursue this lot arrangement. They also would like to request approval for constructing the road as a rural road cross section per your standards instead of a curb and gutter street. The cost of the curb and storm sewer make the development too costly to construct. Plus, we feel that these larger lots on public sewer and water gives the city a unique development that should be very attractive to future residents of Muskego. We would still install sanitary sewer and water to serve the lots. The developer would still need to get a new preliminary plat and final plat approved through Plan Commission and Common Council. Per City of Muskego Municipal Code, the developer has the right to ask this committee for a ditch cross section instead of curb and gutter. The code is below. This committee is not looking at anything else with regards to this development. The City of Muskego Municipal Code 392-35 General Standards A.(2) Should a land division create parcels with an average size of greater than 40,000 square feet, the developer may choose to request a Public Works and Safety Committee decision regarding the type of improvements required. The only option the Public Works and Safety Committee will consider other than curb and gutter section is ditch section construction per City of Muskego specifications. Should this option be permitted, the ditch sections shall be maintained by the developer initially and ultimately the homeowners' association. Furthermore, these restrictions outlining the responsibility for this maintenance shall be recorded in a developer's agreement approved the City's Common Council concurrent with the final land division document. If Public Works and Safety Committee do allow a ditch section for this development, this will go to the Common Council for their full recommendation. 3 Recommendation for Action by the Committee: Planning and Engineering: Golf View Estates does not seem like a good candidate for curb and gutter removal. While the lots do meet the minimum size requirements to be able to ask for a possible curb and gutter waiver, the bulk of the lots are not too much larger than said minimum (40,000 SF) needed for this type of request. Also, other developments that have occurred along Ryan Rd. have curb and gutter, which have set a tone for the standard aesthetic in that area. These other neighborhoods with curb and gutter in the area include Champions Village, St. Andrews Condos and Muskego Lake Estates. Curb and gutter have a cleaner look with less required maintenance due to not needing to maintain the ditches that would otherwise be present.
