Last year the owners of Tipsy Turtle obtained Plan Commission approval to add an outdoor seating area along the west side of the building consisting of a raised concrete patio with pillars and a fence through Resolution PC 034-2024. Now the petitioner is seeking approval to add overhead glass panel doors to the western side of the building to connect the indoor space with the outdoor seating area. CONSISTENCY WITH ADOPTED PLANS O47-2025 Comprehensive Plan: The 2020 Plan depicts the property as Low Density Residential uses. As a continued commercial use, this proposal is consistent with the Plan. Zoning: The property is zoned BL-1 Lakeshore Business District. This proposal is consistent with the Code. STAFF DISCUSSION PC 047-2025 As is noted above, the Tipsy Turtle bar recently expanded their outdoor seating area to add 3,138 square feet of area for tables, an outdoor bar and a 6' tall screen to shield the backside of the building and waitress station from the outdoor seating area. Tipsy Turtle has also recently submitted building permit plans to modify the interior of the building including moving the bar and expanding the restrooms. Currently, in order to move from the indoor space to the outdoor space patrons are moving through the standard door opening that leads to the corner of the outdoor space. This approval will allow the petitioner to replace the two large windows with two glass panel overhead doors to connect the indoor and outdoor spaces. There are no additional exterior changes to the building or the site as part of the overall proposal. Additionally, no new lighting or signage has been proposed at this time. Any future signage or exterior lighting changes will need separate permits/approvals. Overall, staff feels this elevation improvement should be a nice addition to this property. (USH 45) / Tax Key No 2257.973.001 NE'/4 and SE'/4 of Section 25 PETITIONER: Planning Division INTRODUCED: March 4, 2025 LAST AGENDA: March 4, 2025 PREPARED BY: Adam Trzebiatowski, AICP BACKGROUND PC 003-2025 This parcel is located off of Loomis Court and North Cape Road (USH 45). In past years the Annual Review was based on the southern portion of the site that contains two buildings. This year the northern portion of the site that is fenced was added to the review based on the conditions of approval of Resolution PC 029-2024 that required site work near the wetlands. The southern building contains mini -storage units and an office/retail space, currently used by Badgerland Auto. The northern building contains mini -storage units, one auto repair and sales businesses and a construction management company. These two building locations were on two separate parcels at one time but when the northern building was built, the two parcels were joined into one. The BSO and CUG approvals for this site were approved under Resolutions #P.C. 053a-2003, #P.C. 067-2004, #P.C. 050-2005, #P.C. 025-2007, W.C. 033-2014, #P.C. 065-2017 and W.C. 024- 2019. An annual review is required. The basic conditions of the approvals are as follows: 1. Two auto sales and repair businesses may operate off the northern building on the site. 2. Auto sales and detailing can occur from the southern building on site. 3. There can be no more than five (5) vehicles for sale on this property in the pre -approved locations near the northwest corner of the northern building for the first auto repair business. 4. For the second auto repair business there can be no more than eight (8) vehicles (six (6) vehicles for sale) on the northern side of the north building and no more than three (3) vehicles parked on the east side of the northern building. 5. The southern building's office area is limited to only five (5) small motor vehicles for outdoor display. These displays can only be out during business operating hours. 6. All other outside storage (other than noted above) of vehicles, materials, and/or other miscellaneous objects are prohibited at all times. 7. There shall be an enclosed gravel storage area with an asphalt approach on the northeastern portion of the site. The fencing of this area must include brown colored privacy slats. 8. There shall be no unapproved ancillary signage on the property for any reason. 9. All rental vehicles, including but not limited to trucks, trailers, etc., must be stored at all times within the fenced area at the northeastern part of the site, with the exception of three vehicles parked east of the newer building. `V STAFF DISCUSSION PC 003-2025 Resolution PC 003-2025 was deferred at the March 4, 2025 meeting in order to complete the required improvements for the wetland setback area. A site visit on September 30, 2025 showed that the area along the inside of the fence that had the compacted gravel was scraped out as requested along with large rocks creating a border to ensure that the area remained open. The scraped area has not yet had any re -vegetation established yet. It's currently just dirt and it cannot remain that way due to erosion concerns. There are also other various disturbed areas on site that need to be re -vegetated. All disturbed and/or exposed dirt areas on the site must be re -vegetated with grass or other appropriate ground cover within one month from the date of this approval. The gravel base for the secondary driveway leading into the site was installed but it was not yet paved. Per the approved plans and the Zoning Permit, this driveway needs to be paved between the fence/gate and the road edge. This paving must be completed within one month from the date of this approval. Also, there are a few trees to screen the fencing towards the west that was part of the 2nd driveway access project that have not yet been installed. The owner stated that the trees would be planted this week and as of this writing we have not heard that the trees were planted. The plantings must be installed within one month from the date of this approval. Staff is recommending approval of the resolution, subject to the resolution being amended to place the re -vegetation, paving and tree planting requirements as conditions for approval of this annual review. Pictures from the recent site visit are attached. Failure to comply with the deadlines noted above, and in the resolution, could result in further actions, including the possible issuance of citations. A site inspection was completed on February 11, 2025 and the site was found to be mostly in compliance. The items found to not be in compliance were the number of vehicles and location of said vehicles present that exceeded the number approved during the BSO and CUG on the northern side of the property where Elegant Auto is located. Additionally, on the eastern side of the newer building there were more than the three allowable parked vehicles. A violation letter was sent to the tenants with the owners copied and a follow-up inspection was completed on February 21, 2025. Upon this site inspection the additional vehicles were removed and the site was compliance at that time. The northern outdoor storage area is required to install a barrier along the edge of the wetland protection offset throughout the entire fenced area as well as remove all gravel or recycled asphalt from the wetland protection offset area as well as remove anything being stored from the same area. This has not been completed at this time and the owner has stated that they plan on commencing this work in spring also including the 2nd drive access along the western side of the fenced area. (a for -profit company) is seeking a Building, Site and Operation (BSO) Plan amendment to be allowed to keep a large donation container/box in the parking area of the multi -tenant building at the corner of Janesville Road and Bellview Drive. The site is used as a car wash, laundromat and a nail salon. The donation box was placed in this location and during final occupancy inspections of the nail salon, the donation bin was noticed and with no previous approvals was required to be removed as a condition of occupancy unless Plan Commission approval was granted. Even though there are several of these donation bins located time -to -time throughout the City, the Plan Commission has never approved any of them. This is the first petition to be brought to the Plan Commission for approval for these types of donation bins. CONSISTENCY WITH ADOPTED PLANS 037-2025 The 2020 Plan depicts the property as Commercial uses. The company Comprehensive Plan: that owns the donation box is a business; there is no other portion of the business located on the site other than passively collecting donated items. This proposal is consistent with the plan. The property is zoned B-4 — Highway Business District, which allows a wide range of uses. However, without an actual store or facility to handle the Zoning: materials, the Plan Commission is being requested to determine whether a donation box for a commercial use located elsewhere is a use that should be allowed in the B-4 — Highway Business District. STAFF DISCUSSION PC 037-2025 Resolution PC 037-2025 was deferred at the September 2, 2025 meeting to the October 7, 2025 meeting so that the petitioner could work out several issues including the location of the donation bin on a new site plan with a parking stall striped for no parking if needed; the color of the donation bin to match the colors of the building; and the owner of the property being the petitioner or the owner of RDCycles being a co -petitioner. Staff reached out to the petitioner immediately after the September 2, 2025 meeting requesting this information so that it would be included for Plan Commission review. There has not been any information submitted to update the Plan Commission. 21 As a result of not abiding by the direction from the Plan Commission to submit additional information, staff recommends deferring Resolution PC 037-2025 for one additional month. If nothing is submitted by the deadline for the November meeting then the petition be denied. The Resolution has not been altered in any way since the last meeting. As noted above, RDCycle, LLC. installed the donation container at its current location along Janesville Road and was notified that Plan Commission approval would be required if they intended to keep the container there. The container is located in the northeast corner of the parking lot and is within a single parking stall. When the original addition to the car wash was approved by the Plan Commission, via Resolution PC 049-2019, determined that there were ample parking spaces on the property for the size of the building and there were no concerns about the overall number of stalls. The Plan Commission is being asked to discuss and approve this petition and since there has not been any approvals for donation bins in the City in the past, to determine whether this is an acceptable use on a commercially zoned property, the appearance/condition of the donation bin, whether or not the bin is located in an acceptable area of the property and any conditions they wish to impose for this and any future donation bins to be located in the City. Previously mentioned, this area is planned for and zoned for commercial uses. This business is headquartered in New Berlin so the donation box would be adding another separate commercial user to this site. The Plan Commission is being asked to determine if the donation box, for another commercial user, is sufficient to be an allowed use in the District. Staff comments: It is not the idea of adding another commercial use to a site with a multi -tenant building, but more so the idea of approving a non -occupant feature/user, not within the main approved building on site. If the Plan Commission is willing to allow this additional use on site, staff would recommend adding a timeframe before re -approval is required. As for the location of the bin, it is currently located in the front (northeast) parking stall. They are seeking a highly visible location that is out of the way of traffic. The petitioner believes that moving the bin to another location on the site would affect the performance of the bin, the safety for the public to use and the visibility for the public to use and remember that it is still there. Staff comments: Staff likens a donation bin (as proposed here) to outdoor sales/display similar to those approved at gas stations/convenience stores. Those outdoor sales/display containers are typically required to be located next to the building or between gas pumps and painted to match the building. If the bin is allowed here without restrictions, could this be a drive for each commercial lot along Janesville Road to install a donation bin near the road which would take away from the purpose and guidance of the Downtown Design Guide which is to "enhance and unify its visual character while avoiding monotony and repetition. These standards will also assist in fostering sound, functional, attractive and quality development. " The bin itself is 45.5 inches x 43.25 inches x 76.5 inches and is painted green with stickers identifying it as a donation bin with info on it identifying acceptable materials. With these dimensions, there are no issues with the donation bin being fully contained in a single parking stall. Having the bin fully within a single parking stall would be not in the way of thru-traffic, but will occupy a parking space and two spaces during pickup times. It is out of traffic for those visiting the other commercial uses on the site. The bins are repainted and new stickers applied as needed, per the operator. Staff comments: The size of the donation bin will keep the bin within a single parking stall where there were no concerns during the initial approval process for the building. Adding a condition regarding the appearance of the donation bin would ensure that the bin is maintained without paint or stickers peeling. The petitioner notes that they offer weekly pickups to empty the donation bins along with a 24-hour notice for `emergency' pickups if the boxes are too full. The petitioner would be willing to install a security camera or sensor on the donation bin to alleviate any donations being left outside of the container or overfilling. Pickups are during normal business hours, but the petitioner would be willing to change pickup times if necessary. 0 Staff comments: Weekly pickups may suffice for much of the year. However, there must be some accountability on the petitioner to ensure that there is never a time with donation materials outside on the ground outside of the container. Waiting for a complaint to respond within 24 hours is not acceptable and may result in unsightly outdoor storage for a potentially lengthy period of time. Staff has observed unapproved bins within Muskego, as well as in other communities from time to time that can often be too full or overflowing so that donations are pouring out of the bin and/or scattered around the outside of the bin. This is the biggest concern for staff. The Plan Commission should discuss these general topics, along with the specifics of this site, as it relates to these clothing donation bins to determine how they want to proceed. Based on the topics and comments noted above, the Resolution is drafted to approve the donation bin on this property, based on the with the following conditions: BE IT FURTHER RESOLVED, That an annual review be scheduled for each March to ensure that the donation bin remains in good condition and to ensure that no complaints have been made and to be sure that no overflows and/or material being stacked outside of the bin were observed during the past year. I appreciate your willingness to work with me on developing an arrangement that is beneficial to the city, the citizens, and myself. I am seeking the permission the use a small area of a parking lot for the collection of textiles. This benefits the citizens by reducing textile waste and decreasing the amount of garbage. 95% percent of textiles that go into landfills can be recycled. Nearly 17,000,000 tons of textiles are thrown away in the United States every year representing 6.3% of the country's waste. Janesville road provides an ideal location because of it's commercial nature and high visibility. This is on my route and allows me to easily empty the bins on a weekly basis. Because it on a parking lot, my truck can access the bins. Also, logistically it is essential to avoid empty miles coming out of New Berlin to access other bin locations along the route. Your concern for spilling, or items being left outside of the box: I agree that you should never see anything outside the box. The box is for textiles, mainly shoes and clothing. Anyone placing these items in the weather is not using their best judgement. This hasn't been a concern at this location. If this rare occurrence happens, the landlord would likely be notified and let me know. The only other option is to put a security camera to watch the bin. I am willing to do this. 2. When it comes to overflowing, the owner agreed to notify me. Only on a very rare occasion has this bin overflowed. The only other option to deal with this is to install a sensor that would let me know when it is nearly full. If necessary, I am willing to install a sensor. The location of the bin provides easy access and is out of the way for the other businesses. The landlord believes it is an ideal location and has given us permission to be on his property. We prefer if the bin stands out to be highly visible. We have heard of pedestrians walking into bins on occasion and therefore want the bins to be easy to see. We also want the brand to be noticeable for consumer alure. We believe the artwork we placed on the bins are attractive and essential. The bin dimensions are 45.5 inches x 43.25 inches x 76.5 inches. M We believe that the location of the bin is the perfect spot. It's out of the way and doesn't interfere with any of the traffic at the site. It's an easy and safe drop off point for the landlord's customers and other citizens. It being visible, is literally the whole point of having it there. How are citizens supposed to know it is there or use it if it's not easy, safe and convenient for them to drop off? Moving it to a different location on the property most likely would affect multiple things. The performance of the bin, the safety for the public to use, and the visibility for the public to use and remember it is still there. STAFF DISCUSSION PC 046-2025 As noted above, Brian Romans is seeking sign approval from the Plan Commission on behalf of the Muskego Youth Football program again for additional lighting. All details of the lighting including the portable generator light trailers, the timeframe and positioning of the light trailers will be similar to past years. The difference will be the number of generator -powered temporary light towers. All of the lights will be positioned to face in a westerly direction towards Bay Lane Drive, which would be parallel to the neighbors to the north and south and away from the neighbors to the east. Additionally, the light trailers may not be identical to one another, but will be very similar as the Muskego Youth Football program will likely be forced to mix the lighting trailers between diesel, gas or solar based upon availability to rent. This petition would raise the number of generator -powered temporary light towers at this location from five (5) to ten (10) trailers. The towers extend to a height of 25' 8" with four LED light fixtures on each trailer. The temporary lights will be used on weekdays only between September 22nd through November 1st each year. This is roughly a week sooner and three days later than the previous approvals. The lights would be on from dusk until 7:30 PM, which is 1/2-hour earlier than the last approvals. 48 The lighting trailers will be located approximately 100 feet from the property line to the south and the same must occur to the property line to the east. The intention is to be able to continue to hold youth football practice at Bay Lane Elementary School with lighting on each of the practice fields, which does not have any lighting on the open field that is used for football in the fall. Since football occurs during the fall months and daylight shrinks with sunset occurring earlier by the day the Muskego Youth Football rents lights to allow for evening practice toward the end of their season. Exterior lighting for specified outdoor recreational uses allows for light sources not exceeding a maximum pole height of fifty (50) feet. The proposed lighting is much shorter than allowed. According to the specifications submitted for the initial lighting proposal, the light spillover with the light height at 23 feet and on a 70-degree tilt will broadcast at least 0.5 footcandles of light nearly 200 feet. Based on the location of the lights being approximately 100 feet away from the property lines, there would be less than 0.5 footcandles on their property and the lights will be completely turned off by 7:30 PM. The Planning Division did not receive any complaints or concerns regarding the lights since the original approval in 2022. The petitioner did reach out to each of the neighbors to the south through a letter to notify each of them and ask for any questions/comments for their petition. At the time of this writing there have not been any concerns raised by the neighbors. Building, Site and Operations Plan Application Planning Services — Community Development Bay Lane Elementary Expansion of Temporary Lighting Plan September 19, 2025 Dear Plan Commission Members: On behalf of the Muskego Youth Football, Inc. ("MYF" organization, my name is Brian Romans and please accept this submission and application to allow for additional portable temporary lighting at Bay Lane Elementary ("BLE"). Description of this request: MYF holds practices for almost 350 players at BLE on weekday evenings. Over the years, MYF has worked closely with BLE leadership to minimize any impact to the school functions, including end of day pickups and traffic patterns. MYF's goal is to be an excellent user of these facilities and works closely with BLE and the surrounding Muskego neighbors. As an organization, MYF provides an outlet for youth athletes ranging from 1 st grade through 8th grade to participate in organized team activities, practices (conducted at BLE) and games (with home games at Muskego High School). In doing so, MYF places a strong emphasis on the safety and well-being of its participants, families and their coaches, especially as it navigates currently having a total of 12 teams throughout the program. In fact, MYF recently purchased multiple AED devices which are stored on -site at BLE and accessible at field level. Previously, MYF was approved for 5 portable temporary outdoor lights for use between October 3 through October 28 at BLE as outlined in Resolution #P.C.052-2022 which was subsequently extended by Resolution #P.C. 049-2023. Currently, practice start times range from 5:OOpm-7:30pm at BLE with most teams practicing 3 or 4 nights per week (Monday through Friday - No weekends). Each of the 12 teams has a dedicated practice area at BLE. Historically, with the 5 approved portable temporary outdoor lights, there were several fields that did not receive much, if any, illumination, leaving some teams and fields in the dark. Accordingly, MYF is seeking modification of the previously approved Resolutions as follows: approval for 10 portable temporary outdoor lights for use Monday through Friday between September 22nd and November 1 st of each calendar year. We would further restrict the time per day to be from dusk until 7:30pm, further reducing the hours of operation. All other restrictions previously imposed would remain in effect. The need for the additional lights is to help with safety of the players leaving the practice fields and having sufficient light during practice when sunset occurs around 6pm toward the end of October. MYF has considered and evaluated other options, including starting practices earlier or holding more practices during the week with shorter time intervals. These options, however, present more negative impacts, including, without limitation, conflicts with BLE dismissal and student release times, traffic congestion that would impact all students and busing efforts, safety, family and coaches' availability for such early practices, as well (a LO as league rules on timing limitations for practices allowed. In the end, MYF has been diligent in its application and use of the previously approved temporary lighting and, to MYF's knowledge, there haven't been any complaints by the neighboring properties related to use of the temporary lighting. In consideration of the surrounding Muskego residents, MYF will continue to take the following measures to reduce and, if possible, eliminate any impact: 1. MYF will rent the newer models of light plants that generate very little sound. These newer and more costly light plants almost eliminate sound at a distance of 25 feet. 2. The lights from the units will be directed only onto the practice fields and will not be directed toward BLE neighbors. 3. MYF will place the light plants in efficient locations to only shine on the practice fields. 4. The lights will not be used on weekends. 5. The lights will be turned off by 7:30pm. 6. ("MYF") organization. My name is Brian Romans. I currently have three boys in the MYF program (2nd grade, 4th grade and 6th grade), with my 4-year-old son anxious to join his older brothers. In addition to serving as an assistant coach for my 41h and 6th graders, I also serve as an executive board member of MYF. My commitment to MYF as a board member is, in part, my way of giving back to our community to help ensure that the MYF program continues to support our youth (1st through 8th grade) and their athletic goals (and passion) to play football for Muskego High School. To further our efforts as an organization, I am writing this letter to inform you of MYF's recent submission and application to the Plan Commission to allow for additional portable temporary lighting at Bay Lane Elementary ("BLE"). As you are likely aware, in 2022 (to the present), MYF was approved for five (5) portable temporary lights to illuminate its youth practice football fields at BLE between October 3rd and October 28th from dusk until 8:00pm. As an organization, MYF provides an outlet for youth athletes ranging from 1st grade through 8th grade to participate in organized team activities, practices (conducted at BLE) and games (with home games at Muskego High School). In doing so, MYF places a strong emphasis on the safety and well-being of its participants, families and their coaches, especially as it navigates currently having a total of 12 teams throughout the program. In fact, MYF recently purchased multiple AED devices which are stored on -site at BLE and accessible at field level. Currently, MYF practice times range from 5:00pm-7:30pm at BLE with most teams practicing 3 or 4 nights per week (Monday through Friday - No weekends). These practices generally occur from August 1 st through October 31 st. Importantly, each of the 12 teams has a dedicated practice area at BLE so that players and parents can easily identify the practice location for efficient drop- offs and pick-ups. Also, this allows grade levels with multiple teams to practice near each other for coaches' collaboration, scrimmages, etc. However, given the nature of the portable temporary lights, once placed in a particular location they cannot be easily moved. As a result, the previously approved five portable temporary outdoor lights left several fields and teams without much, if any, illumination, leaving some teams and fields in the dark. MUSKEGO YOUTH FOOTBALL UNITY — FAMILY - BROTHERHOOD 62 Accordingly, MYF is seeking modification of the previously approved resolutions as follows: approval for a total of ten portable temporary outdoor lights for use Monday through Friday between September 22°d and November I" of each calendar year to more appropriately cover the current practice times and field/team locations. MYF would, however, further restrict the time per day to be from dusk until 7:30pm, reducing the previously approved hours of operation from the currently approved end time of 8:00pm. As for all other restrictions previously imposed, MYF would propose those remain in effect — namely positioning of lights away from BLE and its eastern and southern neighbors, no use on weekends and continued use of newer models of light plants to help further reduce noise. The request for additional lights is in line with MYF's commitment to safety and to provide additional illumination for players leaving the practice fields, parents picking up participants, and also having sufficient light during practice times as sunset is around 6pm toward the end of October. MYF has considered and evaluated other options, including starting practices earlier or holding more practices during the week with shorter time intervals. These options, however, present more negative impacts, including, without limitation, conflicts with BLE dismissal and student release times, traffic congestion that would impact all students and busing efforts, safety, family and coaches' availability for such early practices, as well as league rules on timing limitations for practices allowed. In the end, MYF is unaware of any current complaints by BLE's neighboring properties related to MYF's use of the temporary lighting. In summary, MYF plans as follows: 1. MYF will rent newer models of light plants that generate very little sound. 2. The lights from the units will be directed only onto the practice fields and will not be directed toward BLE neighbors to the East or South, nor toward the BLE building. 3. MYF will place the light plants in efficient locations to only shine on the practice fields. 4. The lights will NOT be used on weekends. 5. The lights will be turned OFF by 7:30pm. 6. The lights will be utilized between September 22nd-November lst. In the end, MYF seeks these minor modifications to provide more efficient use of practice times available by increasing illumination on the practice fields that aligns with current practice schedules. In doing so, it allows MYF to limit their use from dusk until 7:30pm (with most teams ending practice by 7:00pm). The current proposal measures 1,128 square feet in area. The proposal meets the bulk requirements of the Zoning Code. A building permit was also obtained with conditions applying Resolution PC 021-2025 based on the Plan Commission approval. Then during final inspections it was found that the colors did not match the house. The BSO Narrative from the petitioner for the April meeting stated, "The structure was designed to have a residential look with the colors matching Ed's house colors perfectly." Photos from the inspector are included in the submittal. Resolution PC 021-2025 states: "BE IT FURTHER RESOLVED, The colors of the proposed building must be similar to the colors of the home." Plan Commission may waive the architectural requirements for accessory structures when any of the following are met: 1. The structure is screened from view, 2. The principal structure is composed of materials, colors, or styles that are inappropriate in their applications to an accessory structure, 3. The Plan Commission finds other circumstances to be present which would result in no undue harm to the property or its surroundings, 4. When the area is found not to be predominately residential. The architectural requirements state that the accessory structure should have similar materials and colors as the principal residence. The petitioner is proposing a beige steel siding on the accessory structure to match the beige color of the house. The roof will be a metal charcoal color to match the color of the roof on the house. Planning Commission approval is being sought due to the difference of materials. The accessory structure would be located 6'8" from the rear property line and 5'8" from the side property line with the second structure five feet away from the first structure. The proposed height of the building is approximately 101.75", which is within the allowable height of an accessory structure this size with the proposed distance to the property lines. The petitioner notes that there is an alternating board on board privacy fence surrounding the entire backyard so the majority of the accessory structures will not be visible from surrounding views. The petitioner also identifies the durability of steel, longevity and the fact that metal sheds are low maintenance as reasons for the metal sheds. From a cursory review sheds the offsets, height and location appear sufficient to meet the Code. Open space is another requirement that some lots have issues meeting. This lot is no different from the others in the RS-2 District in the City and requires either 15,000 square feet of open space or 75% of the lot remain as open space, whichever works best for the owner. If the Plan Commission approves the use of the metal for the accessory structures, staff will require a new survey be submitted with the building permit application identifying the hard space verses open space on the property to ensure the open space requirement is met. Additionally, the unapproved/unpermitted carport will need to be removed from the property before a Building Permit can be issued for the sheds. Lastly, the existing shed in the backyard needs to be removed as part of the permit process. Historically, the Plan Commission (PC) has not typically granted material waivers for metal clad structures in neighborhood settings, such as this area. The one difference in this case is that the applicant has stated that the entire backyard is fenced and as such believes that the sheds will be minimally visible. Staff's concern with this is what happens if the fences are ever removed or fall down. THEREFORE BE IT RESOLVED, That the Plan Commission approves of two (2) 120 square foot accessory structures for the Pollack property located at W192 S7420 Richdorf Drive / Tax Key No. 2189.148. BE IT FURTHER RESOLVED, The colors of the proposed building must be similar to the colors of the home. BE IT FURTHER RESOLVED, That a new survey be submitted with the building permit identifying the amount of hardspace verses open space on the property to ensure the open space requirements are met.
