APPROVAL OF TWO METAL ACCESSORY STRUCTURES FOR
THE POLLACK PROPERTY LOCATED IN THE NE 1/4 OF SECTION 8
(W192 S7420 RICHDORF DRIVE / TAX KEY NO. 2189.148)
WHEREAS, A survey, building drawings and photos were submitted to construct two (2) 120
square foot accessory structures on the property located at W192 S7420 Richdorf Drive / Tax
Key No. 2189.148, and
WHEREAS, The property is zoned RS-2 Suburban Residence District, and
WHEREAS, The 2020 Plan depicts the area for Medium Density Residential land use and the
proposal for these residential outbuildings is consistent with the Plan
WHEREAS, The proposal does not meet the Plan Commission's standards for administrative
approval of residential accessory structures as metal exterior materials being proposed on the
accessory structure, and
WHEREAS, The total square footage for accessory structures allowed on this property is 720
square feet as long as all other Code requirements are met, and said proposal meets the bulk
requirements of the Zoning Code, and
WHEREAS, The petitioner proposes to construct two (2) metal accessory structures measuring
10' x 12' (120 SF) each, and
WHEREAS, The accessory structures will be used for personal storage only, and
WHEREAS, The sheds will each have beige steel siding to match the beige color of the house
and a charcoal colored metal roof to match the color of the roof on the house, and
WHEREAS, Each accessory structure would be located 6'8" from the rear property line and 58"
from the side property line with the second structure five feet away from the first structure with a
height of the building being approximately 101.75", which is within the allowable height of an
accessory structure of this size with the proposed distance to the property lines, and
WHEREAS, The petitioner notes that there is an alternating board on board privacy fence
surrounding the entire backyard so the majority of the accessory structures will not be visible from
surrounding views, and
WHEREAS, The petitioner also identifies the durability of steel, longevity and the fact that metal
sheds are low maintenance as reasons for the metal sheds.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of two (2) 120 square foot
accessory structures for the Pollack property located at W192 S7420 Richdorf Drive / Tax Key
No. 2189.148.
BE IT FURTHER RESOLVED, The approval of the metal accessory buildings is contingent
upon the fence remaining, or replaced with a similar fence.
BE IT FURTHER RESOLVED, The colors of the proposed building must be similar to the colors
of the home.
BE IT FURTHER RESOLVED, That a new survey be submitted with the building permit
identifying the amount of hardspace verses open space on the property to ensure the open space
requirements are met.
BE IT FURTHER RESOLVED, That the unapproved/unpermitted carport that is located next to
the garage must be removed from the property before Building Permits for the sheds can be
granted.
BE IT FURTHER RESOLVED, The existing shed in the backyard must be removed as part of the
Building Permit process.
BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the
approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation
of legal action, or both.
