PCR2025048 Herda Accessory BldgRESOLUTION #P.C. 048-2025 APPROVAL OF A METAL ACCESSORY STRUCTURE FOR THE HERDA PROPERTY LOCATED IN THE NW 1/4 OF SECTION 26 (W145 S9685 GROVEWAY LANE / TAX KEY NO. 2261.980) WHEREAS, The petitioner obtained approval for a waiver to the architectural requirements to allow for a metal accessory structure via Resolution PC 021-2025 on the property located at W148 S9685 Groveway Lane / Tax Key No. 2261.980, and WHEREAS, The original proposal did not meet the Plan Commission's standards for administrative approval of residential accessory structures as metal exterior materials were proposed on the accessory structure, and WHEREAS, A building permit was obtained based on the Plan Commission approval and upon final inspections it was found that the colors of the accessory structure were not what was approved by the Plan Commission and did not match the home, as was stated it would based on their application to the Plan Commission, and WHEREAS, The applicant is now requesting to be allowed to leave the house and accessory structure with their current colors, and WHEREAS, The Herda property is at the end of the cul-de-sac of Groveway Lane along the shore of Big Muskego Lake and the accessory structure is located behind the house and almost 275 feet from Groveway Lane, and WHEREAS, The petitioner also notes that the accessory structure is blocked from view from the only neighboring property by the tree lines and neighbor's garage, and WHEREAS, The property is zoned RL-1 Existing Lakeshore Residence District. THEREFORE BE IT RESOLVED, That the Plan Commission approves an amendment to Resolution PC 021-2025 allowing a new color scheme for the accessory structure for the Herda property located at W148 S9685 Groveway Lane / Tax Key No. 2261.980. BE IT FURTHER RESOLVED, All other conditions of approval of Resolution PC 021-2025 remain in full effect. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
