CCR2025.080-Approve sale of Vacant Land (Musk House)COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #080-2025 RESOLUTION APPROVING SALE OF VACANT LAND TO MUSKEGO HOUSE, LLC WHEREAS, Muskego House, LLC wishes to purchase vacant land owned by the City of Muskego; the land to be transferred is illustrated on the attached map and legal description of the property; and WHEREAS, the following circumstances are considerations for approval of the sale: 1. This area is land locked, and DPW is not able to maintain this area properly without going on adjacent property. This area of land has significant grade change as well. This means the City of Muskego would have to do a large amount of restoration to the neighbor's property each time we need to do work in this area. 2. This portion of the lake access has no riprap shoreline protection and is eroding. If a tree falls into the lake, it is very difficult to cut the tree and remove it. It is not cost beneficial for the City of Muskego to invest in riprapping this shoreland area. 3. The City is not selling the entire property as there is a culvert pipe that the City of Muskego needs to maintain for proper drainage in the area. Lake access for use by the public will still be available despite the sale of this small portion of land. 4. The land is not marketable and serves no public purpose; the only entity that has any benefit from owning this small strip of land is Muskego House, LLC, which owns the land adjacent to said transfer; and WHEREAS, negotiations between the City and Muskego House, LLC resulted in an agreement to transfer the property in an "as is" condition and by Quit Claim Deed to Muskego House, LLC for the amount of $8,000.00; and WHEREAS, closing documents have been prepared by the City Attorney for transfer of said property. NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Muskego does hereby approve the sale of the vacant land as depicted on the attached map and legal description to Muskego House, LLC. BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to sign the necessary closing documents in the name of the City and the City Attorney is authorized to make substantive changes to those documents as may be necessary in order to preserve the general intent thereof. BE IT FURTHER RESOLVED that the Mayor is authorized to sign such substantive changes made by the City Attorney. DATED THIS 2nd DAY OF DECEMBER 2025.
