RESOLUTION AUTHORIZING THE MUSKEGO PARK & RECREATION DEPARTMENT
TO SELL FERMENTED MALT BEVERAGES AT EVENTS HELD IN CITY PARKS
WHEREAS, the Muskego Park & Recreation Department organizes community events and
recreational programming throughout the City of Muskego's public parks for the enjoyment and
benefit of residents and visitors; and
WHEREAS, Wis. Stat. §125.06(6) provides that a license is not required for the sale of
fermented malt beverages by a municipality or by municipal employees in any public park
operated by the municipality, provided that the sale is authorized by an ordinance, resolution,
rule, or regulation enacted by the governing body of the municipality; and
WHEREAS, pursuant to said statute, the City of Muskego is seeking authorization by means of
a resolution, for activities that involve the sale of fermented malt beverages; and
WHEREAS, the Muskego Park & Recreation Department intends to continue holding such
events that include fermented malt beverages sales in City parks for an indefinite period of
time.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Muskego, that
the City of Muskego, including but not limited to, the Muskego Park & Recreation Department,
is hereby authorized to sell fermented malt beverages at events held in public parks operated
by the City of Muskego on an ongoing basis for an indefinite period of time.
BE IT FURTHER RESOLVED that such sales shall be conducted in a manner consistent with
all applicable state laws, municipal ordinances, and departmental policies relating to public
safety and responsible beverage service.
