APPROVAL OF REVISIONS TO THE MUNICIPAL ORDINANCE
DEPOSIT AND FORFEITURE SCHEDULE
WHEREAS, in accordance with Section 18-3(c) (Schedule of Deposits) of the City of
Muskego Municipal Code, Municipal Court Judge, Lisa Warwick is charged with the
authority to submit to the Common Council for approval an Ordinance Deposit and
Forfeiture Schedule for violations of City Ordinances, Resolutions, and Bylaws; and
WHEREAS, Gina McKinney, Judge Warwick's Court Clerk, reviewed the current
Municipal Ordinance Deposit and Forfeiture Schedule, which was last updated on
August 15, 2023, by Resolution #045-2023, and based on the creation of several new
ordinances, as well as, modifications of existing ordinances since that time, determined
that revisions are needed to said Deposit and Forfeiture Schedule so that it would be up
to date for the community at large and allow for implementation by Law Enforcement,
the City Attorney and the Municipal Court; and
WHEREAS, the following is a summary of the revisions made to the Deposit and
Forfeiture Schedule by Court Clerk McKinney:
— All citations written under chapters 135 (All -Terrain and Utility -Terrain Vehicles),
278 (Public Waters and Beaches) and 302 (Snowmobiles) will be issued as a
Non -Traffic Citation (NTC).
— Chapter 135 (All -Terrain and Utility -Terrain Vehicles), and all violations and
penalties associated therewith have been added due to the creation of said
ordinance.
— All violations of All -Terrain and Utility -Terrain Vehicles were removed from
Chapter 302 and placed under newly created Chapter 135 as indicated above;
that Chapter 302 is now limited to snowmobile violation and penalties.
— Added section 263-16(A) regarding the Possession/Consumption of Alcohol
Prohibited in a Vehicle with a forfeiture of $155.50.
— Added section 263-25 with corresponding penalties due to the newly created
Chronic Nuisance Ordinance.
— Added sections 263-1.946.32(1)(a), 263-1.946.32(1)(b), 263-1.946.32(2)
regarding False Swearing Under Oath with a forfeiture of $817.00 for each
subsection to assist with violations of the purchase of firearms by convicted
felons.
— Added section 334-8 Contributing to Truancy (Must Appear Citation) with a
forfeiture of $376.00, after investigation revealed said subsection was missing
from the Deposit and Forfeiture Schedule altogether; and

WHEREAS, The revisions noted herein have been incorporated into the attached
Municipal Ordinance Deposit Forfeiture Schedule; that said revisions are reflected in
green highlighting only for the purpose of review and passage by Council; that said
highlighting will be removed in the final Deposit and Forfeiture Schedule should it be
approved by Council; that the revisions have been reviewed by the City Attorney and
approved by Judge Warwick; and
WHEREAS, The Finance Committee has reviewed the changes and updates to the
Municipal Ordinance Deposit and Forfeiture Schedule and recommends approval to the
Common Council.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby approve
the attached revised Municipal Ordinance Deposit and Forfeiture Schedule.
BE IT FURTHER RESOLVED That in accordance with Section 18-3(c) of the City of
Muskego Municipal Code, the Municipal Ordinance Deposit and Forfeiture Schedule
once approved shall be posted in the office of the Municipal Court Clerk, as well as, the
Muskego Police Department.
