CCR1978180ti 1 i RESOLUTION #:180-78 RESOLUTION ESTABLISHING THE BIG MUSKEGO LAKE DISTRICT WHEREAS, The Common Council of the City of Muskego deems it necessary and in the best interest of the citizens of Muskego to pursue activities which will result in the improvement of Big Muskego Lake - Bass Bay and surrounding wetlands, be it resolved. Section I: Title: There is hereby established the Big Muskego Lake District. Section 2: Purpose- Big Muskego Lake District is established for purposes of undertaking programs, projects and activities to protect and rehabilitate the environment of Big Muskego Lake - Bass Bay, to improve the quality of the waters, to improve the fishery and wildlife habitat, and to change the condition of Big Muskego - Bass Bay to a condition of greater usefulness. Section 3- Territory: Said district shall be com- prised of the property and territory lying within the boundaries of the City of Muskego as described in Exhibit A, attached hereto and incorporated herein. Section 4: Governing Body: There is hereby created a Board of District Commissioners who shall be responsible for the management of the affairs of the district. The district commis- sioners shall be the members of the Common Council of the City of Muskego and the Mayor of the City of Muskego, who shall be its Chairman. Section 5: Organizational meeting: The Board of dis- trict commissioners shall hold an organizational meeting within 30 days from the adoption of this resolution at which time it shall: I. Elect a secretary and treasurer, who shall serve until the first annual election. 2. Adopt rules of procedure 3. Adopt by-laws Upon the election of the officers at the organizational meeting, the Board may commence conducting the affairs of the district. (2) The board may make an initial assessment of all taxable property within the district to raise funds to pay organi- zational costs and operate the district until the receipt of the tax voted by the first annual meeting. The manner of making the assessment shall be within the discretion of the board. Section 6: Advisory Body- A Board of District Deputies shall be responsible for advising the Board of District Commissioners and shall perform activities for the benefit of the district as directed by the Board of District Commissioners. Is • A u Section 7: Officers: ITEM A: The Board of District Commissioners shall elect a Secretary who shall keep minutes of ail Board of District Commissioners meetings, maintain the district election roll, and annually inform the Department of Natural Resources, State of Wisconsin, of the District's existence. ITEM B: The Board of bistrict Commissioners shall elect a Treasurer who shall receive and manage all district monies as directed by the Board of District Commissioners. Section 8: Compensation: District Commissioners, Deputies, and Officers shall receive no financial compensation but may be reimbursed for expenses incurred on behalf of the district. Section 9- Annual Meeting: The district shall have an annual meeting. The first annual meeting shall be scheduled between May 22 and September 8, and annually thereafter unless changed by vote at the previous annual meeting. (2) The annual meeting shall be preceded by written notice mailed at least 10 days in advance of the meeting to all electors within the district and persons owning lands within the district and whose address is known or can be ascertained with reasonable diligence, and to the Department of Natural Resources. In lieu of sending written notices to electors residing within the district, the Board of District Commissioners may substitute a Class 2 notice, under Ch. 985, Statutes. (3) The annual meeting shall: (a) Elect one or more commissioners to fill vacancies in the district board; (b) Approve a budget for the coming year; (c) Vote a tax upon all taxable property within the district for the costs of operation for the coming year, which tax shall not exceed a rate of 2.5 milis of equalized valuation, a report of which shall be delivered by the Treasurer, by October 31, by certi- fied statement to the clerk of each municipality having property within the district for collection; (d) Approve or disapprove all proposed projects by the district having a cost to the district in excess of $5100001 by vote of the electors and property owners within the district. The annual meeting may also authorize the Board of District Commissioners, during the succeeding year until the next annual meeting, to approve or dis- approve projects having a cost to the district in excess of $5,000, and to enter into contracts accordingly. (e) Take up and consider such other business as comes before it; Section 10. Business Meetings: The Board of District Commissioners shall meet at least four (4) times per year. Public notice of such meetings shall be made prior to the meeting. The Board of District Commissioners shall take up and consider such business as is brought before it by the district members. Section 11: District Powers: Big Muskego Lake District is a body corporate and may sue, be sued, make contracts, accept gifts, purchase, lease, devise or otherwise acquire, hold money, contract debt and do such acts as are necessary to carry out pro- grams of lake protection and rehabilitation. Section 12: Borrowing Power: The district may borrow or issue special assessment bonds as provided for by statute. Section 13: Financial Assistance: The district shall have the authority to apply for municipal, state, and federal aids. Section 14: Attachment and Detachment: The district may attach and detach territory as provided by statute. Section 15: Merger: The district may merge with a con- tiguous district as provided by statute.
