PCR2023033 Hrin Rustic Structure CUG ALTERNATEÐÏࡱsted prior to January 1, 2002, and
WHEREAS, A Public Hearing was held on June 6, 2023 in front of the Plan Commission, and
WHEREAS, This petition has been on the Plan Commission agendas on June 6, 2023, August 1, 2023 and November 7, 2023 and deferred each time, and
WHEREAS, The petitioner adjusted the petition for the Rustic Structure designation in two parts including:
Lot 3 of Certified Survey Map 12377 will be increased 13,000 square feet with land from Lot 1 of Certified Survey Map 12378.
Three accessory structures and a portion of a fourth structure (as highlighted in yellow on the attached Exhibit A identified as accessory structures 4, 5, 6 and 7) will be removed,
and
WHEREAS, The result of the additional land combined with his lot would allow 4,456.1 square feet of accessory structures by right, and
WHEREAS, Buildings 1 and 2 of Exhibit A account for 4,453 square feet, which would be allowed by right with the additional 13,000 square feet of land, and
WHEREAS, The barn (3) would then be granted rustic structure status (not including the portion labeled 4) where the two percent limit is waived for that 5,640 square feet of accessory
structure, and
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Conditional Use Grant for a portion of the main barn identified as accessory structure 4 on Exhibit A and grain building on
the Hrin property at S99 W20523 Parker Drive / Tax Key No. 2280.999.021.
BE IT FURTHER RESOLVED, That no commercial/business use or storage is allowed within any of the accessory structures on the property, whether Rustic Structure designations have been
granted or not.
BE IT FURTHER RESOLVED, That the 13,000 square foot lot line adjustment conveying the land from Lot 1 of Certified Survey Map 12378 to Lot 3 of Certified Survey Map 12377 must be completed
by June 1, 2024.
BE IT FURTHER RESOLVED, That as lots owned by the petitioner sell to a different owner, the petitioner must reduce the number/square footage of accessory structures by an amount equivalent
to uphold the two-percent limit of accessory structures.
BE IT FURTHER RESOLVED, That the petitioner must notify the City of any lot sales and closing dates and then 30 days from the date of closing on the property sale the number/square footage
of structures must be removed.
BE IT FURTHER RESOLVED, At the end of five years of the date of this approval, or after all lots have sold whichever is sooner, all of the accessory structures (as highlighted in yellow
on the attached Exhibit A identified as accessory structures 4, 5, 6 and 7) must be removed.
BE IT FURTHER RESOLVED, That at the call of the Planning Department, the operations subject to this Conditional Use Grant may be subject to further review by the Plan Commission if the
building is not properly maintained and kept up, and any future operations which are deemed to be inconsistent with this approving resolution may be subject to further conditions by
the Plan Commission.
BE IT FURTHER RESOLVED, A copy of said plans must be kept on file and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, Failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
