RESOLUTION GRANTING CITY STAFF AUTHORITY TO APPROVE
LITTLE MUSKEGO YACHT CLUB'S YEARLY REQUEST FOR
PLACEMENT OF RACE COURSE MARKERS ON LITTLE MUSKEGO LAKE
WHEREAS, the primary purpose of the Little Muskego Yacht Club is to provide an
organized weekly sailboat racing format for club members and guests on Little Muskego
Lake during the summer; and
WHEREAS, the sailboats involved in the weekly racing events are 16-foot-long, mon-
motorized vessels; and
WHEREAS, details of the racing activities are very consistent from year to year and
generally include the following:
- Sixteen (16) — twenty (20) racing days held throughout the spring and summer
with each race session lasting from two (2) — four (4) hours,
- Four (4) — eight (8) sailboats per race session,
- Two (2) — three (3) markers are used to mark the course, approximately three (3)
feet in diameter, orange or yellow in color, set up one (1) hour before the race
session and taken down before dark,
- One (1) motorized committee boat and one (1) safety boat monitors each race;
and

WHEREAS, in or about January of each calendar year, the Little Muskego Yacht Club
makes the same request, via letter correspondences, for permission to place race
course markers on Little Muskego Lake for their race events for the forthcoming
spring/summer; and
WHEREAS, pursuant to Chapter 278.15 (Uniform Aids to Navigation; Waterway
Markers) of the City of Muskego Municipal Code, a permit is required to place any
waterway marker or aid to navigation in any navigable waters within the City of
Muskego; and
WHEREAS, the Little Muskego Yacht Club request is made pursuant to Chapter 278-
15(E) of the City of Muskego Municipal Code which states that the Common Council
may, on an annual basis, allow for the temporary placement of race course markers on
a waterway for special events without the requirement of obtaining a permit; and
WHEREAS, The customary practice of the Common Council from year to year is to
grant Little Muskego Yacht Club's request with little or no discussion, such that it would
be more efficient for Council to authorize City Staff to grant the request on a yearly
basis, without Council approval, unless the Little Muskego Yacht Club is requesting
unique or significant changes to their racing format in a particular year, whereby staff
may then use its discretion to bring the matter to the Common Council for discussion
and approval.

NOW, THEREFORE, BE IT RESOLVED by the City of Muskego Common Council
based on the above facts and circumstances, hereby authorizes City Staff, the
discretion and right to grant the Little Muskego Yacht Club's yearly request for
placement of race course markers on Little Muskego Lake for the purposes as outlined
herein; that in the event staff has issues or concerns with granting the request in a given
year, the matter will then be brought to the Common Council for discussion and
approval.
