PLEDGE OF ALLEGIANCE ROLL CALL Commissioners Kuspa, Jaske, Boyer, Hauboldt(6:04PM) and Hammitt were present. Chief Westphal and Captain Fons were also present. STATEMENT OF PUBLIC NOTICE APPROVAL OF MINUTES Commissioner Hammitt made a motion to approve the minutes from 05/14/2024. Commissioner Boyer seconded. Motion passed. REPORT FROM POLICE DEPARTMENT Chief Westphal advised the last month has been a little challenging, with the loss of retired Captain, Craig Simuncak. The NNO committee has his name added to this year's shirt in his memory. NNO was a success, and the police department would like to thank everyone who helped and volunteered their time for this great cause. There were no issues to report from the RNC. Our SCIT team was there on 12hr rotations and all went well. Sarah Tuchel and Joaquin Vega -Gonzalez are 1.5 weeks into the academy and we wish them well. K9 Fundraiser is Sunday, 08/18/24. The 5K run will take place at the Dog Park, by Moorland Skate Park. There will be a pancake breakfast and corn hole tournament at the Moose Lodge after. Chief wanted to also thank Making the Cut for an earlier fundraiser that created a $6000.00 donation to the department, and Norway PD also received $6000.00. Chief took on the chief from Waukesha Police Department, Chief Dan Thompson on battle of the badges on FM106, and was able to win some great prizes, one will be donated to the K9 fundraiser and the other the Chiefs Association Golf Outing, coming up next week. The golf outing helps raise money for our Waukesha County Victim Witness Program and the Women's Shelter. Dandelion Daze is coming up at the end of the month, our Citizen's Academy Alumni Association will again have a tent, Brats for Cops, to help raise money for the department. The department will be starting the process for the 2nd investigator spot. Chief wanted to congratulate Officer Erin Cortese on her receiving a Tunnels for Towers award for going above and beyond. The specific case was a subject who was in crisis and wanted to take his own life, but would only speak to Officer Cortese. Officer Cortese was contacted in the middle of the night on her off day and talked to the subject and responded, causing the subject to surrender without incident. Chief advised his papers have been filed for his military retirement, which will happen in Spring of 2025. MOTION OF CLOSED SESSION Following conclusion of consideration of the above portion of its regularly scheduled agenda, the Police and Fire Commission will meet to vote on a motion to convene in Closed Session for the purpose Of the following matters: 1. John R. LaPlante V. City of Muskego, et al, Eastern District of Wisconsin Case No. 24-CV- 215. Update status by Chief of Police and City Attorney. 2. Discussion relating to ongoing investigation of fatal traffic crash occurring on July 28, 2024, in the City of New Berlin, Wisconsin. 3. Policy of handling an unfounded complaint filed against a police officer by a member of the public. A closed session for the above purposes is authorized pursuant to the provisions of Wisconsin State Statute, Section 19.85(1)(g). Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved; and Wisconsin State Statute Section 19.85(1)(c), considering employment, promotion, compensation, or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility. Upon conclusion of the Closed Session, the Police and Fire Commission will convene in Open Session to consider its public agenda, including motions to recommend approval or rejection of the above -listed deliberations or any of the public agenda items that have not been acted upon Commissioner Hammitt made a motion to go into closed session, Commissioner Jaske seconded. Motion passed all in favor. Meeting went into closed session at 6:11 PM. OPEN SESSION Commissioner Jaske made a motion to go back into open session, Commissioner Boyer seconded. Motion passed all in favor. Meeting was back in open session at 6:44PM. OLD BUSINESS NEW BUSINESS DATE OF NEXT MEETING November 21, 2024 ADJOURNMENT Commissioner Boyer made a motion to adjourn, Commissioner Hauboldt seconded. Motion passed all in favor.
