CLOSED SESSION
Following conclusion of consideration of the above portion of its regularly scheduled agenda, the
Common Council will meet to vote on a motion to convene in Closed Session for discussion/action
relative to: discussion of City's Sex Offender Ordinance with regards to a possible offender and to take
such further action as may be appropriate with respect to such matters.
A Closed Session for the above purpose is authorized pursuant to the provisions of Wis. Stats. §
19.85(1) (g) Conferring with legal counsel for the governmental body who is rendering oral or written
advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to
become involved.
Upon conclusion of the Closed Session, the Common Council will convene in Open Session to consider
its public agenda, including motions to recommend approval or rejection of the above -listed deliberations
or any of the public agenda items that have not been acted upon.

We are deep in the Budget Season now. We wrote a grant for our fire fighters and one for the remodel
of the old police department. If we get anything, it will be brought forward to see what we want to do
with it.
PUBLIC HEARING
To consider the petition of Daryl Borchardt of the Oakridge Glen Subdivision concerning the area
described as Tax Key Nos. 2172.068 & 2172.069 / Lot 38 & Lot 39 of Oakridge Glen Subdivision
(Vacant Lots) be granted a rezoning from RM-2 — Multiple Family Residence District to RS-2 —
Suburban Residence District for the purpose of converting two multi -family lots to single-family lots.

Mr. Trzebiatowski explained this is to rezone two lots that are currently zoned for multi -family to
single family lots. The original developer's family is making the request.

Alderman Decker stated that this started as a request to eliminate Water Bugs traffic. Currently,
there are signs on both sides stating no parking on holidays and weekends from May 1 st to Oct 1 st.
Parking on both sides on Wednesday evenings creates a hazard because the roads are narrow as
they are.
Original staff recommendation was for no parking on one side and allow parking on the other side.
Committee discussed and voted making no parking on both sides.

City Clerk Roller stated that the meeting was noticed in accordance with the open meeting law on
Friday, August 2, 2024.
PUBLIC COMMENT
1) Greg Shaw - S77W 16852 Bridgeport: He is with the Muskego Warrior Baseball Organization.
Personally, he feels the proposal is a great for community. He thanked InPro for their continued
support in the community.
2) Michael Miller - S64W18951 School Drive: He represents the Muskego Warriors. This is a great
asset for our community and for the kids.
3) Jim Becker W212S7712 Agnes Way: He is president of the Muskego Athletic Association. This is
very important for not only the organization, but also for the community.

Alderman Wolf asked for a history including what we talked about in past budgets in regard to the
three diamonds. Mr. Kroeger stated the following in response:
1) Cost for field prep too high and games rained out

2) Turfed fields 1, 2 & 3 which allowed a user fee and brought in more tournaments. This was
started in 2021 with the first games played in 2022
3) The grades of all of the fields were raised to improve drainage
4) We don't cancel games anymore
Mr. Kroeger talked about the reasons for bringing this forward early. Now we are able to have the
company come in, do the work, and get it done so we don't loose any tournament or any play
starting in 2025. Also, they are seeing a 10% increase cost in terms of turf, labor, freight, etc. We
would not pay anything until 2025.
We will be doing a lot of the work with Ryan as the project manager. DPW is available now as
apposed to waiting until the first of the year.
Last year we had about $70,000 in revenue for doing tournaments and right now we are right about
there for 2024.
This would not be possible without the donation and we would not even be talking about it.
We joined TIPS in 2021 and - they guarantee it is the lowest bid possible. We are trying to make
these fields as versatile as possible.
Alderperson Schroeder stated that this started as an email from Mayor that if there was no
objection, he would move forward.
Alderperson Madden and Alderperson Kubacki stated that there are limitations for what the landfill
money can be used. It can't be used for roads or fire departments.

RE -APPROVAL OF A CERTIFIED SURVEY MAP
Helm
WHEREAS, a two -lot Certified Survey Map was submitted by David Helm on behalf of
Joyce Switala located at S77W15973 Woods Road (Tax Key No. 2190.999.001) and
was approved through Resolution #049-2022 on June 14, 2022; and
WHEREAS, the Plan Commission adopted Resolution #P.C. 044-2022 recommending
approval; and
WHEREAS, the certified survey map was not recorded within the required twelve-month
time period.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of
Muskego, upon the recommendation of the Plan Commission, does hereby approve the
certified survey map submitted by David Helm on behalf of Joyce Switala to finalize a
two -lot land division for the property located at S77W15973 Woods Road subject to the
conditions outlined in Resolution #P.C. 044-2022.
BE IT FURTHER RESOLVED that this re -approval is subject to receipt of all fees
required by Section 392.13 of the Land Division Ordinance, any special assessments
which may be due, payment of any unpaid taxes, and approval of the City Engineer.
BE IT FURTHER RESOLVED that a digital file of this certified survey map shall be
submitted to the City in accordance with Common Council Ordinance #1118 and
Resolution #196-2002.

WHEREAS, DCEN, LLC entered into a Development Agreement with the City for the
development on Crowbar Drive just north of Kelsey Drive; and
WHEREAS, the project has been completed per the Development Agreement and to
the satisfaction of the Director of Public Works and Development; and
WHEREAS, DCEN, LLC has submitted a request for a reduction to its Performance
Bond; and
WHEREAS, The Public Works and Development Director has recommended that the

APPROVAL OF LETTER OF CREDIT REDUCTION FOR
Peach Lane LLC (Twin Silos Subdivision)
WHEREAS, the Peach Lane LLC entered into a Developer's Agreement with the City to
construct Twin Silos Subdivision located off Tess Corners Drive just south of Cornell
Drive; and
WHEREAS, the project has started construction per the Development Agreement and
the work done to date has been approved by the Director of Public Works and
Development; and
WHEREAS, based on construction work performed, Peach Lane LLC has submitted a
request for a reduction to its Letter of Credit; and
WHEREAS, the Public Works and Development Director has recommended that the
Letter of Credit be reduced by $119,136.60, leaving a remaining balance of
$1,120,386.40.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby approve
that the current amount remaining on the Letter of Credit for Peach Lane LLC be

Spitzer
WHEREAS, the Director of Public Works and Development has identified an area in the
City of Muskego with significant drainage concerns such that there exists a need for a
Permanent Drainage Easement over lands not owned by the City to assist with said
issue; and
WHEREAS, the property over which the City would like a drainage easement is owned
by Walter Spitzer and Debra Weber -Spitzer and located at W182S65665 Garnet Drive,
Muskego, Wisconsin; that Walter Spitzer and Debra Weber -Spitzer have agreed to
grant the City an easement for drainage over their property; and
WHEREAS, the attached Permanent Drainage Easement has been reviewed and
approved by the City Attorney; that the document was signed by Walter Spitzer and
Debra Weber -Spitzer on July 25, 2024; and
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of
Muskego, upon the recommendation of the Director of Public Works and Development,
does hereby approve the attached Permanent Drainage Easement between Walter
Spitzer and Debra Weber -Spitzer and the City of Muskego.
BE IT FURTHER RESOLVED the City Attorney, in his sole discretion, is authorized to
make substantive changes as may be necessary in order to preserve the general intent
thereof and the Mayor, Treasurer, and City Clerk are authorized to sign the Permanent
Drainage Easement (with any changes, if necessary, as made by the City Attorney) on
behalf of the City of Muskego.

3. The right, permission and authority is also granted said Grantee, to trim and/or cut down

maintenance of the Facilities or represent a hazard to such Facilities.
4. The Grantors, their successors and assigns, covenants and agrees to restrict the use of the
land included in the easement described hereinabove as follows:
A. The land will only be put to uses consistent with this easement.
B. No obstruction of access to the Facilities or its appurtenances shall be created in
the future in that no building, trees or other structures or items that may interfere
with inspection, maintenance or repair shall be located in the easement.

C. The surface elevation of the land within the easement shall not be raised or
lowered without the prior written approval of the Grantee.
Grantors, their successors and assigns, covenants and agrees to permit and allow grantee
to have Facilities and its appurtenances to be installed at such time and in such location as
grantee may deem necessary.
6. Grantee and its agents shall have the right to enter upon the premises of the Grantor for
the purpose of exercising its rights herein acquired. Grantee agrees to restore or cause to
have restored said premises, as nearly as is reasonably possible, to the condition existing
prior to such entry by the Grantee or its agents. The restoration, however, does not apply
to any brush or trees which may be removed at any time pursuant to the rights herein
granted.
7. The undersigned understands that the City could not condemn the easement across said
lands without following Wisconsin Condemnation Law procedures which provide
protection to the rights of the property owners including, but not limited to, obtaining an
appraisal at the City's expense and payment of fair compensation to the property owner.
The undersigned wishes to grant a perpetual Storm Sewer easement across said lands to
the City for good and valuable consideration to the City and waive any and all
condemnation rights which grantor has including, but not limited to, the right to an
appraisal, the rights to condemnation and any and all appeal rights.
8. All the provisions of Easement Agreement shall be binding upon and inure to the benefit
of the heirs, successors, and assigns of parties hereto.

DISCUSSION PC 041-2024
As previously mentioned, the petitioner is seeking to create new lots in order to better define the existing
Muskego Landfill and Stone Ridge Landfill along with associated landfill support areas. The petitioner is
also splitting lots unrelated to the landfill for future development. There have not been any proposals for
what or where any future development may occur at this time.
Upon initial review of the CSM, Lot 3 of the CSM is only 193,033 square feet and must be 200,000 in the
M-3 Landfill and Extractive Operations District. With the remaining land available the 6,967 square feet
should not impact the remainder of the CSM. Otherwise, the bulk requirements of the code appear to be
met. A technical review is in the process of being completed. All corrections/additions will be needed
prior to the CSM can be signed by the City and recorded.
Staff recommends approval subject to meeting all technical corrections received from the Engineering
Division. The Resolution is drafted accordingly.

As previously mentioned, the petitioner is seeking to create new lots in order to better define the existing
Muskego Landfill and Stone Ridge Landfill along with associated landfill support areas. The petitioner is
also splitting lots unrelated to the landfill for future development. There have not been any proposals for
what or where any future development may occur at this time.
Upon initial review of the CSM, the bulk requirements of the code appear to be met. A technical review is
in the process of being completed. All corrections/additions will be needed prior to the CSM can be
signed by the City and recorded.
Staff recommends approval subject to meeting all technical corrections received from the Engineering
Division. The Resolution is drafted accordingly.

As previously mentioned, the petitioner is seeking to create new lots in order to better define the existing

There are three lots being combined to create this lot bounded by the Wisconsin Electric right-of-way,
Crowbar Drive and Janesville Road. One of the existing lots was impacted with the Wisconsin Electric
right-of-way and currently sits on both sides of the right-of-way split by the right-of-way. This Certified
Survey Map will combine all the lands south of the Wisconsin Electric right-of-way to create a single lot
while the remaining land is combined and divided by the first CSM of the series.
Upon initial review of the CSM, the lot being created does not meet the minimum required size for the M-3
Landfill and Extractive Operations District. However, this lot being created is as large as it can be based
on the right-of-ways completely surrounding the land. Based on this, the parcel needs to be renamed an
Outlot and a note must be placed on the CSM stating that the Outlot cannot be development until a
proper rezoning is granted for the parcel to make it a compliant lot. Prior to any future development being
allowed on the parcel, a rezoning to an acceptable Zoning District, consistent with the Comprehensive
Plan, must be granted.

WHEREAS, The petitioner is seeking approval to combine multiple lots and create a total of six new lots via
Certified Survey Maps, and
WHEREAS, This third CSM is to create one new lot bounded by the Wisconsin Electric right-of-way,
Crowbar Drive and Janesville Road, and
WHEREAS, Said property is currently zoned M-3 Landfill and Extractive District and requiring minimum lot
sizes of 200,000 square feet (4.591 acres) and an average minimum width of 300 feet, and
WHEREAS, The proposed lot is 121,085 square feet (2.780 acres) in size and does not meet the minimum
lot size requirement, and
WHEREAS, The 2020 Plan depicts the area for Landfill and Extractive uses and the proposal is consistent
with the plan, and
WHEREAS, This Certified Survey Map will combine all the lands south of the Wisconsin Electric right-of-way
to create a single lot while the remaining land is combined and divided by the first CSM of the series, and
WHEREAS, All lots are/will be served by municipal sewer and water, and
WHEREAS, A technical review is in process and review comments are pending.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of Three Certified Survey Maps
submitted by Waster Management for properties located in the SW '/4 of Section 18 (Tax Key Nos.
2231.998.001, 2231.993 & 2231.997), subject to technical corrections as identified by the City Engineers
and Planners and payment of all applicable fees and outstanding assessments, if applicable.
BE IT FURTHER RESOLVED, Since the created lot is substandard, it must be relabeled as an Outlot and
restrictions must be placed on the CSM stating that the Outlot cannot be development until a proper
rezoning is granted to make it a compliant lot.
BE IT FURTHER RESOLVED, Prior to any future development being allowed on the parcel, a rezoning to an
acceptable Zoning District, consistent with the Comprehensive Plan, must be granted.
BE IT FURTHER RESOLVED, That all technical corrections from the City will need to be addressed before
the Certified Survey Map can be signed and recorded.
BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in accordance
with Common Council Ordinance No. 1118 and Resolution 196-2002.

FOR ELECTED OFFICIALS
The Common Council of the City of Muskego, Waukesha County, Wisconsin, do ordain as
follows:
SECTION 1: The following biweekly salary, based on 26 pay periods, is established for the Office
of Mayor effective April, 2026: $3,153.84
SECTION 2: Health insurance and life insurance benefits for the Mayor shall continue to be
provided on the same basis as provided for non -represented employees, as well as WRS pension
benefits for elected officials.
SECTION 3: The following biweekly salary, based on 26 pay periods, which has been in effect
since May, 2020 with the passage of Ordinance #1438, is established for the Alderpersons:
$293.79
SECTION 4: The Council president shall continue to receive an additional $23.08 on a biweekly
basis.
SECTION 5: The following biweekly salary, based on 26 pay periods, which has been in effect
since May, 2020 with the passage of Ordinance #1439, is established for the Municipal Judge:

SECTION 6: The several sections of this ordinance are declared to be severable. If any section
or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid,

Background Information:
The petitioner, Daryl Borchardt of the Oakridge Glen Subdivision, is applying to rezone two (2) vacant
properties located along Hackberry Hill Court (Tax Key Nos. 2172.068 & 2172.069). The proposed
rezoning is from RM-2 — Multiple Family Residence District to RS-2 — Suburban Residence District. This
request is to expand the existing RS-2 portions of the Oakridge Glen Subdivision into the multi -family
portion of this overall development. This eastern portion of the Oakridge Glen Subdivision was originally
planned for multi -family homes to serve as a buffer between the single-family homes (to the west) and the
commercially zoned properties (to the east). The owner of the development is making this request since he
has perspective buyers that want to build in this area, but do not want to build a multi -family residence. The
two (2) properties in question do not directly abut the commercial lot next door, but they are located close to
the adjacent commercially zoned area. If this rezoning were granted there would still be twelve (12) multi-
family zoned lots in this eastern portion of the subdivision.
The 2020 Comprehensive Plan currently identifies this area for High Density Residential use and as part of
this request the land use plan would be amended to Medium Density Residential use to facilitate the rezoning
of the two (2) lots to single-family.

NEW BUSINESS
Discuss Future of Police Department Building
Mayor Petfalski stated that this discussion has been started many times; not looking for an answer
tonight. He wants to go through where we are at, what some of the opportunities we have for that
building, some voids that we have specifically for recreation, other options. The building to operate
is costing the City just short of $100,000 per year for maintenance (things that have to be fixed),
utilities, grounds maintenance. The building is being used slightly; Ms. Dunn for some recreation
programs and PD for some training which is a very inefficient use of the building and he does not
recommend this for long term. A couple of years ago, a task force was put together made up of
about ten citizens and included Alderman Kubacki. Many options were discussed including adding
on to the building, leveling it for parking lot and everything in between. Ultimately, the architects
came up with a plan/layout for the building. The idea was to make the building flexible. At a

Common Council meeting over a year ago, it was decided to get input from the community. After
that we put the brakes on because we needed more internal discussion on what we want to do and
how we want to communicate that with the community.
The Mayor prepared a packet which included a synopsis from meetings with task force and Gray
Architects (the consultant), site layouts (current & suggested), preliminary budget analysis with
inflation allowance to 2026, three different scenarios from financial consultants (Baird) for what this
would cost the average house (when asked, Assessor put the assessed value of the average house
is $366,000).
Ms. Dunn handed out a packet and talked about some of the items in the packet. There are
discussion points on what the rooms would look like and what could be done within those spaces.
She stated we were looking for flexible spaces to run programs we have, programs we could add,
and work with the community on meeting some of the needs that happen in the community. There
are a lot of calls where people are looking for spaces for large and small events, service clubs in
town for their meetings and events. Right now, the recreation program has one building for
programing (the Old Town Hall facility). Everything else they use is either City Hall building space,
the Library space, or space rented from the school district. There is nothing to house programs
during the daytime because there is a 3 & 4K program that runs year-round. In the summer, there
are 100 kids at Vet's Memorial and 100 kids at Old Town Hall in the playground program. Also, in
the packet was a list of programs they are currently offering, added programs to bring into the
community, and programs offer collaboratively with surrounding communities.
After a long discussion with questions and answers, the Mayor asked everyone where they want to
go with this. If we do a survey, we would hire someone to do it right. Mayor will get some numbers
to see what doing a survey would cost. He will bring it back in a month.
Discuss Elected Officials Terms & Salaries
Alderperson Madden stated that over the years, she spends more to be an alderman than she gets
paid. She is not looking for a lot, just enough to cover her expenses. Also, she would like to see the
term changed from two years to three years. Mayor Petfalski explained the process: Salaries can
be changed by Council, but terms can only be changed with a referendum because it is a charter
ordinance.
After discussion, it was agreed that Mayor salary would increase by $5,000 in 2026 and a
$100/year increase in salary for Alderman to begin in January 2025. The aldermanic and mayoral
terms would remain as is.
