PUBLIC WORKS AND SAFETY COMMITTEE Minutes 04192022Approved CITY OF MUSKEGO PUBLIC WORKS AND SAFETY COMMITTEE MINUTES 04/19/2022 5:30 PM Muskego City Hall, W182 S8200 Racine Ave CALL TO ORDER Alderperson Hammel called the meeting to order at 5:30 PM. PLEDGE OF ALLEGIANCE Those present recited the Pledge of Allegiance. ROLL CALL & C4 Of SKEGO Present: Alderpersons Hammel and Kubacki; Scott Kroeger, Director of Public Works and Development Absent: Alderman Terrence; Also Present: Police Chief Stephen Westphal STATEMENT OF PUBLIC NOTICE The meeting was posted in accordance with open meeting laws on April 14, 2022. STATUS OF PROJECTS Discussion update. No formal action may be taken on the following: Great Water Alliance Director Kroeger said that the contractor is finishing the work on Durham Drive and this summer the restoration work will be completed. UNFINISHED BUSINESS Discussion update and possible action may be taken on any or all of the following: Discussion on Ryan Drive Trail Director Kroeger mentioned the last discussion ended with the need for updated traffic counts. The decision needs to be made is whether or not this project is added to the capital budget for a decision by Common Council. The path is from Groveway Lane to North Cape Road and unknown if it would be on the north or south side of the road. Alderman Hammel asked if there is a cost for the concept. Director Kroeger said there is not. A cost would be provided for rough estimates of plans. Alderman Kubacki said he has been down the road several times and there is not much traffic. The counts were made before the speed limit was reduced. There is an average from 6:00 AM to 10:00 PM there are 12 — 14 cars per hour. This is not a thru-way without any destinations of restaurants or bars. There are ditches on either side of the road with dramatic slopes. There will likely need property acquired. Not in favor of the pathway due to cost and believes the roadways would be better served with that money. Alderman Hammel also thought the traffic counts were not that high. Cost of trails have gone up dramatically. He doesn't think it would hurt to get a cost and let the Council vote on it. There are a lot of roads that need fixing. It would be better spent on roads. Alderman Kubacki asked what the cost would be for the estimate. Director Kroeger said that it would be mostly his time, but may need consultants to review. In addition to the right-of-way there will likely need some storm water system by covering the ditches. Alderman Hammel asked how long and the cost of the trail along North Cape Road. Director Kroeger said he would need to look into that. The issue with this trail is that it is a tight right-of-way, may need to curb and gutter one side of the road. It will be an expensive path. Alderman Kubacki said that he has a hard time justifying the time if the path will be $1 M that the roadways need, why waste the time to prepare an estimate. Alderman Hammel said with the traffic count and the path does not connect two significant areas like the Bay Lane with the children. If it will be a million dollars, he couldn't support the project. Alderman Hammel made a motion to Deny the Ryan Drive Trail. Alderperson Kubacki seconded. Motion Passed 2 in favor. NEW BUSINESS Discussion update and possible action may be taken on any or all of the following: Determination of Compensation for the Vacation of the Hrin Right of Way Director Kroeger explained that in Madyson Court area the developer has requested to vacate a portion of the right-of-way. Based on City Policy this Committee must decide whether the City should be compensated for the land. In this case, if the right-of-way is vacated, there is no gain for the developer. There would not be any additional lots that would be created and sold. This vacation simply cleans up the right-of-way for the area. Director Kroeger recommends that the section of Madyson Court be vacated without any compensation. Alderman Kubacki made a motion to Vacate the section of Madyson Court without any compensation. Alderperson Hammel seconded. Motion Passed 2 in favor. No Parking Request - School Drive Director Kroeger explained a request for no parking on both sides of School Drive. This is not commonly done. The request is due to The Local employees parking on School Drive freeing up parking for customers. Additionally, the traffic from Mill Valley School and there is a crosswalk there so parents will park on School Drive and walk over to pick up their children. Director Kroeger recommends only applying the no parking on one side of the road and from Hillendale all the way to Gold Drive. This affects everyone on the road including any events or parties at the homes along the road. Chris said the original request was for no parking on both sides of the road from Hillendale Drive, down School Drive to Preston Lane. They have found that the parking is an issue for the people on Gold Drive and the people along Hillendale to College Avenue. The original idea was for employees to park along College Avenue. The biggest concern is the blind spots at Hillendale Drive and College Avenue. This solution was just shifting the issue to one side or the other and it is not fair. Everyone's grass is getting torn up with the parking. This is a hazard and someone will be hurt. He has 40 signatures from neighbors who agree. With the employees, they are parked there until bar closing and they are parked right behind the driveway and now they need to back into their driveway to be able to leave. Not fair for the neighbors to bear the brunt of the success of the bar. He does not know the remedy for the school parking. Pick-up has been getting out of hand and people are having their driveways blocked. In the short term they are looking for relief and they don't want their property values decreased. Addressing the no parking on both sides of the road, he has examples throughout the City and one example is Jean Drive by the high school there is no parking on both sides. Penn Lane is the same with no parking on both sides. Other examples are Racine Avenue, Woods Road, sections of Hillendale and Parkland Drive. Lastly, fire personnel couldn't make it through with parking on both sides of the road. Greg Witkowski lives on School Drive. There are ruts five inches deep. The Local could expand their parking behind the bar. They have to manage their needs. Alderman Kubacki made a motion to adjourn at 6:02 PM until after Council Meeting. Alderperson Hammel seconded. Motion Passed 2 in favor. Alderman Hammel reconvened the Public Works and Safety Committee Meeting and called to order at 6:29 PM Sergeant Fons said that what the residents are saying is accurate as for what he has seen for parking and the tire ruts. Employees are parking along College Avenue and every time the police have been called, they have looked at the parking and everyone has been parked legally. Given the construction on Hillendale, the traffic patterns have changes several times and it seems as though there is a smooth traffic flow of parents picking up their children. There is a 15-minute window where traffic might get backed up to School Drive but they are moving at a slow pace to facilitate the parent pick-up. Alderman Hammel asked if there have been any calls about vehicles being parked too close to the intersection of Hillendale Drive and School Drive. Sergeant Fons said he was unaware and would need to look at call logs. When there are full -school events like concerts there is some congestion at the intersection. Cars must be parked four feet from a driveway and cannot block mail delivery. John Orlando lives in the home between the school and the bar. There are many times that cars are parked on both sides of School Drive where emergency vehicles would not be able to go through. He has had vehicles parked at the edge of his driveway. It is difficult to get across the street at 6:00 PM. There is not much control of speed or traffic in this area. Fred Fischer, lives across the street from the bar. Has no complaints about the bar. Many customers park on the street and his lawn. Businesses in the City are supposed to provide parking for employees and customers. Now parking is an issue mainly on the weekends. Alderman Hammel is never a fan of no parking signs, especially on both sides of the street. Everyone has parties and no parking signs will also apply to the homeowners as well. No parking signs always move the problem to another location. Alderman Hammel asked if we can speak to representatives from The Local regarding the parking issues. Mayor Petfalski added that parking has been an issue since the opening. Parking on Hillendale has been problematic. The owners of The Local have been very receptive to ideas to help. The owners plan on paving the back of the lot. They are also looking into purchasing additional property to add more parking. As for the use, it is grandfathered in as it has been a bar for a very long time. There is no easy solution to this issue. He will check in with the owners to see where they are as far as the plans to expand the parking. Chris, the speaker at the beginning, this was a tavern that served frozen pizzas and pickled foods and now it is a full-fledged kitchen. With the new kitchen it is a new dynamic. There are 10 to 12 employees along with the customers. Even if the horseshoe pits are removed it may add five stalls. Alderman Hammel said that they are aware of the parking issues and are trying to resolve the parking issues. Alderman Kubacki asked for the definition of legally parked. Police Chief Westphal said legally parked is not impeding on traffic and the distances from driveways and such. Alderman Kubacki also does not like putting up no parking signs as well. Unless the restaurant comes up with a creative way to park employees, it will hurt the business. They are trying to resolve some of the issues. Maybe park and pool their employees there may be an option. Seems like a weekend issue and he did see the lawns damaged, but that is city right-of-way. Would like the City to lean on The Local to come up with a solution. Alderman Hammel also doesn't want to hurt the business. He agrees that going back to The Local to see what they can do. If someone sees someone parked illegally to call the police and have them come out and address the issue. He is not in favor of no parking signs as it just moves the problem to the next area. Alderman Kubacki said if this is a weekend issue, can't people park at the school lot. Director Kroeger mentioned that that would mean there would be extra insurance needed to have parking at another location. He believes this is an option that was explored by the business owners. Alderman Kubacki said at best, he would consider no parking on one side of the street. Would be in favor of deferring this for 30 days to contact The Local to see what they can come up with to solve the problem. Alderman Hammel said that 30 days may not be enough time. Alderman Kubacki said 30 days to come up with a solution with a timeframe. Maybe meet with the condo people to see what can be done. Director Kroeger will come up with a plan to contact The Local to ask them to come to the next meeting to discuss the issue and hopefully come up with a solution. Also, with Fleet Farm coming, not sure if the County will allow continued parking along College Avenue. Alderman Hammel asked to clarify that the County has jurisdiction over parking on County highways. Alderman Kubacki made a motion to defer No Parking on School Drive for 30 days. In the meantime, see if information can be received from The Local. Alderperson Hammel seconded. Motion Passed 2 in favor.
