PLEDGE OF ALLEGIANCE Those present recited the Pledge of Allegiance. Present: Mayor Petfalski, Commissioners Bartlett, Graf and Oliver and Planner Trzebiatowski. Absent: Alderman Kubacki, Commissioner Buckmaster. STATEMENT OF PUBLIC NOTICE The meeting was noticed in accordance with the open meeting laws. APPROVAL OF THE MINUTES Approval of the Minutes of the March 5, 2024 meeting. Commissioner Graf made a motion to approve the March 5t" minutes. Commissioner Bartlett seconded. Motion to approve passed unanimously. PUBLIC HEARING Public Hearing for a renewal of Conditional Use Grant in accordance with Section 14 of the City of Muskego Zoning Ordinance for Payne & Dolan for the purpose of continued mining and processing of sand and gravel and the extension of use of an asphalt plant at the NW corner of Crowbar Road and Janesville Road, in the NE 1/4 and SE 1/4 of Section 13 (Tax Key No. 2230.996 / W217 S8425 Crowbar Road). Planner Trzebiatowski noted this was the annual review. There have been no issues brought to our attention and there has been no notice of overnight operations discussed at this point. Bryanna Bucholtz, Payne & Dolan, noted that there have been no changes to the operations and expecting the same operations in the year ahead. There may be some overnight operations from the asphalt plant this summer and will follow the standard notification process and hand notice to truckers going over the rules and expectations. CONSENT BUSINESS RESOLUTION PC 020-2024 Renewal of a Conditional Use Grant for the purpose of continued mining and processing of sand and gravel, and the extension of use of an asphalt plant for Payne and Dolan at W217 S8425 Crowbar Road / Tax Key No. 2230.996. 3 Commissioner Oliver made a motion to approve the Consent Business. OLD BUSINESS FOR CONSIDERATION RESOLUTION PC 014-2024 Approval of an Annual Review for Frey Auto located at S106 W16301 Loomis Drive / Tax Key No. 2293.996.002. Alderman Kubacki made a motion to approve Resolution PC 014-2024 at the March 5, 2024 meeting. Commissioner Bartlett seconded. Alderman Kubacki made a motion to defer Resolution PC 014-2024. Commissioner Oliver seconded. Motion to defer Resolution PC 014-2024 until April passed unanimously at the March 5, 2024 meeting. Planner Trzebiatowski mentioned that staff visited the site again on April 5t" to check for compliance. The main site is better but there are still car parts and pallets on the property. As far as the property across the street, nothing has changed and there are still many cars parked there that should not be. Petitioner said that he has secured a place to park all of the cars. He was hoping to move the cars by end of June but the owner of the new location said end of July. Commissioner Bartlett made a motion to defer Resolution PC 014-2024 until the August meeting. Commissioner Oliver seconded. Motion to defer Resolution PC 014-2024 passed unanimously. RESOLUTION PC 016-2024 Approval of a Building, Site and Operation Plan and Conditional Use Grant for Eric Huckstorf of Hornet Properties, LLC. located at W180 S7732 Pioneer Drive / Tax Key No. 2196.976. Alderman Kubacki made a motion to approve Resolution PC 016-2024 at the March 5, 2024 meeting. Commissioner Buckmaster seconded. Commissioner Buckmaster made a motion to defer Resolution PC 016- 2024 until April. Alderman Kubacki seconded. Motion to defer Resolution PC 016-2024 passed unanimously at the March 5, 2024 meeting. Planner Trzebiatowski provided an update to the project. The project has changed to be two buildings rather than a single large building. The same type of use as before with a bathroom and office inside with an overhead door. There is much better traffic flow through the site. The takes away some concerns from before about large expanses of walls. From a site layout standpoint this addressed many things from before. Curbing has been added except for the southern side of the exit driveway towards Pioneer Drive. If this is for runoff there are ways to accomplish the runoff with curbing. Normally, we would be asking for this to be curbed. The two buildings still have a 24-foot drive aisle with two parking spaces per unit. There are seven additional outdoor overnight stalls between the existing building and the first building for their trucks on a one- way drive aisle. The southern area of the site hasn't changed. A row of arborvitae has been added on the east side of the site extending around the north side of the site and wrapping the west side of the site. For screening to be effective proper height and density is needed. Screening may need to be a little further south on the eastern side to screen the new overnight parking. Screening in front of the fencing have been removed. As for the building design the buildings are very similar. The interior corridor has a 4-foot masonry band with board and baton panels to the top of the 16-foot walls. The same banding and board and baton panel is on the southern building facing Pioneer Drive. The remainder of the building will be standard metal panel. The east side is not much concern with the landscaping. The northern building will have the masonry band and board and baton metal panels on the southern side with the other three sides being standard metal panels. Staff believes the western side facing Pioneer should match the front of the building with masonry and board and baton siding. Buildings are not always viewed in two dimensions but where the different materials meet is a concern. Walls with masonry are around 20-22 percent masonry. Five total sides do not have masonry or the board and baton siding. Overall, the separation of the building into two buildings resolve many concerns from before. Normally screening is 6-feet, but that is for a transformer, but these will be screening the building. 4 The petitioner noted that the arborvitae are proposed as the giant green arborvitae that grow wide and tall quickly and would serve as a wall. The area south of the middle building, they were thinking about adding a gate with a six-foot solid fence that would screen the vehicles and building from Pioneer Drive. They are open to going as far south as needed with the arborvitae. They are screening a heavily wooded area on the east side. As far as the exterior lighting they will be containing all of the lighting on this lot. Would like to still have approval for overnight parking on the south side of the lot. Commissioner Bartlett asked if they are adding a second gate. The petitioner confirmed there will be another gate on the west side of the existing building that would screen the existing building and the first building. Planner Trzebiatowski also noted that the screening will screen the vehicles as well as some of the building. Mayor Petfalski asked that with the gate and how it works now, but what about if 5 years. The petitioner explained that it would not impact any of the tenants. The petitioner mentioned that the curb and gutter, if that could be incorporated into phase 2, being the front area abutting Pioneer Drive. Planner Trzebiatowski explained that any future development would likely tie into the exit drive. Commissioner Bartlett noted that there is no reference to a grading plan. Planner Trzebiatowski noted that the fine tuning of the grading will be figured out after this approval. Mayor Petfalski asked about the timing for phase 2 of the site. He would suggest a 5-year timeframe to add the curb and gutter. Commissioner Oliver asked if the arborvitae are planned as a staggered style or a straight line. The petitioner said a straight line with the line being only five feet, but that is why he went with the giant green arborvitae that are more bushy. Planner Trzebiatowski noted that due to the lack of space the taller narrower arborvitae may be a better fit so the side is not sheared off for the drive aisle. The key is that it must be dense at the time of planting. We don't want to hold to a certain number as there may be more needed. If the Plan Commission gives a minimum height, we can work with the landscaper to make sure they are dense enough. Commissioner Oliver asked if we are limited on a height of the berm. Planner Trzebiatowski added that he cannot comment until the grading is figured out. Commissioner Graf said that six feet would be a starting point. Planner Trzebiatowski noted that the plantings start at the beginning of the first new building and should the arborvitae extend further south. The petitioner noted that this is past the extend of the neighbor to the east. Commissioner Bartlett asked why stopping the arborvitae on the west side. Planner Trzebiatowski noted that the screening was from the residents, not necessarily by the commercial building. Planner Trzebiatowski asked for clarification on the architecture. If the gate is closed, the back side of the building will not be as visible. Mayor Petfalski said that if the gate is closed you will not see the building Commissioner Bartlett added that if the gate is six -feet tall and the wall is 17'8" you will see the top of the siding on the backside. Does this have to be board and baton siding? Commissioner Graf said he was good with the gate. Mayor Petfalski said that the southern building has the masonry and board and baton on the southern building but not on the northern building. For consistency, why not have them match. The petitioner said that with the screening, it would never be seen. Commissioner Bartlett asked what the finish on the gate will be. The petitioner noted that it will match the other gate being a horizontal solid fence. So, based on the discussion, Planner Trzebiatowski went over all of the changes to the Resolution including the updates for the new plan, height of plantings, curbing on the southern side of the exit drive and the second gate to match the materials of the other gate 6-feet in height. 4i Commissioner Graf made a motion to amend Resolution PC 016-2024 to accept the changes as listed by Planner Trzebiatowski. NEW BUSINESS FOR CONSIDERATION RESOLUTION PC 019-2024 Approval of a two -lot Certified Survey Map for Kamyar Saeian & Sharareh Mirjahn Bakhsh located at W 150 S8255 Harvest Court / Tax Key No. 2214.996.025. Planner Trzebiatowski explained the land division at the end of Harvest Court. This lot was originally approved for a home and guest house. Now there is interest in separating the guest house that meets the minimum housing standards. This lot was unique when approved with heavily wooded areas with predefined building pads and only one predefined area to install a driveway, which is where everything is located. Therefore, the driveway would be shared by both homes. Commissioner Graf made a motion to approve Resolution PC 019-2024. Commissioner Oliver seconded. Motion to approve Resolution PC 019-2024 passed unanimously with Commissioner Bartlett abstaining. RESOLUTION PC 021-2024 Approval of a three -lot Certified Survey Map for the Szczupakiewicz Trust located along College Avenue / Tax Key No. 2170.994.002. Planner Trzebiatowski explained the land division taking two lots with homes on each lot and they are reconfiguring the lots for another buildable lot. One of the existing lots is landlocked and through this land division the noncompliant lot will become compliant. The existing easements are still allowed to be used. Commissioner Graf made a motion to approve Resolution PC 021-2024. Commissioner Oliver seconded. Motion to approve Resolution PC 021-2024 passed unanimously with Commissioner Bartlett abstaining. RESOLUTION PC 022-2024 Approval of a Right -of- Way Vacation located between S75 W 17358 Janesville Road and S75 W 17308 Janesville Road / Tax Key Nos. 2193.088.001 and 2193.059. Planner Trzebiatowski explained the right of way vacation. This was discussed with the Citizens Bank project. The Public Works and Safety Committee reviewed the proposal to see if any compensation would be required to the City and determined that no compensation was necessary as there is no gain with an extra lot or anything. Typically, with a right-of-way vacation '/2 of the property would go to each adjacent property owner. If approved it would go to the Common Council meeting. Commissioner Graf made a motion to approve Resolution PC 022-2024. Commissioner Oliver seconded. Motion to approve Resolution PC 022-2024 passed unanimously. RESOLUTION PC 023-2024 Approval of a Building, Site and Operation Plan Amendment for Jamie Foshey of Leaves Floral Design/The Garden House located at S73 W16582 Janesville Road / Tax Key No. 2198.993. Planner Trzebiatowski explained the proposal including a concrete patio behind the Garden House that is rented for small special events and this is just another space, outdoors. The patio is 30' x 32' and some posts in wine barrels with lights strung between. The patio space is ancillary to the indoor space and not rented separately and must not hold music events without approvals. For the lighting, they are looking for white strung lighting, which does not meet the lighting requirements as the bulb is exposed. Mayor Petfalski has no issues with the lights. Commissioner Bartlett made a motion to approve Resolution PC 023-2024. Commissioner Graf seconded. Motion to approve Resolution PC 023-2024 passed unanimously. RESOLUTION PC 024-2024 Approval of a Building, Site and Operation Plan Amendment for Max Borgardt of Eagle Park Brewing and Distilling Company located at S64 W 15620 Commerce Center Parkway / Tax Key No. 2166.997.003. Planner Trzebiatowski explained the outdoor seating will be the same as the last few years. They use decorative planters to block of the end of the parking lot with property signage. They will still be required to keep a few stalls open to ensure vehicles can turn around. The petitioner is asking for a two year approval. Commissioner Graf asked if there have been any issues in the past. Planner Trzebiatowski said that nothing has been brought up to staff. Commissioner Graf made a motion to approve Resolution PC 024-2024. Commissioner Oliver seconded. Motion to approve Resolution PC 024-2024 passed unanimously. RESOLUTION PC 025-2024 Approval of a Building, Site and Operation Plan Amendment for the Muskego Norway School District located at S75 W16399 Hilltop Drive / Tax Key No. 2200.998.001. Planner Trzebiatowski explained that there is an existing picnic pad behind the school. The petitioner is asking now to place a cover over it. The open sided structure with a metal roof and would be 24' x 48' in size and 13 feet tall. Staff just wanted to be sure the roof matches the color of the small roofing on the school building. Commissioner Bartlett made a motion to approve Resolution PC 025-2024. Commissioner Graf seconded. Motion to approve Resolution PC 025-2024 passed unanimously. RESOLUTION PC 026-2024 Approval of a Building, Site and Operation Plan for a Two -Family Residential Structure located on Lot 19 of Northfield Green Subdivision / Tax Key No. 2172.029. Planner Trzebiatowski provided an overview of the new structure. This is the last lot of the cul-de-sac. The design is very similar to the rest of the buildings and follows all of the same themes and conditions of the past buildings. Commissioner Graf made a motion to approve Resolution PC 0262024. Commissioner Oliver seconded. Motion to approve Resolution PC 026-2024 passed unanimously. MISCELLANEOUS BUSINESS Discussion of string lighting on commercial properties. Planner Trzebiatowski explained that this is not a code change, but more of a policy regarding outdoor lights for businesses. Staff is suggesting keeping the lights a soft white color, not flashing or blinking and as part of an approved outdoor seating area. If there are glare issues with the neighbors it would be addressed on a case -by -case basis. 7 Commissioner Bartlett has not issues and likes the look. There will not be any signage along the road at all. Operations are proposed from June 21s'through July 5'", 2024, from 9:00 am to 9:00 pm with setup beginning no sooner than June 15, 2024 and tear down no later than July 10, 2024. Permission has been received from the property owner to use the site and the restroom facilities. DISCUSSION PC 032-2024 The proposal is consistent with operations of other vendors in Muskego. The petitioner received approval and operated the same fireworks location last year. A transient merchant license must be obtained from the City Clerk's Office. As allowed with other firework sales locations, a storage container may be on site. There have been no problems with the storage container in the past. All tents and storage must be located within parking stalls and no drive aisles can be blocked anywhere on site. STAFF DISCUSSION PC 038-2024 As noted above, Pop's Pub on Pioneer is seeking approval of a BSO amendment to improve the outdoor lighting on the volleyball court area. The petitioner is proposing a single pole in the middle on the east side of the existing volleyball courts. The two lights will sit on top of a horizontal arm mounted to the top of a 24-foot pole. One light will be directed toward each court. The code includes exterior lighting performance standards that include height, location, luminaires, cut- off, intensity and light trespass. Lighting for specified outdoor recreation uses may be exempt from the performance standards by the Plan Commission if certain requirements are met. First, the building, site and operation plan meets all of the other requirements of the code. The lighting is the only request of this BSO. Second, an exterior lighting plan was submitted that meets most of the requirements. Third, the pole will not exceed 50 feet in height. And lastly, if the luminaire is shielded in either orientation or by landscaped buffer areas to prevent light and glare spillover to residential property or residential zoning districts, the luminaire may be positioned to exceed a total cutoff angle of 90 degrees. The proposed lights are proposed at an angle to illuminate both of the courts from a single pole. The fixtures submitted are adjustable and would be aimed at each court. The cutoff angle is a measurement where the light source is visible. A full cutoff angle of 90 degrees on a light would mean that anything above the fixture would not have a visible light source. Because these lights are directed out towards the volleyball court the cutoff angle would be greater than 90 degrees without any shielding. The petitioner said that the light fixtures would be mounted at an angle 30 degrees from horizontal, which would mean that the cutoff angle would be much greater than 90 degrees. As shown in the photometric plan, the 78 higher cut-off angle decreases the light spilling towards the east as the light is being cast away from those residences. In turn, the increased cut-off angle will make the light source visible from the residences to the north, south and west of the volleyball courts. An example of the cut-off angle is shown below. gp No CNaH Cutoff Ash � Angles AnsjlR A beam angle specified in the proposal at 30 degrees does not reference the angle the light is pointed down, but the angle the light is focused from the fixture. A 30-degree beam angle will direct the brightest light to a smaller area on the ground. An illustration of the beam angle follows. A photometric plan was submitted and included in the packet that shows the brightness levels on the courts and surrounding areas. Property lines are missing from the photometric plan. With the light being directed away from the residences it appears as though the light levels will be less than 0.5 footcandles toward the east and south as required by the Code. However, towards the north where there is a residence, albeit owned by the petitioner but still a legally separate lot with no approved commercial uses on it, that the light levels would not meet the required 0.5 footcandles at the property line based on the angle that the used for the measurements. Staff has a few concerns with the lighting proposed. First, the fixtures are not fixed at a particular angle. These fixtures are adjustable and even though the photometrics show the most intense light on the volleyball courts, if the fixtures are slightly adjusted the beam angle could significantly change the light levels at the property lines. Next, with the lights set at an angle to cast light onto the courts, the light source will be very visible to anyone in the residences towards the north, south and west of the volleyball courts as well as anyone on Pioneer Drive. This is normally not allowed for commercial site lighting, but can be considered to be allowed based on the provisions for outdoor recreational lighting. It is worth noting that there are other outdoor recreational light fixture options available that do meet the typical code requirements for lighting, as it relates to tilt and cut-off. As previously mentioned, the Plan Commission may waive the performance standards for outdoor recreational uses. If the Plan Commission is willing to waive the zero -degree tilt and full cut-off fixture requirement, staff strongly recommends that a new photometric plan be submitted prior to installing the lights that clearly show the light levels at the property lines and the angle that the light fixtures will be mounted to ensure that the intensity of the lights do not exceed the 0.5 footcandles at the property line on adjacent residential properties. The Resolution is drafted as such. The wooded area that currently splits the two properties east and west has good coverage currently and the 24' post will be 5' off the lot line. 3. The post will be mounted on top of a concrete tube. The concrete tube will use a shoe base to attach to a concrete pillar that is 2.5' below ground level. This is the current recommendation from several websites for the weight of the pole and lights. 4. ZONING: There are no current regulations on where on the property line LIGHTING must be, but I would anticipate that we can follow the "Retaining Wall" specifications by staying 5' off the most eastern property line. This would allow us in the future to put a retaining wall or fencing behind it to allow for even better separation between the business space and the HOA land from Kristen Downs Subdivision. V. The project will include a new building for the store and a fenced outdoor display area. The structure would be adjacent to the Aurora Health building with the outdoor display area extending from the new building to the existing Dollar Tree store. CONSISTENCY WITH ADOPTED PLANS 039-2024 Comprehensive Plan: The 2020 Plan depicts the property for commercial uses. The petition is consistent with the Plan. The property is zoned PD-34 as part of the original Dreamland Planned Zoning: Development and is under the auspices of the B-3 General Business District. The use is permitted subject to BSO approval. STAFF DISCUSSION PC 039-2024 As stated above, the petitioner requests approval of a Building, Site and Operation Plan (BSO) for a new Tractor Supply Company retail location between Aurora Health and Dollar Tree located on the northeast corner of Moorland Road and Janesville Road. The Tractor Supply fagade is proposed approximately six (6) feet in front of the Aurora Health building which is then approximately fifteen feet closer to the parking area than the Dollar Tree. The proposed building will be 21,930 square feet with a fenced outdoor display area of approximately 19,322 square feet. Hours of the business are likely to be Monday -Saturday 8:00 AM to 9:00 PM and Sunday 9:00 AM to 7:00 PM. Architecture The proposed building materials on the front (south) side and the side in the outdoor display area (east) has a mixture of two-tone earth tone brick veneers and stone veneer horizontal bands. The front will have two bronze standing seam metal awnings on either side of the entry with a stone veneer column between the two awnings. The same stone veneer column material would be used on the front corners of the building as well. The front entryway of the store bumps out further and would have an EIFS material painted to match the band of masonry on either side. A standing seam metal hip -roof canopy structure above the entry door matches the other storefronts in the shopping center with the Craftsman and Prairie style architecture. The side adjacent to the Aurora Health building(west) and the backside of the building (north) will be painted split -face CMU block as these areas will not be visible. A four (4) foot connector 95 wall is proposed to make the front fagade a continuous building and will be constructed to match the front fagade of the storefront. The building return between the column wrapping the front corner of the building to the four -foot wall must also match the same materials as the front fagade. The outdoor display area between the new structure and the Dollar Tree store will have a 4'-4" stone veneer wall with a black aluminum tube fence extending to 16 feet in height. The return to the Dollar Tree store must also have the same 4' stone veneer wall and fence. The backside of the outdoor display area is proposed as an opaque fencing material. The fence will be a black aluminum tube to match the fencing in the front, but will have a prefinished metal panel to screen the loading area behind. The colors of the structure will be a mixture of browns and tans with a reddish -brown band over the doorway. The building will have a flat roof with parapet walls extending 24 feet in height with the top of the bronze roof feature being 30 feet in height. The parapet walls appear to be tall enough to screen the rooftop mechanicals. In front of the store there are two proposed outdoor display areas shielded from the parking area with a four -foot wall constructed of the same material as the stone veneer columns and base of the fence. These two approved outdoor storage areas in front of the store must be kept neat and orderly and free of debris at all times. This area of the City is governed by the General Design Guide, but more directly the Moorland South Design Guide. The General Design Guide calls for 50% masonry product and the proposed structure meets this main requirement. The Moorland South Design Guide gets into more detail and looks to promote structures with Craftsman and Prairie Style Architecture. Site, Parking, and Access The parcel as a whole currently includes the internal roadway as well as the storm detention pond and area with the utility structure on the opposite side of Aurora Health. Additionally, there is a proposed outlot on the southern side of the parking area identified. Prior to obtaining building permits, a Certified Survey Map will be required to separate these other areas from the Tractor Supply Company area. This is noted in the Resolution. The overall site is already pad -ready and has adequate access existing from traffic -controlled intersections at both Janesville Road and Moorland Road. However, the parking lot was never installed as part of the other development. The city allowed the majority of the parking lot to be undeveloped until future users were approved for the complex. The petitioner intends to convert the grass area in front of the new building to a parking lot matching the existing parking pattern as far as size and landscaping islands. Ninety-six (96) new parking stalls along with three (3) stalls intended for vehicles with trailers are shown. The code requires one space for every 150 square feet of customer area. With 15,415 square feet of sales area, the code would require 103 parking stalls. Even though the number of parking stalls is slightly less than required, the entire complex as a whole should have ample parking for all stores. The pedestrian sidewalk continuing through the development will extend around the outdoor display area meeting the sidewalks on both the Aurora Health property and the Dollar Tree property. Fire Department Approval The site plan is still subject to Fire Department approvals at the time of building permits as well. Possible changes to the site plan may be required based upon the final Fire Department review. Dumpsters/Refuse Containers/Outdoor Storage A dumpster enclosure is proposed behind the building. As required by code the enclosure will be constructed of similar materials to the overall structure. Outdoor storage is proposed in both the outdoor display area as well as the two defined areas behind the masonry wall in front of the building. There must not be any outdoor storage anywhere else on the site including the rear of the building and in the parking lot. Landscaping A preliminary landscaping plan has been submitted as part of the proposal and includes landscaped planting beds along the front of the fenced outdoor display area. Landscaping in the new parking area includes the continuation of the landscape islands that will be populated with shrubs and mulch to match 96 the existing planting areas. The resolution states that a final landscape plan will need to be approved by the City Forester prior to the issuance of building permits. Signage Two signs are shown on the elevations. The first is the main identification sign and the second is on the structure identifying the garden center. A separate sign permit is required for the signage. Lighting A photometric plan has been submitted that appears to meet the City requirements for lighting. Final fixtures, light poles and bases must be submitted during permitting to ensure they match the remainder of the development complex and meet all City requirements. Sewer, Water, Storm, Grading The development will be served by existing public sanitary sewer and water. Further, all stormwater arrangements have been accommodated for when the Kohl's Department Store development was constructed. Minor grading may need to occur when the installation of the new parking lot is completed. Certified Survey Map As previously mentioned, the lot for the Tractor Supply Company project currently includes a proposed outlot along with the roadway, detention pond and utility structure. A Certified Survey Map is needed prior to issuing building permits to separate the lot for the store and parking while removing the remainder of the property. Tree 99 store will have a 4'-4" stone veneer wall with a black aluminum tube fence extending to 16 feet in height, and WHEREAS, The backside of the outdoor display area is proposed as an opaque fencing material constructed with a black aluminum tube to match the fencing in the front, but will have a prefinished metal panel to screen the loading area in the rear of the site, and WHEREAS, The Exterior Building and Fencing Materials: The front and right side of the building will utilize an alternating two-tone earthtone brick veneers and stone veneer horizontal bands. An E.I.F.S, fagade will cover the front entry vestibule with a low-pitched standing seam metal roof above and a pair of standing seam metal awnings located on both sides of the entry feature.
