OLD BUSINESS FOR CONSIDERATION RESOLUTION PC 033-2023 Approval of a Rustic Structure designation for Bryon Hrin located at S99 W20523 Parker Drive / Tax Key No. 2280.999.021. Planner Trzebiatowski provided an update as far as what has happened since the last Plan Commission meeting. The last request included buildings 4, 5, 6 and 7 would be removed. The large barn structure (#3) would granted rustic structure status and then outbuildings 1 and 2 would be kept as buildings `by right' with an additional 13,000 square feet of lot area that would be combined by the petitioner. Discussion points included combining an additional lot to the petitioners, timing of when the buildings would need to come down, talk of a 5-year sunset. There has been nothing new proposed since the last meeting. The petitioner is here with his attorney to continue discussion. Attorney James Hammes spoke as he is working with the petitioner. In his opinion all of the buildings apply with the Rustic Structure provision. The application is for everything but the petitioner is willing to remove buildings 4, 5, 6 and 7 in order to move this petition along. The Resolution as provided allows the designation, but the resolution doesn't take in to account the period of time that the other buildings would be removed. The proposal is that after the sale of Lot 4, that would commence the removal of buildings 4, 5, 6 and 7. Also the sunset provision of five years. They are asking for Resolution as written which includes the Rustic Structure, but also add the offer to remove the buildings. Planner Trzebiatowski noted that there is a draft resolution that considers the latest offer by the petitioner including the removal of the buildings. Alderman Kubacki said the biggest decision is whether this qualifies as a rustic structure. Our definition of a rustic structure is a building that is distinctly set apart and unique from other structures and buildings due to its construction technique, materials, age, local historic significance, design or other characteristics. Is this barn unique and one -of -a kind in Muskego? There are numerous barns of similar age. What makes this particular structure unique, a one -of -a kind? Attorney Hammes noted his opinion is that the code is in the disjunctive with the use of the word or. Also, there is no definition of historic significance, which is not defined. Alderman Kubacki said that unique is easy to define. Attorney Hammes noted again that the code is in the disjunctive. Alderman Kubacki noted that is his interpretation, but he disagrees. The petitioner noted for uniqueness, that nobody builds two -foot walls out of fieldstone, nobody uses trees and splits them in half where there is whitewash over the bark which is unique. The shape of gable roof and what they were built out of, rough cut lumber is unique unless special order. Alderman Kubacki said he is unaware of other barns in Muskego constructed in the same manner. The petitioner said if you build a new barn it wouldn't be built like that. Alderman Kubacki said that it is unique to todays building standards but was it unique at the time it was built along with other barns. Commissioner Graf appreciates the response as an alternative proposal from where this started. He thinks it comes back to the heart of what the overall plan was with the whole subdivision. He knew that he had to sell this idea and he put the buildings at risk when he made the decision. So as a Board, they need to make a decision whether historical significance is sufficient to make a stand on these structures. The Plan Commission needs to have firm ground relative to how this has been decided in the past on the square footage on a property and how decisions like this will be made in the future, as this is still an exception. Mayor Petfalski added that they need reasonable conditions to the request and what is appropriate. He is looking for consistency and reasonable in the future. Commissioner Graf asked if there has been anything 4i similar in the past. Planner Trzebiatowski said that there has been rustic structures in the past but they have been for a single building and not this large. Commissioner Graf asked about if this impacted the two -percent rule. Planner Trzebiatowski noted that yes, but not to this extent. Alderman Kubacki asked if this is considered a rustic structure, how does that affect the other buildings. So, buildings 1 and 2 because the additional land he could keep those buildings. Planner Trzebiatowski said that if he was building new and attaching the land, he would be able to keep buildings 1 and 2 and that would be the maximum. The rustic structure exempts it from the size limit so it doesn't apply to the two -percent. Mayor Petfalski said they are talking about conditions on for the possibility of allowing the barn. The conditions may be that all the other buildings have to be removed and can keep the barn. The conditions may be he has to add a lot in order to keep the barn. The Plan Commission has options related to put reasonable conditions on the Conditional Use. Attorney Hammes said that reasonable conditions that are related to this request. Mayor Petfalski added that for this Conditional Use it is going outside of the accessory structure percentage. Attorney Hammes noted that his concern is that what is really being talked about is density, too much square footage of accessory structure for this lot, too much density. Mayor Petfalski added that in the overall view, it is part of the Conditional Use request. Attorney Hammes said that there is nothing articulated in the code related to the rustic structure establishing a relationship with the rustic structure designation and density of buildings on a lot. Mayor Petfalski said that with conditional uses there can be reasonable expectations. Alderman Kubacki said the density is the biggest issue and this proposal is the same as what was discussed three months ago. His position remains the same. Either all the buildings are removed except the barn can stay or one of the contiguous lots must be withdrawn from the market and attached to this property to have sufficient acreage for all the outbuildings. Mayor Petfalski asked that the fact that he is close to that number, as long as the adjacent lot is unsold and vacant and he keeps it, then when he sells the lot the buildings must be removed. Planner Trzebiatowski explained the most recent proposal and explained that as lots sell, City staff would calculate the two percent and the petitioner would need to remove accessory structures to stay within the two percent with a five-year sunset. Then looking forward building three would be allowed to remain. Commissioner Buckmaster said he has been quite clear and all of the buildings would need to be removed, being buildings 4, 5, 6 and 7. Willing to move forward with Alderman Kubacki's suggested plan. Otherwise he is not in favor of this. Attorney Hammes noted that there was an acknowledgment that the barn is a rustic building, but the Plan Commission is not willing to grant that unless another building is taken down. Mayor Petfalski noted that the Plan Commission is discussing conditions to approve the Conditional Use. Attorney Hammes then said that if the barn is a rustic building, then the Plan Commission has to make that finding. But if the Plan Commission wants to say it is a rustic building, but we are going to grant the Conditional Use subject to these other conditions then they can do that and see if it stands the test of time. Mayor Petfalski added that the Plan Commission can come to a conclusion whichever pace or path they take to get there. Commissioner Graf supports the past recommendation. Mayor Petfalski reiterated that he has 5 years to take down buildings 4, 5, 6 and 7 as the adjoining lots are sold that the square footage would be calculated. Planner Trzebiatowski confirmed that after a lot is sold, staff would calculate the allowable square footage allowed, which would determine which of the buildings would need to be removed. Commissioner Graf isn't particular on which buildings come down in which order, but just that they all are removed. Alderman Kubacki asked that if all the lots are sold that there would only be one building left. Planner Trzebiatowski explained the current discussion would include after all the lots are sold that buildings 1 and 2 would stay and would be allowed by right and building 3 would remain with a rustic structure designation. Mayor Petfalski asked if the Plan Commission has any leeway on density. Planner Trzebiatowski noted that by right, no. Rustic structure allows that but if rustic structure is not granted then the limit is two percent. Commissioner Buckmaster asked what the enforcement would be. Planner Trzebiatowski said it would be citations. Alderman Kubacki said this does not solve the problem. Density is the problem. When all the lots are sold all the extra buildings are gone except buildings 1, 2 and 3. Attorney Hammes said that buildings 1 and 2 entitled by right. Alderman Kubacki said they are from the standpoint of density of the parcel. Attorney Hammes said that a rustic structure has nothing to do with density on the lot. Alderman Kubacki said that at the end of the process buildings 1, 2 and 3 would stay. He said he is not comfortable with this. Commissioner Buckmaster and Graf agreed. Alderman Kubacki made a motion to deny Resolution PC 033-2023. Commissioner Graf seconded. Upon a roll call vote: Commissioner Graf, no, still on the owners shoulders to expand his property to include building 3. Commissioner Oliver, no, the property needs to fit all Ordinances with the structures and densities as noted. Alderman Kubacki, no, does not believe the barn qualifies for a rustic structure. Commissioner Buckmaster, no, does not believe density requirements are being met adequately per the CUG and the barn does not meet the requirements for a rustic structure. Mayor Petfalski, yes. Motion to deny Resolution PC 033-2023 is approved 4-1. Commissioner Buckmaster made a proposal to bring Resolution PC 033-2023 back to the table. Seconded by Alderman Kubacki. The motion was to deny and four members voted no, but this was in error. The motion is to deny the request for a rustic structure. Upon a roll call vote: Commissioner Graf, yes, based on previous statements. Commissioner Oliver, yes, based on previous statements. Alderman Kubacki, yes, based on previous statements. Commissioner Buckmaster, yes, based on previous statements. Mayor Petfalski, no. Motion to deny Resolution PC 033-2023 is approved 4-1. NEW BUSINESS FOR CONSIDERATION RESOLUTION PC 001-2024 Approval of a Building, Site and Operation Plan for Mander Collision and Glass located at S106 W16197 Loomis Road / Tax Key No. 2293.996.001. Planner Trzebiatowski provided an explanation of the project. Mander Collision took over the facility fairly recently and they are looking to add parking. Staff does not find any issues. One note is the curbing and when a commercial site is in a more developed area curbing is required and in this area there is no curbing and since this site is not curbed staff is not suggesting curbing. During a site visit it was noted that there are three shipping crates on -site and via discussion with the petitioner they are needed for storing materials. A solution proposed is to expand the fenced area with a taller white vinyl fencing with a new gate. Staff suggests that they replace the shorter wood fence with matching the same fencing to be a uniform appearance. Commissioner Graf made a motion to approve Resolution PC 001-2024. Commissioner Buckmaster seconded. Motion to approve Resolution PC 001-2024 passed unanimously. RESOLUTION PC 003-2024 Approval of a Preliminary Plat for Golf View Estates subdivision located along the north side of Ryan Drive / Tax Key Nos. 2255.979.002 and 2255.998.001. 7 Planner Trzebiatowski explained the new proposal being a conservation subdivision with preserving open space and smaller lots. This proposal received approval from the Plan Commission and Common Council for conservation planned development zoning back in October 2022. The approval was contingent on plat approval. The yield plans shows 15 lots with up to four bonus lots. The request is for 19 lots with more than 50% open space being preserved. The most important note is that they own land from Boxhorn Drive on the north to Ryan Drive on the south and they are willing to make a public trail that extends the entire length. The feature would be built to City standards at the expense of the developer. Alderman Kubacki made a motion to approve Resolution PC 003-2024. Commissioner Buckmaster seconded. Motion to approve Resolution PC 003-2024 passed unanimously. MISCELLANEOUS BUSINESS ADJOURNMENT Commissioner Buckmaster made a motion to adjourn. Commissioner Oliver seconded. AICP BACKGROUND PC 010-2024 The Plan Commission originally authorized an annual review for the property for every year in the month of August until further notice. The petitioner received Plan Commission approval as per #PC 155-1990 and #PC 012-2004. The provisions of those approvals are discussed below. PLAN CONSISTENCY PC 010-0204 Comprehensive Plan: Zoning: DISCUSSION PC 010-2024 The 2020 Plan depicts the area for agriculture and open lands use. The use as a business existed and is consistent with the Plan. The property is zoned A-1 Agricultural District. The proposal is consistent with the Municipal Code and past petitions. The property has had prior approvals for the snowplowing and grading business since 1990. The property currently has an existing 252' x 60' metal farm pole building of which 40' is used for shop area and the rest used for the agricultural practice of the property. The property also houses an approved 32' x 40' salt storage structure. The previous approved resolutions both state that no outside storage of any equipment or LP fuel tanks be located next to the building, and that the business be limited to 17 drivers. Plan Commission requested the annual review during the approvals of February 2004 to make sure the site does not become unsightly and that the outside storage is outside of the public view and mostly contained in the approved storage buildings. A site inspection was conducted on February 20, 2024 and the site was in compliance. Any larger trucks were parked way back by the building or in the building. Plan Department City of Muskego Adopted: Defeated: Deferred: Introduced: March 5, 2024 ATTEST: Adam Trzebiatowski AICP, Planning Manager 26 City of Muskego Plan Commission Supplement PC 018-2024 For the meeting of. March 5, 2024 REQUEST: Metal / Additional Accessory Structure W197 S7325 Hillendale Drive / Tax Key No. 2190.994.016 NW '/4 & SW '/4 of Section 8 PETITIONER: Donald Schemenauer of Breezy Hill Nursery for Joshua & Mary Jean Sparks INTRODUCED: March 5, 2024 LAST AGENDA: N/A PREPARED BY: Adam Trzebiatowski, AICP BACKGROUND PC 018-2024 The petitioner is proposing to construct a new 21' x 41' (861 square foot) accessory structure on site to replace the old pool house. This will be the third accessory structure on the property and the building will clad with cedar siding matching the house and a metal roof. Plans are attached for your review. Plan Commission may waive the architectural requirements for accessory structures when any of the following are met: 1. The structure is screened from view, 2. The principal structure is composed of materials, colors, or styles that are inappropriate in their applications to an accessory structure, 3. The Plan Commission finds other circumstances to be present which would result in no undue harm to the property or its surroundings, 4. When the area is found not to be predominately residential. Plan Commission may approve the materials as submitted, or require modifications prior to release of building permits. PLAN CONSISTENCY PC 018-2024 Comprehensive Plan: The 2020 Plan depicts the area for medium density residential land use. The proposal for this residential outbuilding is consistent with the Plan. The property is zoned RS-2 Suburban Residence District. Accessory structures totaling 12,885 square feet are permitted on the subject property due to the Zoning: property being over 14 acres. The current proposal measures 861 square feet in area (4,899 total accessory structures). The proposal meets the bulk requirements of the Zoning Code. STAFF DISCUSSION PC 018-2024 The architectural requirements state that the accessory structure should have similar materials and colors as the principal residence. Planning Commission approval is being sought due to this concern, and also since this is the third accessory structure over 120 square feet on this property. Any more than two accessory structures greater than 120 square feet in size on one property require Plan Commission approval. The third accessory structure will be used as a pool house next to the new pool and will consist of an open-air lounge space, kitchenette, storage room and changing room. A glass overhead garage door is located on the side WA of the structure. The pool house must be used as an accessory structure and cannot ever be used for housing and may not have sleeping quarters within the structure. The petitioner is proposing cedar siding and a steel roof on the accessory structure. The cedar siding will be stained to match the siding of the existing home along with the same style and color trim. The steel roof is proposed as the pitch of the pool house is lower than what is recommended for asphalt shingles. A bronze color will be used for the steel roof to match the color of the trim on the pool house. There are two (2) other accessory structures on the property. The accessory structure would be located more than 750 feet from Hillendale Drive. The proposed height of the building is approximately 13'5" feet to the highest point, which is within the allowable height based on the size of the lot. The Resolution states the following items: BE IT FURTHER RESOLVED, That the building and lot cannot be used for the operations of any business activities or for business storage. BE IT FURTHER RESOLVED, That the building cannot be used for housing and may not have any sleeping quarters within the structure. BE IT FURTHER RESOLVED, That the floor of the entire building must be concrete or asphalt, unless a specific portion is only to be used by animals. BE IT FURTHER RESOLVED, The depth of the over hangs on all sides of the building must at least be equal to those on the main home. We are proposing adding a third accessory structure on their property at W197S7325 Hillendale Drive. This proposed structure is a pool house to replace the existing pool house that was removed to install the new pool. The proposed pool house will consist of a lounge area(open air), kitchenette, storage room and changing room. The interior walls and ceiling will be finished with a tongue and groove wood finish. The proposed pool house is approximately 741 square feet with nearly 290 square feet being open air. The proposed pool house will be site framed with a rear wall height of 9' and a front wall height of 11'. The roof framing will consist of LVL headers and I joist rafters with 1/2" OSB roof decking. The roof will be a shed style roof pitched front to rear with a 2/12 pitch. Roof covering will be standing seam metal with a dark bronze finish to match the window, door and siding trim color on the existing home. We are using a standing seam metal roof vs a traditional dimensional shingle roof because of the low roof pitch of 2/12. Dimensional shingles are not recommended on a roof with a pitch of lower than 3/12. The exterior siding on the proposed pool house will be cedar horizontal beveled with a 6" exposure, matching the cedar horizontal beveled siding on the existing home. The cedar siding will be stained to match the color on the existing home. The exterior trim on the proposed pool house will match the style and color that is on the existing home. Soffit and fascia will be metal to match the standing seam metal roof in dark bronze color. There will be a 16' x 8' all glass overhead garage door on the front wall elevation. This overhead door will match the overhead doors on the existing home. There is an existing permit for the foundation only of the proposed pool house that was issued on December 11-2023 with a permit #20232192. There are currently two other accessory structures on the property. The one that is closest to the road is 88x26 (approximately 2288 square feet) and the structure that is closest to the existing home is 50x35 (approximately 1750 square feet) The property that these buildings sit on is 14.79 acres. The site contains three mini -storage buildings towards the rear of the site and an office on the front of the site. Approvals were received per #P.C. 227-94 for a Conditional Use Grant and Building, Site, and Operation Plan to conduct mini -warehouse operations on the property. The resolution approved two structures, and both structures are now constructed on the lot. There have been additional approvals, most recently approved by #P.C. 051-2013, to temporarily allow some outdoor storage of U-Haul vehicles and up to three additional storage buildings, one of which has been built. The last two storage buildings where issued permits in January 2020. At this time there has not been any progress in the two additional storage buildings and the permits have since expired. Due to the lapse in progress being more than two years, pursuant to Amended Plan Commission Resolution #P.C. 051-2013 full re -approvals of all un-built phases will be required through the Plan Commission. The CUG dictates that upon obtaining the building permits for the final buildings, no outdoor storage is permitted, no vehicle repair is allowed, and no business operations are allowed to be conducted from the storage buildings. All U-Haul operations, parking, storage and displays are no longer allowed on this site unless further Plan Commission approval is obtained. A bi-annual review is required. STAFF DISCUSSION PC 013-2024 A site inspection of the site was conducted on February 20, 2024. The site did not meet the conditions formally approved. There were multiple trailers and miscellaneous materials stored outdoors within the fenced area. Additionally, since the building permits have been expired for more than two years, all construction related materials must be moved to an enclosed storage or removed from the site. A letter was sent to the business owner identifying the issue and a follow up inspection was conducted on February 27, 2024 and the site was not in compliance due to trailers and miscellaneous materials being stored outdoors. Even though the resolution is drafted for approval, staff recommends deferring the annual review until April for site compliance to be met. No complaints were received by the Planning Department since the last annual review. The resolution is worded to have a review every two years. The property is zoned B-4 and the use is permitted by Conditional Use Grant in the district. The approved plans permit the following: • Seventy-eight (78) stalls for vehicles for sale, • Ten (10) stalls for sale customer vehicles, • Seven (7) stalls for employees, • Fourteen (14) stalls for customer repair vehicles, • Twelve (12) stalls for loaner cars, • Two (2) stalls for tow trucks/deliveries, • Two (2) enclosed outdoor storage areas, • No vehicles can be used as signage, • Signage and banners displayed on vehicles for sale is prohibited, except for a price sign hanging from the rear view mirror and for vehicle disclosure information to be visible as required by State Law. STAFF DISCUSSION PC 014-2024 An inspection was completed on February 20, 2024 and compliance was not found. The issue/violations included cars and flatbed trucks double parked and/or parallel parked in locations that they are not allowed and in some cases were impeding access through the site and vehicle parts being stored outside. A letter was sent to the business owner identifying the issues and a follow inspection was conducted on February 27, 2024 and the site was not in compliance due to the same issues. Even though the resolution is drafted for approval, staff recommends deferring the annual review until April for site compliance to be met. Additionally, Resolution #PC 055-2022 in November 2022 the petitioner was granted the approval of a Building, Site and Operation Plan Amendment for the property south of Muskego Dam Road, which is immediately south of this property. The BSO Amendment allowed for an eight -foot solid fenced enclosure to store vehicles to be sold. Currently, the petitioner has not submitted the required documents for the Zoning Permit and the fence has not been constructed but many vehicles and flatbed trucks are still being stored on the property. 40 Even though the resolution is drafted for approval, staff recommends deferring the annual review until April for site compliance to be met. STAFF RECOMMENDATION PC 014-2024 Deferring of Resolution # PC 014-2024 until April for site compliance to be met. Given the past history of constant issues on this site, the Plan Commission may want to look at further actions to strongly encourage compliance with the approvals for these sites. Plan Department City of Muskego 46 Adopted: Defeated: Deferred: Introduced: March 5, 2024 ATTEST: Adam Trzebiatowski, Planning Manager iIFl City of Muskego Plan Commission Supplement PC 015-2024 For the meeting of. March 5, 2024 REQUEST: Metal Accessory Structure S82 W13560 Hi View Drive / Tax Key No. 2209.942 NW '/4 of Section 13 PETITIONER: David Tippel INTRODUCED: March 5, 2024 LAST AGENDA: N/A PREPARED BY: Adam Trzebiatowski, AICP BACKGROUND PC 015-2024 The petitioner proposes to construct a new accessory structure on site that measures 40' x 50' (2,000 square foot total). This building will be clad in metal with a metal roof. PLAN CONSISTENCY PC 015-2024 Comprehensive Plan: The 2020 Plan depicts the area for low density residential land use. The proposal for this residential outbuilding is consistent with the Plan. The property is zoned RSE Suburban Estate District and the structure is proposed along the side of the house. Accessory structures totaling 2,007 Zoning: square feet are permitted on the subject property based on the size of the property. The current proposal measures 2,000 square feet in area. If all other accessory structures are removed from the property the proposal meets the bulk requirements of the Zoning Code. STAFF DISCUSSION PC 015-2024 The architectural requirements state that the accessory structure should have similar materials and colors as the principal residence. The petitioner is proposing a steel siding and a steel roof on the accessory structure with colors to match the house. The board and batten style siding of the house will match the look of the steel siding. The colors will be beige tones for the siding, wainscoting and roof to match the house. Windows are located on three sides of the structure with a service door along with a single overhead door to offer a residential feel of the structure. Additionally, 18-inch overhangs are included to match those of the house. Planning Commission approval is being sought due to the difference of materials. 48 The accessory structure would be located along the side of the house set back approximately 240 feet from Durham Road. The proposed height of the building to the midpoint is 18'4" as measured by the Code, which is within the allowable height of an accessory structure with a property this size. The petitioner also noted that there is a tree/shrub line along the west side of his property to assist with screening the accessory structure from Durham Drive. With this being said, the structure will be in plain view from Hi View Drive and partially visible from some sections of Durham Drive. Below are two images from Google Street View showing the views of the area. View from Hi View Drive View from Durham Drive The petitioner stated that the large accessory structure is to house some agricultural equipment in order to farm his property. As this is a residentially zoned property, this structure and/or the property cannot be used for any business or commercial storage or use. Based on the aerial photo of the property there is currently a shed and carport on the property. These structures and any other accessory structures must be removed from the property prior to final occupancy of the new accessory structure in order to meet the maximum allowable square footage of accessory structures on the property. The Resolution is drafted as such. The Resolution states the following items: BE IT FURTHER RESOLVED, That the building and lot cannot be used for the operations of any business activities or for business storage. BE IT FURTHER RESOLVED, That the floor of the entire building must be concrete or asphalt, unless a specific portion is only to be used by animals, which need specific City approvals. BE IT FURTHER RESOLVED, The depth of the over hangs on all sides of the building must at least be equal to those on the main home. BE IT FURTHER RESOLVED, That the colors of the proposed building must be similar to the colors of the home. BE IT FURTHER RESOLVED, That all other accessory structures will be removed from the property to meet the maximum allowable square footage of accessory structures on the property. STAFF RECOMMENDATION PC 015-2024 Approval of Resolution #PC 015-2024, if the Plan Commission feels the proposal metal structure meets the typical waiver requirements to allow metal siding and roofing. Given the visibility of the proposed structure, the Plan Commission may want to require a different exterior material (siding and roofing) that better match the home. There was a similar sized accessory structure on a similar sized lot proposed to the Plan Commission in 2008 further east on Hi View (SW corner of Hi View and North Cape) that was denied having metal materials due to its visibility. The only difference between that structure and this one is that this one does have agricultural uses present on site and in the area. 49 HI VIEW DR 9 David Tippel S82 W13560 Hi View Drive Q Agenda Item(s) Right -of -Way Properties - i t C W 0 100 200 Feet SKFGO 1 1 1 9\i 1 Prepared by City of Muskego Planning Department RESOLUTION #P.C. 015-2024 APPROVAL OF A METAL ACCESSORY STRUCTURE FOR THE TIPPEL PROPERTY LOCATED IN THE NW 1/4 OF SECTION 13 (S82 W13560 HI VIEW DRIVE / TAX KEY NO. 2209.942) WHEREAS, A survey and building drawings were submitted to construct a 2,000 square foot accessory structure on the property located at S82 W13560 Hi View Drive (Tax Key No. 2209.942), and WHEREAS, The property is zoned RSE Suburban Estate District, and WHEREAS, The proposal does not meet the Plan Commission's standards for administrative approval of residential accessory structures as metal exterior materials being proposed on the accessory structure, and WHEREAS, The total square footage for accessory structures on this property is limited to 2,007 square feet, and said proposal meets the bulk requirements of the Zoning Code, and WHEREAS, The accessory structure will be used for personal storage only, and WHEREAS, The accessory structure would be located along the side of the house set back approximately 240 feet from Hi View Drive, and WHEREAS, The accessory structure will be a beige tones for the siding, wainscoting and roof to match the house, and WHEREAS, The board and batten style siding of the house will match the look of the steel siding , and WHEREAS, The accessory structure will have 18-inch overhangs to match those of the house WHEREAS, There is a tree/shrub line along the west side of the property to assist with screening the accessory structure from Durham Drive, and WHEREAS, There is currently a shed and carport on the property that must be removed from the property along with any other accessory structures prior to final occupancy of the new accessory structure, and WHEREAS, The accessory structure will also include windows located on three sides of the structure with a service door and a single overhead doors to offer a residential feel of the structure, and said proposal does meet the Plan Commission's standards for administrative approval of residential accessory structures. Although the building will have stee siding the look will resemble the same appearance of the vinyl siding that is currently on the house. The vinyl siding on the house is a board and batten style that in appearance will match he look of the steel siding. The steel siding will be color matched to be as close to the same color as the house as possible. Part of my property is zoned agricultural. I am looking to build this building to house some agricultural equipment that I already own, along with equipment hat 1 am looking to purchase after the construction of the building is complete. In the future I am looking to do some farming on this land. This land is currently being farmed by a local fa mer. I am looking to use steel due to the durability of the steel, as well as the lengthy paint warranties that come with steel products to ensure that the structure continues to look nice as the years go by. I have seen more and more steel structures within the City of Muskego being bL ilt in the last few years. I believe this is due to the versatility within the steel industry to be able to make these structures look like the other structures within the City. Also I do have a tree/bush line that runs the whole west side of my property that will help to conceal the pole building frc m the view of citizens traveling on Durham Road. The pole building will sit approximately 240 feet from Durham Road. The pole building will be set back approximately 240 feet from Hi View Drive. I would also like to take a minute to point out that the city has approved the construction of 2 other steel buildings within my neighborhood on Northview Drive, 1 of which is visibl from my yard and sits approximately 650 feet from where I am looking to construct my building. This building is visible from Hi View Dr and sits approximately 300 feet off Hi View Drive and 195 feet off of Northview Drive and is visible from the road. The second building sits 220 feet off of Northview Drive and is visible from the road. I would like to take this time to thank you for your consideration. Design Guide(s) The General Design Guide Design Guide governs this area. See comments below about building design. _ I STAFF DISCUSSION PC 016-2024 The applicant is proposing to build a new 11,800 square foot single story multi -tenant building for up to five future commercial tenants. The units range from 1,900 square feet to 4,000 square feet. A small office and restroom will be constructed within each of the units with the remaining space for parking 61 and/or storage of the tenant. There are no specific tenants that have been noted to the City at this time. However, all future tenants are expected to be small business owners, smaller contractors or residents looking for storage for larger personal vehicles. The spaces are not allowed to be rented out as general personal mini -storage units. There are no defined hours of operation for the contractors or tenants of the units. Because there are single-family residential units immediately east and west of the proposed building staff suggests that hours be limited to 6:00 am to 10:00 pm. As it relates to tenants of this new building, all tenants must apply for a Business Registration and received a formal approval before they can occupy the space to ensure all proposed use type is allowed by the Zoning Code and Building Codes. As the Business Registrations are reviewed for each future tenant and lease space sizes and uses are known/proposed, parking requirements will need to be determined/allocated for each user and depending on the size and uses for each tenant space, there could be future restrictions as to what type of use and size of spaces can be allowed for remaining tenants based on the amount of parking remaining on site. Architecture This area of the City is governed by the General Design Guide. The building is constructed as a steel building with a masonry band on the bottom of three sides and full steel on the fourth side. The walls will be a light gray color steel siding with the gables being a darker steel color. The masonry band is proposed as earth tones ranging from gray colors to light beige colors. There will be five overhead doors with three facing west and two facing south along with five service doors adjacent to the overhead doors for access for each of the units. The service doors will be black and the overhead doors will match the darker steel color. Windows are also shown at the front of each unit as well as one in the rear of each unit. A small overhang is shown above the service door and window at the front of each unit. The building will have a pitched roof made of a charcoal gray metal standing seam roof. The General Design Guide calls for 50% masonry product with four-sided architecture. The proposed structure includes a masonry band around the west, south and north sides of the building with a masonry column along selected corners of the building accounting for following masonry percentages: • West Elevation - 21.6% • South Elevation - 20.8% • North Elevation - 14.4% • East Elevation — 0% (100% vertical steel siding) The overall masonry on the entire building is 13.8 percent of the vertical wall area (non -windows and non - door areas). With the north and east elevation being extremely below the typical design guidelines for masonry for a new commercial structure, these areas may need to contain more masonry or design features or even possibly dense landscaping, as identified below in the landscape section of this supplement. As a note, the existing building on this site, which this new building will be located behind/next to, is a full masonry/block building. Many other past projects that included adding an additional building on the site have been required to match or complement the materials of the existing building. Based on past approvals from the Plan Commission and based the low masonry percentages and the overall design, the Plan Commission may want to see some changes to the overall building design proposal, such as increased masonry, upgraded materials to complement the masonry and/or more unique design character. The Plan Commission can discuss this more that the meeting and require modifications if they so wish or they can approve the design as proposed, if they feel it meets the design guidelines. One item the applicant offered earlier in the design phase, before the masonry was added to the building, was to include a board and batten style metal panels in place of masonry (this option was retracted when the masonry was added). Staff believes one option could be to add the board and batten style metal panel above the masonry, which might enhance the overall design if it were to replace the currently proposed metal panel. This is just one possible option. Site, Parking, and Access The property that the multi -tenant building is proposed on is unique in that there is 160 feet of frontage on Pioneer Drive and then the property extends north 202 feet behind the existing 3 and a half lots that are along Pioneer Drive. Access to the site is proposed from a single one-way drive along the south side of the property from Pioneer Drive around the existing building with a one-way drive aisle and a one-way exit on the north side of the portion of the property that abuts Pioneer Drive. The drive aisle is 16-feet in width at its narrowest point meeting the Code requirements of a minimum of 12-feet for a one-way drive 62 aisle. A retaining wall extends west from the southern edge of the building into the parking area separating the drive aisle from the paved area in front of the new building. At the time of this supplement being written, staff was not sure what the purpose of this retaining wall is. The majority of the parking area for the new building is designed as an open paved area with eight (8) parking stalls provided along the western edge of the paved area including one handicap stall for the new multi -tenant building's use. The drive aisle between the end of the retaining wall and parking stalls must remain 24-feet as a two-way traffic aisle. Each of the parking stalls will be 10' x 20' meeting the code. Without having known users for any of the tenant spaces it is difficult to calculate a total number of parking stalls needed for the development. However, future tenants will be reviewed on a case -by -case basis during the Business Registration process to ensure that the allotted parking will be sufficient for each tenant. There may be a scenario in the future where individual tenants are not approved based on the available parking stalls remaining. The resolution notes that the outdoor parking stalls for the new building are not approved for outdoor overnight parking or storage. The site plan that has been submitted at the time of writing this supplement includes two areas of parking for employees and work vehicles identified for the DJ's Plumbing business on the south side of the existing building. There are two spaces allotted for DJ's employee parking and a 20' x 68' area illustrated for overnight parking of the DJ's business vehicles. Based on a recent drive -by inspection, it was noticed that there were many company and employee vehicles on site in front of and behind the business. With that being said, staff did question the owner relating to where all of the current company and employee vehicles will be parking on site as those few limited stalls are not nearly enough for the current needs/requirements of the business. The applicant was going to provide staff with an updated plan showing additional parking that was missed on the southern portion of the site, but that has not been provided to the City as of the writing of this document. Based on the overall lack of parking shown for DJ's Lawn Sprinklers work vehicles and employee vehicles, staff is going to have to recommend deferral of this approval in order to receive a site plan that adequately addresses all parking needs/requirements. The revised site plan needs to show actual individual stalls rather than a general boxed area for overnight parking and all parking for all other company and employee vehicles. Also, with this should be an inventory from the owner noting all potential company and employee vehicle counts to ensure the proposed parking will meet or exceed the demand. This is required by the Zoning Code. Additionally, there should be no other vehicles, trailers, machinery, equipment, etc. ever parked anywhere else at any time on site, except for within the buildings. The Resolution is drafted as such. If the applicant gets staff an updated site plan, before the meeting, showing the full parking lot stall design and quantity and a list of all of the vehicles quantities that could need to park on site (all company and employee vehicles), then the Plan Commission may be able to review this at the meeting to address these important parking concerns. The General Design Guide states that parking areas and traffic ways shall be enhanced with landscaped spaces containing trees or tree groupings. However, where building sites limit planting, the Guide states that the placement of trees in landscaped islands is encouraged. Also the Guide looks to break up longer lengths of parking stalls with landscaped islands/peninsulas every ten parking stalls. Staff recommends that at the end of the parking areas a landscaped island be installed with curb and gutter to protect the plantings. The Plan Commission can discuss this further if the owner would like to request some type of waiver of this requirement. The resolution is draft as such. Additionally, the Code requires that any off-street parking area that abuts or faces a residence district shall be offset a minimum of 10-feet and provide a planting screen, landscaped fence or wall at least four feet in height along the side abutting the residence district. The district immediately west of the proposed parking area is HC-1 Historic Crossroads District that allows for a mixture of uses including residential and retail uses. There are currently two residential users and a commercial user west of the property, meaning that the parking area should be offset 10 feet and provide a screening application from the residential uses. Based on the tight layout of the site and use, staff feels that a waiver from Plan Commission would be warranted relating to this topic if the project provides a screening buffer, excluding a chain link fence with slats, between the residential uses and the new parking area. Typically, concrete curb and gutter is/has been required for all new/replaced non-residential parking/drive areas in developed portions of the City. Additionally, the concrete curb and gutter is an aesthetic enhancement and will also assist with keeping trucks and trailers on the paved areas of the lot. This being part of the developed area of the City, concrete curb and gutter should be added to the areas of the parking lot and drive aisles that will be new and/or replaced with new pavement. The Plan Commission 63 can discuss this further if the owner would like to request some type of waiver of this requirement. The resolution is currently drafted to require curb and gutter in all new and replaced paving areas. A six-foot fence is proposed at the back of the entry drive along the southern portion of the property, just west of the existing commercial building. The fence will be constructed of a Trex material in a vertical pattern as a privacy fence. There will be a 16-foot sliding gate (also clad with Trex material) across the drive to provide privacy and security. The fence is only on the entry drive and not on the drive exiting the site. Fire Department Approval The site plan is subject to Fire Department approvals at the time of building permits. Possible changes to the site plan may be required based upon the final Fire Department review. Dumpsters/Outdoor Storage The petitioner states that as part of their lease agreement that any garbage/recycling containers/dumpsters must be stored within the building. This will also apply to all operations on -site including DJ's Sprinklers. Additionally, there can be no outside storage of any materials onsite. There is a location on the northern side of the existing building noted as being DJ's outdoor storage area. If anything is going to be stored in that location it must be screened or enclosed within an approved enclosure. The Resolution is drafted as such. Landscaping The site plan that was submitted shows a four -foot planter bed in front of the fence that also includes four evergreen trees. As mentioned previously the Code requires screening between the parking area and the residences along Pioneer Drive. Additionally, the design guide also encourages landscaping beds to separate and break up the parking areas as previously discussed. Along the backsides of the building (north and east -facing sides) the building is set back 10.5 feet from the east and approximately 15.5 feet from the north to meet the offsets of the B-3 Zoning District. If the Plan Commission is willing to grant a waiver to the masonry percentage, as previously discussed, staff recommends a dense landscaping screen especially to the east, adjacent to the Kristin Down residential subdivision, to ensure that the residential uses do not have to view a large solid metal building wall between existing trees or when the existing trees lose their leaves or when existing trees die off. Note - Screening solutions are always the responsibility of the person that is requesting the project/items that needs to be screened. The Resolution is drafted requiring a detailed landscaping plan, prior to building permits being issued, including landscaping to buffer the residential uses from the parking area, a dense landscaping buffer on the east side of the building screening the building from the residences, landscaping islands at each end of the row of parking, screening any outdoor storage from all views unless an enclosure is included, and dense screening around any ground or wall mounted mechanicals. Typically, the City require any plantings used for screening need to be some type of conifers/evergreens at least 6 tall at the time of planting densely spaced as to serve as a functional screen at the time of planting. Signage No signage details have been provided at this time. The total wall signage allowances are based on the typical code requirements. For this development, the B-3 District standards would apply allowing five percent of the wall area is allowed on each fagade. Typically for multi -tenant buildings each tenant is allowed signage for the leased tenant space they occupy. Separate sign permits will be required before any signage (temporary or permanent) can be installed including both building and freestanding signs. Lighting A photometric plan has been included along with a schedule of proposed lighting fixtures. The photometric plan indicates that the lighting will only be building mounted lights. The photometric plan shows the lighting levels to be less than 0.5 foot-candles at the property lines in all areas except the very western corner of the proposed building. The light levels may abide by the code if additional calculations are made to the property line. Additional information regarding the exterior lighting will be required during permitting to ensure that the lighting levels are less than 0.5 foot-candles at the property line. All lighting must be zero -degree tilt and full cut-off. There are no pole lights proposed at this time, but if any lighting is proposed in the future the light poles cannot have a concrete base more than 6 inches 64 above grade and are limited to 15 feet in height or the height of the building Mechanicals There are no mechanical units identified in the plans submitted. The petitioner notes that each space will be climate controlled and will also have an exhaust penetration from a ceiling hung heater. There have not been any details regarding the venting, but if these vents are more than a residential -style roof vent/stack they must be fully screened from all views and may be subject to Plan Commission approval. This will also apply to any electrical transformers, meters, HVAC unit, louvers, exhausts or any other mechanical unit whether they are roof, wall or ground mounted. Sewer, Water and Stormwater The development will be served by municipal sanitary sewer and water. The engineering department will review the proposal and be sure that all stormwater requirements are met prior to building permits being issued. The following are also part of the Plan Commission resolution: BE IT FURTHER RESOLVED, The site plan is still subject to Fire Department approvals at the time of building permits. BE IT FURTHER RESOLVED, That a separate sign permit will be required before any signage (temporary or permanent) can be installed and this includes any signage on the building. BE IT FURTHER RESOLVED, All lighting fixtures must be full cut-off with a zero degree tilt and the concrete bases for the pole lights cannot exceed 6 inches in height above grade. BE IT FURTHER RESOLVED, That any bollards, railings, ladders, etc. must be painted to match the colors of the principal structure. BE IT FURTHER RESOLVED, That any new handicap signs be permanently mounted in the ground or mounted to the building so they are not moveable. C101 ATE: 1/26/2024 2:17 PM W M W PIONEER CONTRACTOR WAREHOUSES: a. Use — Our intended use for our new space is to provide a small business owner or smaller contractor with an affordable space to lease. Each unit will consist of 2000-4000 sq ft of space including a 150 sq ft office with an ADA compliant bathroom. The entire space will be climate controlled. Each unit will be allotted two parking spaces in the parking lot to be used during normal business hours. There will be no overnight parking, nor any exterior storage permitted. If a contractor or business owner shall occupy a unit, they shall apply for individual Business Registration with the City of Muskego. b. Site Plan —The intent of the layout is to maximize use in the space allotted. We have laid out the building in a way that will work with the existing grades and improve upon them. Due to the limited space on the northwest corner of our existing building, we will have to provide a loop to accommodate one-way traffic. The proposed fence and gate will provide security and privacy to our employees and their vehicles as well as deter unwelcome traffic into our parking lot. We are also proposing limited overnight parking in front of the overhead doors of our existing building for our daily service vehicles. This is a very minimal change as our vehicles are currently parked on the opposite (north) side of the building overnight and brought around to the front every morning to be loaded for the day. The entire south existing parking lot is surrounded and screened by trees to the East and South. We will also install a landscape bed along the west side of the proposed fence to provide additional screening and privacy, while also providing an aesthetically pleasing look. c. Architecture — The architectural design that we have chosen has a color scheme to work with our existing building. We have also chosen a natural color that will blend in to the trees and woodlands to our east, even during the winter months. We have designed the west, north, and south facing facades to incorporate a significant amount of masonry to best abide by the General Design Guide. We have not included masonry to the east side of the proposed building as this is facing a heavily wooded area with existing mature evergreen screening from our neighbors. Our intention is to provide a very clean and professional business atmosphere without drawing attention from Pioneer Drive or the surrounding neighbors. Each unit will have an exhaust penetration from a ceiling hung heater. We, as owners of this building, as well as the existing building on site, have a vested interest in constructing a very attractive building, as our businesses operate on the same site. Any garbage/recycling containers/dumpsters must be stored in the building per lease agreement that we will provide to tenant. The existing chain link fence will remain. We are unclear at this time whether we will have a gate across the northwest drive entrance at the northwest corner of our existing building. There will be no pole lighting on site. Building lighting as per provided photometric drawing. 89 Proposed Pioneer Contractor Warehouses W180 S7732 Pioneer Dr. Muskego, WI 53150 Owner: Hornet Properties LLC S84 W 12696 Schaefer Dr. Muskego, WI 53150 Contact: Eric Huckstorf 262-909-4582 Builder: Cleary Building Corporation 190 Paoli Street Verona, WI 53593 Contact: Chuck Kuiper 262-989-006 CKUPIER(cDclearybuilding.com Civil Engineer/Surveyor: Lynch & Associates Engineering Consultants, LLC 5482 S. March 5, 2024 REQUEST: Approval of a Building, Site, and Operation Plan Amendment for Pop's Kettle Corn S79 W 18927 Janesville Road / Tax Key No. 2225.987.004 NE'/4 of Section 17 PETITIONER: Mark Knudsen INTRODUCED: March 5, 2024 LAST AGENDA: N/A PREPARED BY: Adam Trzebiatowski, AICP BACKGROUND PC 017-2024 The petitioner has submitted a request for approval of a Building, Site, and Operation (BSO) Plan amendment for Pop's Kettle Corn. The request is to allow for limited outdoor and overnight parking of business related vehicles and trailers on the site. PLAN CONSISTENCY PC 017-2024 Comprehensive Plan Zoning: DISCUSSION PC 017-2024 The 2020 Plan depicts this property for commercial uses. The proposal is consistent with the Plan as the current use is already existing and aDDroved for this site. The property is currently zoned B-2 —Local Service Center District. The current use is consistent with the Code. As is noted above, Pop's Kettle Corn is seeking approval for limited parking of business -related vehicles and trailers at their headquarters behind the existing building. The petitioner has specifically identified three trucks, three trailers and his firetruck that would be parked on the eastern side of the property. Additionally, each vehicle and trailer will have a defined parking space proposed. As part of the approval of the building and parking area in 2005 (below) there were eight (8) parking stalls identified along the eastern edge of the parking area. Four of the stalls are shown to be used by three trailers and the box truck. Where the pick-up and fire truck are located there are four spaces that run parallel to the paving edge. a v TENANT V LL --------------- 4 -, TENANT T' 1 JJ 1 3 4 91 That site plan also shows the spacing between the curbs to be 44' 8". The one-way drive aisle requirement of 12 feet must still be met with the box truck and fire truck parked perpendicular to the curb of the parking area. Each parking stall must be a minimum of 9' x 18' in size as required by the code, and must be large enough to fully encompass each vehicle (i.e. the firetruck). Because the existing parking stall layout is changing, the new parking stalls must be painted/re-painted for the new parking stalls. The Resolution is drafted as such. There are no other exterior site or building modifications being proposed. Staff is recommending the approval of the proposed parking of the specified trucks and trailers on the backside of the existing use as there are no customer visits to this location and the trucks/trailers will be neatly parked at the rear of the property. Section 400-178 F. of the Zoning Code notes that the parking of advertising vehicles in prohibited so that means that while the vehicles are allowed to be parked in the marked stalls, if approved, the vehicles are not allowed to be used as signage on their own or parked on other non -approved areas of the site.
