COMMUNICATIONS FROM THE MAYOR'S OFFICE 2024 Budget Planning Calendar Tentative Budget Timetable 2024.pdf CLOSED SESSION Following conclusion of consideration of the above portion of its regularly scheduled agenda, the Common Council will meet to vote on a motion to convene in Closed Session for discussion/action relative to: Ronald Schroeder vs. City of Muskego, Case No. 2:20-cv-01066- WED, United States District Court, Eastern District of Wisconsin. A Closed Session for the above purpose is authorized pursuant to the provisions of Wis. Stats. § 19.85(1)(g), Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved. Upon conclusion of the Closed Session, the Common Council will convene in Open Session to consider its public agenda, including motions to recommend approval or rejection of the above -listed deliberations or any of the public agenda items that have not been acted upon. ROLL CALL Present: Alderpersons Wolfe, Hammel, Terrence, Kapusta, Schroeder, Kubacki and Madden. Also present: Attorney Warchol and City Clerk Roller. STATEMENT OF PUBLIC NOTICE City Clerk Roller stated that the meeting was noticed in accordance with the open meeting law. PUBLIC COMMENT There were no speakers. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Petfalski provided information on several items: • The first item is the League of Wisconsin Municipalities has been working very hard to bring several bills forward to provide extra shared revenue. Along with that, the League hosts a Local Government Day in Madison. The event is May 23, 2023, and encourages Alderpersons to attend. • The State shared revenue has increased by 150%-almost $600,000. • Janesville Road street lights are being removed, recoated and replaced. • The road program began last week - all those affected have been notified of any closures. • Waiting on staff options for the boat launches for Boxhorn and Durham as they are impassable. He will notify Council once he hears back. CONSENT AGENDA Alderperson Kubacki made a motion to approve the items under Consent; Alderperson Schroeder seconded. STATEMENT OF PUBLIC NOTICE Assistant Deputy Clerk -Treasurer Crisp stated that the meeting was noticed in accordance with the open meeting law. PUBLIC COMMENT None COMMUNICATIONS FROM THE MAYOR'S OFFICE Update on dredging for boat launches — Boat launches on Big Muskego Lake were clogged with sediment so there were issues getting on the lake. In Madison today for Local Government Day that the League sponsors. It coincided with the Senate's Public Hearing on shared revenue. There may be something passed that would increase our State aid by about $600,000; currently we get about $400,000. Happy Memorial Day to everyone and thank you to all of the veterans for their service. PUBLIC HEARING To consider the petition of Patrick J. Theys of PJ's Trucking concerning the area described as Tax Key No. 2260.998.002 located at S99W12707 Loomis Drive be granted a rezoning from B-4 -Highway Business District to M-1 - Light Industrial District for the purpose of allowing a trucking terminal/business. Planning Manager Trzebiatowski stated that this is the location of nursery that used to be there. The proposed business use would be for truck parking/storage and other outdoor storage of materials. He gave more information about the zoning and Comprehensive Plan. Mayor closed this public hearing at 6:05 pm. To consider the petition of Jared Burback of Burback Builders concerning the area described as Tax Key No. 2258.996.006 located at Loomis Road & Country Club Lane (Vacant Lot) be granted a rezoning from RM-1 - Multiple Family Residence District and B-4 - Highway Business District to PD Planned Development District (based on RM-3 - Multiple Family Residence District) for the purpose of allowing nine future two-family condos (totaling 18 units). Planning Manager Trzebiatowski stated this is rezoning on the west side of Country Club Lane that leads into Muskego Lakes Golf Club. He spoke more about the zoning and Comprehensive Plan. He spoke expressing concerns about the rezoning of the neighboring property for condos. 2. Steve & Lisa Wolfgang, W139S9979 Jay Dr. (condo complex east of the subject property) He spoke against the proposal. 3. John Wahlen, S99W13956 Clubhouse Ct. (with Cornerstone Development -this address takes you to their model) He complimented the builders and suggested a few things to be tweeked. Mayor Petfalski closed this public hearing at 6:20 pm. To consider the petition of MSI General on behalf of InPro Corporation concerning the area described as Tax Key Nos. 2225.984 located at S80W19025 Janesville Road, 2225.985 located at S79W18997 Janesville Road, 2225.986 located at S79W18953 Janesville Road, and 2225.999.014 located at S79W18975 Janesville Road be granted a rezoning from B-2 - Local Service Center District and RS-2 - Suburban Residence District to PD-45 - InPro Planned Development District (based on B-2 - Local Service Center District) for the purpose of allowing expansion of the InPro campus, including a parking lot and a future office building. Planning Manager Trzebiatowski stated that InPro is one of our large employers here in our business park. They have expanded throughout the years. He went on to speak concerning the rezoning for their future plans for expansion. Those that spoke are as follows: Steve Pavlons; S80W19020 Janesville Rd. He has questions concerning the traffic and the effects on the property that is already there. 2. Roger Zindler; S80W19050 Janesville Rd He has concerns about the extra traffic. Planning Manager Trzebiatowski mentioned that this item and the next two items will be on the Plan Commission meeting held on June 6, 2023. There will be more discussion and detail for the projects. Ordinance #1489 - An Ordinance to Amend the Zoning Map and 2020 Comprehensive Plan of the City of Muskego (RM-1 & B-4 to PD / Burback Builders -Iron Oaks Condos). Planning Manager Trzebiatowski answered Council Members' questions. He then addressed the items of concern mentioned by those residents who spoke during the public hearing. Some of the issues addressed are topics for construction and would come up at an engineering review; they are not zoning topics (he explained the difference). They are asking for a less intense zoning than what is allowed. Ordinance #1490 - An Ordinance to Amend the Zoning Map of the City of Muskego (B-2 and RS-2 to PD-45 / InPro Corporation). Planning Manager Trzebiatowski provided an additional document which is a narrative of their big picture plans. He addressed concerns brought up during the public hearing regarding the impact on traffic on Janesville Rd. City Clerk 6/23cmc 49 AGREEMENT WATER BUGS SKI TEAM, INC. and CITY OF MUSKEGO Piers Placement, Water Ski Jump, and Show Events at Idle Isle THIS AGREEMENT, consisting of nine (9) pages including Exhibit "A", is made by and between the Water Bugs Ski Team, Inc., a Wisconsin corporation, hereafter referred to as "Water Bugs," and the City of Muskego, hereafter referred to as "the City." WHEREAS, Water Bugs understand it may be necessary for Water Bugs to obtain appropriate approvals, if any, from the Wisconsin Department of Natural Resources, hereinafter referred to as "WDNR", for said piers placement on Little Muskego Lake; and WHEREAS, Water Bugs understand it is necessary for Water Bugs to obtain appropriate approvals from the WDNR, to place a water ski jump on the bed of Little Muskego Lake; and WHEREAS, the City's approval of the placement of said piers and ski jump is conditioned upon the execution of this Agreement. NOW, THERERFORE, in exchange for the execution of this Agreement and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Water Bugs and the City agree as follows: 1. Term of Agreement A. The term of this Agreement shall commence on the date on which Water Bugs obtain all required approvals from all governing bodies and agencies, including, but not limited to, the WDNR, for placement of a water ski jump on the bed of Little Muskego Lake and the placement of two piers on the Lake. Water Bugs shall provide the City copies of all approvals obtained by Water Bugs under this Agreement. If no approvals are necessary, Water Bugs shall provide the City with a statement to that effect. Unless earlier terminated by action of the City, the term of this Agreement shall terminate on the 30th day of September 2023. B. The term of this Agreement shall automatically terminate in the event Water Bugs is properly ordered or otherwise required to remove the water ski jump from the bed of Little Muskego Lake or the piers from the Lake by any governmental authority or agency. C. Upon termination of this Agreement, Water Bugs shall remove the ski jump from the bed of the lake and the piers, together with any related equipment and materials, within seven (7) calendar days or no later than September 30, 2023. 2. Ownership and Placement of Piers A. At all times during the term of this Agreement Water Bugs shall be the sole owner of the piers located at Idle Isle Park, W182 S6666 Hardtke Drive in the City of Muskego. Water Bugs cannot, without the prior written approval of the City, assign any ownership interests in the piers or any of Water Bugs' rights, duties, or obligations under this Agreement to any person, entity, or association. 50 2023 Agreement— Piers Placement, Water Ski Jump, and Show Events at Idle Isle Page 2 Water Bugs Ski. Team, Inc. and City of Muskego B. Water Bugs shall be responsible for the physical placing and removal of Pier 1 from Idle Isle Park and Little Muskego Lake. The physical location of the piers shall be placed at a distance of thirty (30) feet from the 5' x 32' piers abutting the boat landing (see Exhibit A) having a maximum length of thirty (30) feet. Pier 2 shall be placed at a distance of fifty (50) feet from the fishing pier at the north end of the park (Exhibit A) having a maximum length of twenty (20) feet and four (4) feet wide. C. Water Bugs will allow the City and the public to use Pier 1 at all times that it is not scheduled for exclusive use of Water Bugs. Water Bugs will make five signs, with prior approval of the Public Works and Development Director. Two signs will indicate that the swimming area will be decreased in size ten minutes prior to and throughout the practice and will be closed during show times as posted on the beach and at the entrance of the park. The swimming area will be increased to its original size ten minutes after the show or practice time unless in the case of a cancelled show or practice. The other two signs will indicate that Pier 1 will be closed to the public one-half hour prior to and throughout the practice/show times posted at the piers and at the entrance of the park. Pier 1 will be open to the public one-half hour after the show or practice time unless in the case of a cancelled show or practice. The last sign will indicate that Water Bugs' Pier 1 is not to be used for public swimming, diving, or jumping from and no public boats shall be docked/moored to said piers. Pier 2 shall remain locked and closed to the public. Signage will be created by Water Bugs indicating closed to public, no mooring, no swimming, no diving, no fishing. Security gate shall extend off both sides of the pier to prohibit access by the public. The Water Bugs' barge will be secured to Pier 2 for the duration of the Agreement. D. Water Bugs shall be solely responsible for and shall promptly perform all maintenance and upkeep required or recommended for the piers and signs. In the event Water Bugs fail at any time to perform any maintenance or upkeep reasonably deemed necessary by the City, upon written notice to Water Bugs, as stated in Section 13(C) of this Agreement, the term of this Agreement shall immediately terminate. 3. Ownership and Placement of Ski Jump A. While the ski jump is on the bed of the lake, Water Bugs shall cause the installation, maintenance, and operation of a flashing yellow light on the ski jump from dusk to dawn. Team, Inc. and City of Muskego D. Water Bugs shall be solely responsible for and shall promptly perform all maintenance and upkeep required or recommended for the ski jump. In the event Water Bugs fail, at any time, to perform any maintenance or upkeep reasonably deem necessary by the City, upon written notice to Water Bugs, as stated in Section 13(C) of this Agreement, the term of this Agreement shall immediately terminate. 4. Usage for Shows and Practices A. A minimum number of show dates and practices will be set at 15-16 (show) and 30-32 (practice), per calendar year for a minimum of 48 events. Should Water Bugs intend to do more than 48 events, they will need to come before the Parks and Conservation Committee for approval at their March meeting. Dates can be taken away based on infractions against Water Bugs. The Parks & Conservation Committee can recommend this to the Finance Committee. B. Times for shows/practices (defined by driving boats and making wakes inside of the no wake buoys): 1) Mid -May to July: 6:30 p.m. to sunset. 2) August: 6:00 to sunset. C. Set-up times for shows/practices (includes moving the ski jump and take-over of Water Bugs piers) is defined as setting up equipment on the Water Bugs piers: 1) Mid -May to July: 6:00 p.m. to 6:30 p.m. 2) August: 5:30 p.m. to 6:00 p.m. D. Take -down after shows/practices by 9:00 p.m. E. The complete sound system will only be used for show dates and should only be loud enough for show spectators and participants to enjoy. One speaker may be used for two practices in mid -July and early August to prepare for tournaments and will only be loud enough for members to hear the music between the shelter and the beach. 5. Removal of Ski Jump and Return of Buoys to Rectangular Position A. Buoys and ski jump and any associated permits must conform to any and all governmental regulations, at all times, concerning piers and ski jumps during the terms of this Agreement. B. Ski jump must be put up and removed within the designated set-up and take -down times in Section 4. See Section 5(D) if the weather prevents takedown of ski jump. C. Buoys in swimming area must be returned to original rectangular position within Committee's designated take -down time. This also applies to when the ski team is giving ski lessons (two separate program offerings) for the Recreation Department. D. In the event a show/practice is cancelled at any time, the ski jump has already been moved to the use position, and weather conditions would make it difficult to return the ski jump to the off -use position, the ski jump is to be anchored by 10:00 am the following day to the off -use position. 52 2023 Agreement— Piers Placement, Water Ski Jump, and Show Events at Idle Isle Page 4 Water Bugs Ski. Swimming buoys will be the last things moved before show/practice time; no more than 10 minutes prior to show/practice time; and returned to their original location within the first 10 minutes after the completion of the show/practice time. F. In the event of hot weather (85+ degrees) when the public is extensively using the beach, the City will reserve the right to disallow the moving of the swimming buoys on scheduled practice/show dates. 6. Signage A. Water Bugs will make the following signs, with prior approval of Director of Public Works and Development: 1) Beach and Park Entrance Signs: Indicate swimming area will be decreased ten minutes prior to and throughout the practice times and closed during show times. The swimming area will be open to public ten minutes after show or practice time unless in the case of a cancelled show or practice. 2) Piers Sign and Park Entrance Signs: Indicate Pier 1 will be closed to public one-half hour prior to and throughout the practice/show times posted at the piers. Pier 1 will be open to public one-half hour after show or practice time unless in the case of a cancelled show or practice. 3) No Public Swimming, Jumping, or Diving off Pier 1 and Pier 2 and No Public Boat Docking: Indicate that swimming, jumping, or diving is prohibited at all times on or near the piers. Also, no boat docking to piers. 7. Parking A. The Recreation Department will issue six (6) parking placards, free of charge, to Water Bugs designated person. This person can issue these six (6) passes to members of the team for parking their vehicles in the automobile parking area. These are not for launching watercraft. The Recreation Department will issue six (6) half priced boat launch stickers, for a reduced rate of $21.00/sticker, to Water Bugs designated person. These passes must be affixed to the windshield of the vehicles pulling the boats and cannot be shared among members. B. Water Bugs equipment trailer will be parked along the perimeter of the boat trailer parking area, close to the boat wash area. C. No Water Bugs equipment will be left on the premises, with the exception of the Water Bugs owned piers, or other items as approved by the Director of Public Works and Development. D. There will be no allowance of parking on any grass or park area other than the paved parking lot. All overflow parking will be directed to the parking lot in Park Arthur. 8. Contact Persons A. Contact person from Water Bugs will be the President of Water Bugs. Water Bugs will also be responsible for listing an alternate contact. Water Bugs will designate their contact person and alternate who will be Water Bugs' representatives and who will receive any correspondence. These names will be submitted to the Parks and Conservation Committee. 53 2023 Agreement— Piers Placement, Water Ski Jump, and Show Events at Idle Isle Page 5 Water Bugs Ski. Team, Inc. and City of Muskego B. Contact person from the Parks & Conservation Committee will be the Public Works and Development Director. The alternate contact person will be the Recreation Manager. If circumstances would arise not covered by the provisions contained within this Agreement, Water Bugs must contact above person(s) for a decision. 9. Inclement Weather A. If weather conditions result in a cancellation of a scheduled show/practice date, a make- up date will be considered. The make-up date must be confirmed in writing by the Director of Public Works and Development and must be rescheduled within two weeks of cancelled date. B. If cancellation is determined other than at the park (earlier in the day for example), the Director of Public Works and Development will be contacted. 10. Consequences For Not Complying With Rules A. The Parks & Conservation Committee will review summer Water Bugs use of the park at the October meeting in regard to the rules established for the Water Bugs. A monthly review (activities occurring May -August) will take place as it relates to the two unscheduled visits to Idle Isle Park by the Muskego Police Department. 1) If a substantiated non -frivolous complaint, as determined by the Muskego Police Department, is received from a citizen(s), an Alderman, Water Patrolman, Police Department, Parks & Conservation Committee Member, Director of Public Works and Development, then; 2) The Director of Public Works and Development will contact Water Bugs contact person concerning consequences by phone with a follow-up in writing. The date of the phone call will serve as the notification of denial of park use as follows; a. First Offense: Permission to use Idle Isle Park will be denied for the next two scheduled dates (practice and/or show dates). b. Second Offense: Permission to use Idle Isle Park will be denied for the next four scheduled dates (practice and/or show dates). c. Third Offense: Denial of remainder of year's schedule, and possible effect on next year's request. 11. Ski Patterns A. In regard to the ski pattern, a 100-foot clearance between boats and Otto Island, Jaycee Island, and the Idle Isle Park fishing piers must be maintained with permanent buoys, provided by the City. During Water Bugs use dates, the 100-foot clearance along the south shore of Idle Isle will be waived and Water Bugs will be allowed to make a wake inside of thirty feet from Idle Isle. However, during these same dates, the permanent buoys around Otto Island and the fishing piers, marking the 100-foot distance, can be moved closer for safety reasons, only if a smaller temporary buoy is used to mark the 100-foot clearance from that island. The permanent buoy marking Jaycee Island can be moved closer to allow boat traffic within thirty feet. To avoid boat props from hitting a temporary buoy marker and/or its anchor, no temporary buoy will be used, but following each use date, Water Buts will move the permanent buoy back to its permanent location. 54 2023 Agreement — Piers Placement, Water Ski Jump, and Show Events at Idle Isle Water Bugs Ski Team, Inc. and City of Muskego Page 6 B. Slow -no -wake buoys, located in front of Idle Isle Park, can be temporarily moved for Water Bugs use during approved practices/shows. All permanent buoys must be placed back to their original locations by Water Bugs, after each approved use. The Public Works staff will be responsible for making sure all buoys are installed before the first and removed after the last approved lake use by Water Bugs. All buoys will be installed/maintained per approved GPS coordinates (100' from Jaycee Island coordinates are LAT: 42 55'22.57172"N LONG: 88 08'37.96325"W and 1 00'from Otto Island coordinates are LAT: 42 55'23.86632"N LONG: 88 08'36.46380"W). 12. Insurance and Indemnification A. Water Bugs shall indemnify the City and hold the City harmless against and from any and all liabilities, fines, suits, claims, demands, and actions, including costs and expenses of any kind or nature, including, but not limited to, attorneys' fees brought or asserted by anyone due to or arising out of (a) any default by Water Bugs in observing any provision of this Agreement required to be observed and performed by Water Bugs, or (b) any damage to property or injury to person or persons, including death, occasioned by or resulting from Water Bugs' ski jump, piers, and signs. B. During the term of this Agreement, Water Bugs, at its expense, shall maintain comprehensive general liability coverage, bodily injury coverage, and property damage coverage, insuring Water Bugs and the City against liability for injury to persons or property occurring on or about the ski jump, piers, and/or signs or arising out of the ownership, maintenance, or use of the ski jump, piers, and/or signs. The insurance shall have a limit of not less than $1,000,000.00 per occurrence with an aggregate limit of not less than $2,000,000.00. Water Bugs shall cause the City to be named as an Additional Insured for the types and limits of coverage stated above in respect to this Agreement, and shall, upon request by the City, provide the City a Certificate of Insurance and separate written Endorsement to the policy demonstrating Water Bugs' compliance with the above insurance provisions. C. Water Bugs shall provide to City separate written Endorsements to its insurance policies that provide for the following: Naming the City as an Additional Insured. — Stating that the Insurance is Primary and Non -Contributory. — Waiver of Subrogation — Notice of Cancellation for any change in the terms or conditions of the policy. D. Failure to provide the herein named insurance with written Endorsements as stated shall result in termination of this Agreement. 13. Miscellaneous Provisions A. Other Governmental Regulations. This Agreement is subject to any and all governmental regulations as they may be amended from time to time over the term of this Agreement. If the Agreement is in conflict with said regulations, the regulations must be followed. B. Assignment. F. Captions. The captions in this Agreement are inserted only as matters of convenience and for reference and in no way define or limit the scope or intent of the various provisions, terms, or conditions hereof. G. Binding Effect. The terms and conditions of this Agreement shall be binding upon and benefit the parties hereto and their respective successors and permitted assigns. H. Entire Agreement. This writing constitutes the entire agreement between the parties hereto, and all prior statements, letters of intent, representations and offers, if any, are hereby terminated. This Agreement may be modified or amended only by written instrument signed by both parties. I. Counterparts. This Agreement may be executed in one or more counterparts, each of which will be deemed an original. J. Representations as to Authority. Each party to this Agreement represents and warrants that: a) it has the power and authority to consummate the transactions contemplated by this Agreement; b) all proceedings necessary for it to consummate the transactions contemplated by this Agreement have been duly taken in accordance with law; and c) the persons executing this Agreement on behalf of it have been duly authorized to execute this Agreement. 56 2023 Agreement — Piers Placement, Water Ski Jump, and Show Events at Idle Isle Water Bugs Ski Team, Inc. and City of Muskego Page 8 K. Dispute Resolution. In the event of a dispute between the Water Bugs and the City arising out of this Agreement and prior to formal litigation in a court of law, the Water Bugs and the City agree to attempt to resolve such dispute through mediation. In the event that the Water Bugs and the City cannot agree upon a mediator, they shall each propose a qualified mediator, and such qualified mediators shall choose a qualified third -party who will mediate the dispute. L. The parties agree that signatures scanned and sent via email attachment shall be binding on the parties hereto. M. Annual Review and Committee Approval. This Agreement is to be approved each season by the Finance Committee contingent on no changes to placement of the piers and ski jump and no additional show and practice dates being requested. If changes to placement, the changes will need to be approved by the Public Works & Safety Committee. The original approval in 2014 included certain hours with a six month review to see if there were any noise, garbage or traffic issues. Upon the re -review new hours were allowed. Due to higher sales near closing this BSO Amendment was for extended hours. Staff reached out to the Alderman and Police and there were no issues related to the hours of operation reported to the police. RESOLUTION PC 028-2023 Approval of a Building, Site and Operation Plan for a Multi - Tenant Spec Building located on the vacant lot along Janesville Road in front of Kohl's / Tax Key No. 2167.995.007. Planner Trzebiatowski provided an overview of the proposed building. The building is in the outlot in front of Kohls. The building will be just under 9,500 sq. ft. with up to five separate tenants. Allowable uses could include service retail, office, medical, financial. The Moorland Corridor South Design Guide. The building is 100 percent masonry with metal trim with a variety of cream -colored split faced block and a variety of bricks and stone. The bulk of the building will have parapet walls to screen the mechanical units. The building will also have three metal hip -roof tower features. A drive thru window is located on the north side of the building. There are 41 parking stalls included assuming 50% of the area is customer area as identified in the Code. Discussions have been occurred with the developer to see if there is any shared parking allowed. With each business registration that comes in for each user the parking will be reviewed to ensure that enough parking is available. The architect was present and Mayor Petfalski wanted to be sure the petitioner was aware of potential limitations on future tenants. The architect noted that the developer is reaching out to Kohls to see if shared parking is an option. Alderman Kubacki made a motion to approve Resolution PC 028-2023. RESOLUTION PC 030-2023 Approval of a Building, Site and Operation Plan Amendment for St. Leonard Catholic Church located at W173 S7743 Westwood Drive / Tax Key No. 2196.945. Planner Trzebiatowski explained that St. Leonard's is looking to put up a chain -link fence on the southern side of the property adjacent to the southern parking lot and playground area. When the original approval was granted back in 2001 a 5-foot solid fence was required to screen the headlights. The petitioner has noted that the fence was worn and removed roughly five years ago, so they were working with the police to figure out ways to secure the site especially for the kids during the school days as that parking lot is used for recess. The chain link was recommended by the Police Chief for visibility as well as gates installed by the walkway to the trail and in the drive area for when kids are outside. RESOLUTION PC 031-2023 Approval of a Building, Site and Operation Plan Amendment for Site Improvements at Pop's Pub on Pioneer located at W180 S7808 Pioneer Drive / Tax Key No. 2196.983. Planner Trzebiatowski provided an overview of the proposed site improvements. There are two separate crushed granite areas with one being around the tiki-bar area and another towards Kristen Drive that would be used for bags or other outdoor games. The granite area around the tiki-bar will have a few wall features and a seating feature and there will be some tree clearing along Kristen Drive being replaced with a dense row of arborvitaes to screen from Kristen Drive and the residence that is across the street. Other projects including lighting and other outdoor improvements may be coming but will be discussed at another meeting when all of the information is put together. The hours of operation will be tied to the liquor license so if Council changes the liquor license hours, the usable hours of the outdoor area will change also. Planner Trzebiatowski explained that last year the petitioner tried a community market, which was a one-year approval and now the petitioner is looking to run this market again. Last year it was a bit more inconsistent and this year the request is for every Sunday from 11:00 am to 3:00 pm through September 2023. The parking lot will be closed off and all parking will be on -street during these hours. There were no issues last year and if any issues arise this year we can bring this back to Plan Commission. Mayor Petfalski noted that on the diagram that the parking is identified, but wanted confirmation that street parking will not be designated solely for these customers. Planner Trzebiatowski said the on -street parking will not be only for market customers, but that is where customers will need to park. Additionally, the area marked as handicap parking on Pioneer Drive cannot be solely reserved for handicap parking for the market. The site has direct access to Loomis Drive and is less than 500 feet from North Cape Road, or County Trunk Highway 00. The property is immediately adjacent to planned industrial and commercial areas. The parcel to be rezoned is approximately 12.6 acres (549,825 SF) and has approximately 420 feet of Loomis Drive frontage. Immediately adjacent to the west are larger properties currently zoned RSE Suburban Estate District, B-4 Highway Business District is located to the north and east of this property and A-1 Agricultural District is east and south. 2020 Comprehensive Plan The 2020 Plan depicts the area for Commercial use. DISCUSSION PC 036-2023 Rezoning Burback Builders is petitioning for a rezoning for a property north of Loomis Road and west of Country Club Lane to amend the existing zoning of B-4 Highway Business District and RM-1 Multiple Family Residential District to a Planned Development District based on the RM-3 Multiple Family Residential District. The petitioner is requesting this rezoning in order to allow for a future cohesive development consisting of two-family condominiums built closer to Country Club Lane to preserve the woodlands and wetlands on the western side of the property. As part of the requested Planned Development District rezoning, the applicant is requesting a 30' setback, reduced from the typical 40' setback, in order to be able to preserve more of the trees within this area, and A conceptual submittal came before the Plan Commission for Iron Oaks Condominium Development earlier this year. The parcel to be rezoned is approximately 19.2 acres. With 18 units proposed the residential density would be approximately 1.1 units per acre. Immediately adjacent to the east is the PD - Planned Development District for the Cornerstone Development known as the Glen at Muskego Lakes and A-1 Agriculture District to the west where the golf course exists. 2020 Comprehensive Plan The 2020 Plan depicts the area for High Density Residential and Commercial use. Public Hearing The Council held the public hearing for this request at their Tuesday May 23, 2023 meeting. There were three people that spoke, being the Country Club Owner, a neighbor within the new development to the east and the developer of the Glen at Muskego Lakes, with concerns including: - There is a land transfer brought up that this property may be part of. City Reply: It was noted that any land transfers are being handled now by the legal teams involved, but it is not believed that any of the land transfers will impact this development and the land transfer is a private issue between the past seller and buyer. The City has no involvement in this. - Golf balls will hit the houses. City Reply: It was noted that on past housing projects adjacent to the golf course that tempered glass was required for windows facing the course. That is an inherent risk when living near a golf course. There is a culvert now that allows the pond on the golf course to flood. City Reply: Similar to all new developments, all storm water from this project will be required to be handled on -site and not pushed onto adjacent property. Stormwater features are being proposed as part of this development. If there are concerns with the storm water from the Glen at Muskego Lakes development, the property owner should contact the Engineering Department to ensure everything was developed as planned. - Concerns with road construction and how it affects business. City Reply: When future development occurs, Country Club Lane must remain passable for all employees and patrons of the golf course. Also, construction of utilities within the roadway will be for a limited period of time. - Concerns with the removal of trees, especially near the golf course. City Reply: The development pushed the buildings closer to County Club Lane specifically to try to limit the impact the this wooded area. There will be some trees removed on the side and backsides of some of the buildings but the least amount of trees necessary will be removed. The number of driveways and future parking issues. City Reply: It was noted that each unit will have two enclosed parking stalls and that if the building is set back 30 feet as proposed there would be room for four additional off-street parking stalls available for each unit, which exceeds what is required by code. Additionally, Country Club Lane was constructed to meet the City standards with the same width found throughout the City where on -street parking is allowed. If on -street parking becomes an issue at some point, this parking along Country Club Lane could be re -considered by the Public Works & Safety Committee. - The HOA restrictions of the neighboring development and would like these restrictions also applied to the Iron Oaks Development. City Reply: It was noted that the City cannot enforce or add extra HOA restrictions on new developments as the HOA regulations are private to each development with no City involvement. This could be suggested to the developer by the neighboring condo owners. The new condos should be pushed back further into the woods and a separate road be required parallel to Country Club Lane to ease the number of driveways on Country Club Lane and then a tree -lined roadway would be preserved. City Reply: The purpose of having the condos closer to the road was to preserve the large expanse of trees behind the building as a larger environmental area is more beneficial. Additionally, the reality of being able to add another road parallel during construction without damaging the tree roots will likely not be able to happen. Therefore, ensuring the larger natural area with trees will ensure the majority of the trees remain intact. A separate road in additional to 85 the already necessary grading and disturbance would destroy a much larger area of the trees, along with concerns with how close items may then get to the wetlands on site. PLAN CONSISTENCY PC 038-2023 Comprehensive Plan: The 2020 Plan depicts this area for Commercial uses. The proposal is consistent with the Plan. Zoning: The property is currently zoned B-2 Local Service Center District and IRS Suburban Residence District. The zoning being requested is BP- 45 Inpro Planned Development for all four properties. Park and Conservation Plan: No acquisitions are proposed in this area. The Parks & Conservation Plan shows a Priority #1 (High Priority) trail segment along Janesville Road. It will be recommended that the trail be extended as part of this project. Street System Plan: The proper right-of-way width will be dedicated to the City via CSM, which is a separate request. The proposal is consistent with the Plan. Adopted 208 Sanitary Sewer Public sanitary sewer serves the property. The proposal is consistent Service Area: 1with the Plan. Water Capacity Assessment The development is served by municipal water. The proposal is District: 1consistent with the Plan. DISCUSSION PC 038-2023 Rezoning As stated above, the petitioner is requesting a rezoning that will change the zoning on the property from one property from B-2 Local Service Center District and three properties from RS-2 Suburban Residence District to PD-45 Inpro Planned Development District. The parcels to be rezoned are approximately 4.46 acres (549,825 SF) and has approximately 522 feet of Janesville Road frontage. The property to the west of this area is zoned B-2 and contains a Vet Clinic and the property to the east of this area is also zoned B-2 and contains a car wash. A public hearing was heard before the Common Council on May 23, 2023 and there were a couple comments. One comment/question was whether there will be a large commercial building in this location. The second comment was pertaining to the traffic on Janesville Road. Building, Site and Operation Plan (BSO) As previously stated, Inpro is seeking approvals for a phased redevelopment of four properties along Janesville Road. These properties are also proposed to be combined via CSM, which is a separate proposal. The redevelopment will occur in two separate phases. The first phase of the redevelopment includes a new parking lot on the southern end of the properties away from Janesville Road. The second phase is constructing a new office building closer to Janesville Road. This petition is for the first phase of the project while the second phase is anticipated in 2024-2025 and will require a separate BSO Amendment. For the first phase, the vacant home at S79 W 18997 Janesville Road will be razed to allow for the new access drive to be constructed. This will be the access point for the new parking lot and the future office building. The other two houses and the commercial building will remain at this time. The new parking lot will consist of 140 parking stalls. With two-way traffic all drive aisles must be a minimum of 24 feet in width and the parking stalls 9' x 18' minimum. These dimensions will be confirmed upon a review for a Zoning Permit. The General Design Guide that applies to the entire City requires a landscape island every ten stalls to break up long stretches of parking stalls. The proposed outer rows of parking include 25 stalls with the inner rows of parking being 21 stalls per side. A landscape island must be included to break up each row of parking to abide by the General Design Guide. The Resolution is drafted as such. Vertical face concrete curb and gutter is typically required for all new or reconstructed parking areas and drive aisles. This curb and gutter are illustrated on the plans along the southern, western and eastern edges of the parking lot as well as around the two landscaping islands. Excluding the concrete curb and gutter along the long drive aisle and the western portion of the site is reasonable as these areas will be removed for the egress drive and parking area expansion during the second phase of this project. Any areas on the eastern portion of the parking lot that will not be expanded or impacted with the future construction of phase two must include the concrete curb and gutter during the first phase. Additionally, the entire entry drive and parking lot must be retrofit with concrete curb and gutter if phase two of the project has not begun the approval process with a BSO amendment process by the end of 2025. Stormwater management facilities will be required with the development of the first phase including the large impervious parking lot and egress drive. Although not shown on the plan the stormwater facilities will be located in the eastern area of the property. City Engineering will be reviewing all of the storm water plans for compliance. As noted above, the Parks & Conservation Plan shows a Priority #1 (High Priority) trail segment along Janesville Road. This trail is shown on the site plan as a Future Public Walk. The existing Janesville Road trail is stubbed to a group of five properties, with this proposal accounting for four of the five properties. As part of the approval for this Building, Site and Operation Plan, staff recommends the trail be installed by the petitioner during the first phase of this redevelopment project and is included in the Resolution. A rezoning application was previously submitted to bring them all under the InPro Corporation Planned Development (InPro PD). A new CSM has also been submitted to combine all four lots into one new lot. The current plan for future development includes several phases: 1. Phase 1 (2023) — construct a new approx. 140 stall parking lot across the south end of these four lots. 2. Phase 2 (2024-2025) — construct a new office building on the lots on Janesville Road with additional parking. The homes on the two lots to the east are currently leased out with leases expiring in September 2024. The vacant home at S79W18997 Janesville Road is ready for demolition as a part of Phase 1 upon approval of the plan by the Plan Commission (targeting June 6) and of the CSM & Rezoning by the Common Council (targeting June 13). The business at S80W19025 Janesville Road has a lease on this property until Spring 2024, after which it is expected that this building would be demolished as well to make room for a new entrance drive and additional parking.
