5.11 BICYCLE CONTROL
(1) GENERAL POLICY STATEMENT:
Bicycle Control 5.11
The intent of this program will be to provide a climate of
safe bicycle operation in the City of Muskego through education,
inspection, and enforcement.
(2) RATIONALE:
The City of Muskego is experiencing an increase in bicycle
riders. Bicycle Traffic violations have resulted in serious acci-
dents causing injuries to the bicycle operators. A decrease in
bicycle registrations has made enforcement and the investigation
of bicycle thefts difficult for the police department. The lack of
proper equipment and mechanically safe bicycles contribute to a
hazardous climate of bicycle operation. An affirmative action
bicycle program will give the police officer more definite guide-
lines and control to fulfill his responsibility in this area.
(3) PROCEDURAL DIRECTIVES AND RESPONSIBILITIES:
(a) Moving Traffic Violations - Citations should be issued
for moving violations to subjects 16 and older. If subject is
under 18 years of age, parents will be notified by the arresting
officer and a Juvenile Report will be filed with Juvenile Officers.
(b) Moving violations by subjects under 16 years of age- will
require a Juvenile Report. Parents will be notified of the
violation and informed of date and time the juvenile subject and
one or both parents are to appear at the department for a safety
program. Failure to appear or second violation would cause
revocation of subject's registration plate (City Ord. 7.18(6)).
Third violation results in referral to Juvenile Court.

(c) Equipment
Violations - 5-day
warnings for
equipment will
not
require
a Juvenile Report, however,
parents will
be notified by
the
officer. Date and time of the notification will be entered on the
department's copy of the 5-day. Also check paragraph 4 under this
section.
of (d) Non -Compliance Citations for Equipment - covered by State
Statues, will be issued to the driver if 16 years of age or older.
For subjects under 16 years of age the Non -Compliance Citation will
be issued to the parents (55346.77).
(e) Non -Compliance of 5-day warnings for registration - violations
involving juveniles will require a Juvenile Report, parents notified,
and a citation issued to parents under M.C. 7.18.
(f) Non -Compliance Citations for Equipment - will only be issued
for equipment violations covered in State Statues. However, the
department may still refuse or revoke the registration for violations
that would cause the bike to be unsafe for operation.
(g) Safety Inspection for Registration - prior to receiving a
registration all bicycles will be required to pass a safety check.
Inspections will be made according to prescribed check list at
designated locations or at the police station on specified dates and
times. If bicycle fails the the inspection, registration will be with-
held until corrections are made.
(h) Safety Programs - it will be the responsibility of the Juvenile
Officer to promote an affirmative action safety program with the Muskego
School System. The use of department bicycle safety material will be
made available to the schools and other interested groups upon request.
