RLO19940804• RULES, LAWS 6 ORDINANCE COMMITTEE - CITY OF MUSREGO MINUTES OF MEETING HELD THURSDAY, AUGUST 4, 1994 The meeting was called to order at 7:07 P.M. by Chairman Taube. Also present were Committee Members Woodard and Misko, Police Chief Johnson and Mr. Richard Schaumberg. Mr. Schaumberg appeared before the Committee to express his concerns about proposed amendments to Liquor License ordinance. He feels that if you own a liquor license for an existing business, the City should not be so quick to pull licenses. The Committee reviewed Attorney Molter's correspondence of July 20, 1994 and agreed that the second paragraph should not be adopted as it is in conflict with the first and that the first paragraph should be amended as follows: Any license issued pursuant to the general ordinances for this community shall be subject to such further regulation and restriction as may be imposed by the governing body, or any committee thereof, of the municipality by amendment to this section or by the enactment of a new ordinance. Further, the governing body of the municipality is • specifically authorized to impose reasonable conditions upon any alcohol beverage license. If any licensee shall fail or neglect to meet the requirements imposed by such restrictions and regulations or the conditions imposed by the municipality, his or her license may be revoked, not renewed, suspended or cancelled in accordance with this section. In the case of revocation, non -renewal, suspension or cancellation of any license for any violation of any provision of this ordinance in accordance with section or by the Court or for any reasonable cause no refund shall be made of any part of the license fee. If a license issued hereunder is not used within 365 days after its issuance or its usage is discontinued for a period of 90 days or remainder of license period, whichever is greater, such situation may be grounds for cancellation, suspension, revocation or non -renewal of the license in accordance with the provisions of this section and the laws of Wisconsin. The Committee requests that the City Attorney draft language to incorporate the following in the proposed amendment: 1. If an owner decides to terminate his business in one • location and relocate to another, no license review is necessary. • Rules, Laws & Ordinance Committee - Page 2 August 4, 1994 2. A license cannot be sold or transferred to another person at another location, that license will revert back to the City. 3. Require licensee to surrender his license if type of use changes to a non -licensed business. 4. Language for new establishment with no existing license; license can be reserved/granted, but not issued until Building, Site & Operation plan is approved within one (1) year of granting of license and construction to start within one (1) year of the approval of the Building, Site & Operation Plan. (The Committee's intent is to eliminate the need for a Hearing if the owner of the establishment defaults on the above conditions.) The Committee discussed Composting and took no action at this time.
