RLO19930708RULES, LAWS AND ORDINANCE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD THURSDAY, JULY 8, 1993 • The meeting was called to Taube. Also present were Mayor De Angelis, Lt. John the attached list. 11 • order at 7:08 P.M. by Chairman Committee Members Misko and Woodard, Daly, Ald. Patterson and those per The Committee discussed proposed amendment to Chapter 13.01 as outlined in Chief Johnson's memorandum of June 1, 1993, which list the revisions to the Dog Ordinance eliminating the $100,000 insurance provision and an amendment to Dog Bite suggested by the Municipal Judge. Ald. Misko moved to recommend approval of the proposed amendments with the following additional revisions: Chapter 13, Section 13.01 (20) "Change the word 'No' to 'A'". Seconded by Ald. Woodard, motion carried. The Committee reviewed proposed amendment to Chapter 12, Section 12.08(6)(d) Enclosure of Junk or Salvage Yards that was referred by the Finance Committee. The Finance Committee has proposed to amend the ordinance requiring a fence "to allow a suitable alternative such as a berm or permanent coniferous vegetative buffer". The Committee requests that Attorney Molter prepare an ordinance which would "grandfather in" existing salvage yards from having to have fencing until lack of fencing presents a safety issue; and that all new establishments would require either fencing, or suitable coverage in the form of a berm of coniferous trees or combination thereof, trees being not less than four (4) feet in height. Lt. Daley appeared before the Committee to discuss proposed provisions to Chapter 9, Orderly Conduct. Chapter 9 of the Muskego Municipal Code deals with public peace and good order. Many of these ordinances prohibit conduct that is also prohibited by State Statutes. When the City originally adopted State Statute Chapters 939 through 947 there was an unintended duplication of various ordinances. Having dual ordinances that address the same behavior can result in unfair or inconsistent treatment of offenders. Ald. Misko moved to recommend adoption of the above amendments, with the remaining ordinances to be renumbered to reflect a proper sequential order. Seconded by Ald. Woodard, motion carried. The Committee discussed proposed amendment to Charter Ordinances for Elected Officials to lengthen terms for City Clerk, Assessor, Treasurer and Judge.
