RLO19911212RULES, LAWS & ORDINANCE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD DECEMBER 12, 1991 T� The meeting was called to order at 8:40 P.M. by Chairman Harold L. Sanders. Also present were Committee Members Dave Taube and Patrick A. Patterson, Mayor Salentine and Sgt. Geiszler from the Muskego Police Department. The Committee further discussed a revised Ethics Code for the City. Ald. Patterson moved to adopt City Attorney's suggested language as follows: "If the City receives a complaint concerning any municipal candidate's conduct concerning a municipal election, the City shall upon receipt forward said complaint to the proper legal authorities for investigation; that if the investigations determine that there may be an election law violation, the legal authorities shall forward said complaint and the results of the investigation to the Waukesha County District Attorney and to the State of Wisconsin Election Board". Seconded by Ald. D. Taube, motion carried. The Committee requests that the City Clerk send a letter to all candidates for the upcoming election to advise of Committee's intent to change Code • of Ethics. Chairman Harold Sanders will review the Code of Ethics of the surveyed communities and the Committee will further review the comparisons at their January meeting. The Committee discussed current ordinances on blockage of solar panels/dishes and request that the Building Inspection Director submit recommendation to the Committee on how to protect established solar panels from blockage caused by new construction. The Committee will discuss proposed Animal Litter Ordinance at the January 9th meeting. The Committee further reviewed present Transient Merchant, Peddler & Canvasser Ordinance and determined that no changes need to be made. No new information had been received on the potbellied pigs so the Committee deferred until the January meeting. The Committee reviewed proposed amendment to Chapter 7, Section 7.06, which is a revision to the weight limit ordinance. This proposed amendment clarifies the existing ordinance and puts us into compliance with the State law regarding the placement of weight limits on our roads. Ald. Taube moved to recommend approval of proposed ordinance. Seconded by Ald. Patterson, • motion carried. Upon passage of this revision, the Department of Public Works will block out the words "Class B Highways" from all the signs posted at the entrances to the City. Rules, Laws & Ordinance - Page 2 December 12, 1991 Correspondence from Building Inspection Director was reviewed recommending creation of Section 16.205 - Disturbance of Field Drain Tiles in the municipal code as follows: (1) Whenever excavation disturbs an existing underground field tile, the tile shall be reconnected in a manner judged by the Building Inspector or the Public Works Department to be satisfactory. (2) Whenever excavation for a structure disturbs an existing underground field tile, the tile shall be rerouted in a manner so as not to be nearer than fifteen (15) feet at any point to the proposed structure. Inspection by the Building Inspector or the Public Works Department is required before backfilling. Ald. Dave Sanders moved to approve above amendment. Seconded by Ald. Patterson, motion carried.
