MINUTES OF MEETING HELD DECEMBER 6, 1990
The meeting was called to order at 8:05 P.M. by Chairman H.
Sanders. Also present were Committee Members Taube and Patterson
and Chief Johnson.
The Committee further reviewed the regulations on Fire Works and
determined that the information attached supports new fee
schedule.
The Committee deferred further discussion on proposed amendments
to Loitering Ordinance.
The Committee reviewed request to amend Section 32.02 of the
Municipal Code -Sprinkler Ordinance and referred the matter back
to the Public Safety Committee to address at their January
meeting.
The meeting adjourned at 8:10 P.M.

INSPECTION OF FIREWORKS STANDS
The procedure is to check the stands three times from the time they open until July
4th. Sgt. Budish inspects for legal operations, permits, fire equipment and storage
procedures; at least one undercover buy is attempted at each stand; and a third
inspection by a plain clothes officer is then performed. This procedure involves an
estimated five man hours of time.
If a complaint of illegal sales is received from a citizen or we are made aware of
same, the procedure is that undercover buys are attempted. If successful, we
proceed to secure evidence for criminal prosecution. The following is an actual
case scenario from June 1990 with man hours expended.
Two fireworks stands, operated by the same corporation, were
inspected by Sgt. Budish and found to be selling Class C permit
required fireworks to individuals who did not hold valid permits.

approximately 5 hours.

Miscellaneous contacts with the District Attorney's office,
the defendants, the defendants' attorney, the purveyor of
fireworks.

Due to the lawsuit, the Mayor and one lieutenant attended the
hearing for the return of the fireworks. 8 man hours

This case was settled out of court, otherwise, with motion hearings, suppression
hearings, preliminary trial and the trial, the anticipated man hours for six
officers would be an additional 100+ hours.
