RLO19890726RULES, LAWS & ORDINANCE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD JULY 26, 1989 The meeting was called to order at 7:10 P.M. by Chairman Patterson. Also present were Committee Members Simmons and Taube, Director and Land Use Administrator G. P. Lee, Police Chief Johnson and those per the attached list. The Committee reviewed with Police Chief Johnson his memorandum of July 21, 1989, recommending that the City adopt the State Industry, Labor and Human Relations Chapter 14, Open Burning, and retain the following sections of our current Chapter 9.22, Open Fires: 9.22(2) (Location of Burning Prohibited), 9.22(14)(2), Wind Direction, 9.22(4) (Emergencies). Chief Johnson indicated that, after conferring with Attorney John Macy, it was determined that the law is clear in that permits should be issued after approval of the Fire Chief. Chief Johnson felt that it may be possible to appoint a designee who would be able to sign the permit in lieu of the Fire Chief. This person should be knowledgable of the laws and would sign the permits after reviewing the applications. Ald. Simmons moved to defer in order to question Attorney Molter if it is possible when a permit is being applied for, to give to the applicant the state regulations, have the applicant read and sign a prepared statement that he has read and will abide by said regulations, and would this sufficiently cover the DIHLR regulations regarding permits issued by Fire Chiefs. Also, would any liability be passed on to the Fire Chief as they would not be personally signing off on the permit. Seconded by Ald. Taube, motion carried. Muskego Volunteer Fire Company Fire Chief Lloyd Pickart and Tess Corners Volunteer Fire Department Fire Chief Phil Dibb appeared before the Committee to discuss the Sprinkler Ordinance. Fire Chief Dibbs suggested splitting I into A & B; A with common entrance and B with individual entrance. Ald. Simmons moved to defer in order for proposed amendment to be clarified to state that the sprinkler ordinance does not apply to 1 and 2 family buildings. Seconded by Ald. Taube, motion carried. The Committee reviewed memorandum from City Clerk Jean Marenda dated June 16, 1989, regarding inspection of gun clubs. The Committee determined that there will be no change to current procedure and are not recommending amending Chapter 9.01. The Committee further discussed Chapter 17, OD Duplex District regarding 15% Variance Control granted to the Plan Commission and determined that there would be no need to change text as final control stays with the Common Council. Rules, Laws & Ordinance Committee - Page 2 July 26, 1989 The Committee reviewed the proposed ordinance to amend Chapter 17, Section 17 2.02(74) and Section 17: 3.08(1) of the Municipal Code. Ald. Taube moved to recommend approval excluding Plan Commission from Section 2. The Committee deferred discussion on Roberts Rules of Order until the September meeting. The meeting adjourned at 8:30 P.M.
