RLO19890608' RULES, LAWS & ORDINANCE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD THURSDAY, JUNE 8, 1989 The meeting was called to order at 8:25 P.M. by Chairman Patterson. Also in attendance were Committee Members Simmons and Taube, Ald. D. Sanders, Police Chief Johnson, Mayor Salentine, Treasurer Sandes and Mr. Harold DeBack. The Committee discussed proposed Ordinance #646, Restricting Overnight Parking on City Streets, and recommended the following amendment to 7.05(2)(a): No overnight parking of cars from 3:00 A.M. to 7:00 A.M. between December 1, and April 1, without Police Department approval. Trucks weighing 10,000 lbs and over are not allowed to park between the hours of 3:00 A.M. and 7:00 A.M. The Committee reviewed proposed amendment to Chapter 12, Section 12.03, Transient Merchant with Police Chief Johnson. Ald. Taube moved to recommend the following amendment: 12.03(1)(a) The applicant who is the prospective licensee must obtain a license in its own name providing a bond as provided in subsection (8) herein. The prospective licensee must further obtain a permit for each individual person peddling, soliciting, canvassing or going from place to place soliciting orders. The permit must identify the name, permanent address, social security number, date of birth, and driver's license of each permittee and such other information as the Chief of Police may from time to time require. The prospective licensee and each person peddling, soliciting or canvassing under the licensee is required to remit fees as set forth in section 7. 12.03(7)(c): Change from a $25.00 investigative fee to a $10.00 investigative fee. 12.03(7)(d): Eliminate the words "or working for a transient merchant". Seconded by Ald. Simmons, motion carried. The Committee reviewed proposed Ordinance #654 with Treasurer Sanders and recommended approval with the three -payment plan • dates to be January 31, April 30 and July 31. Rules, Laws & Ordinance Committee - Page 2 June 8, 1989 The Committee reviewed correspondence from Attorney John Macy dated April 24, 1989, regarding Jurisdiction of Zoning Board of Appeals. The Committee requests that the City Attorney review the present ordinance and draft the necessary language to insure that Common Council action can not be subject to Board of Appeal review. The Committee discussed amendment to Zoning Ordinance, Section 9.09(1) (00 Duplex District) (lot size) which would grant the Plan Commission authority to grant a 15% reduction in cases where existing buildings are already on a lot. Ald. Simmons moved to recommend amendment. Seconded by Ald. Patterson, motion carried with Ald. Taube casting the only dissenting vote. The Committee requests that this item be put on the July agenda to discuss whether the 15% control should remain with the Plan Commission or the Common Council.
