RLO19890403• RULES, LAWS & ORDINANCE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD APRIL 3, 1989 The meeting was called to order by Chairman Hilt at 8:00 P.M. Also present were Committee Members Patterson and Repischak, Chief Johnson and those per the attached list. The Committee reviewed proposed amendment to Chapter 7 of the Municipal Code which would create Section 7.05(2) to Restrict Overnight Parking on City Streets in the City of Muskego with Chief Johnson. Ald. Repischak moved to recommend approval. Seconded by Ald. Hilt, motion carried 2-1 with Ald. Patterson casting the dissenting vote. Proposed Transient Merchant Ordinance changes were reviewed by the Committee and representatives from Parkland Mall. Ald. Patterson moved'to recommend approval. Seconded by Ald. Hilt, motion carried. The Committee is requesting that the City Attorney define Section 12.03(e) of the proposed ordinance referring to "an enclosed area". Chief Johnson advised the Committee that he is awaiting information from Attorney Macy in regard to the proposed • ordinance on Chapter 4, Section 4.06, Compensation and Working Laws. Ald. Patterson moved to recommend approval of amendment to Forfeiture Schedule for an addition to Chapter 9 involving cigarettes and tobacco products as adopted by Ordinance 640 as follows: 9-48.983 Purchase or attempted purchase of $25.00 cigarettes or tobacco products 9-134.66 Sale of cigarettes or tobacco $50.00 products Seconded by Ald. Repischak, motion carried. The Committee reviewed correspondence from City Clerk Marenda regarding DNR ruling that the DNR has advised that the City will need to adopt an ordinance listing all locations where we have slow no -wake waterway markers placed. Ald. Patterson moved to recommend Council approval or proposed ordinance. Seconded by Ald. Repischak, motion carried. Correspondence from Municipal Judge Peter D. Lentz, dated March 15, 1989, was reviewed wherein Judge Lentz is recommending that . the City of Muskego's standard bail/forfeiture amount for operating after license is revoked or suspended (Section 343.440) of the Wisconsin Statutues) be increased to a base penalty of $200, plus $40 penalty assessment, $15 court costs, • Rules, Laws & Ordinance Committee - Page 2 April 3, 1989 and $10 jail assessment.
