RULES, LAWS & ORDINANCE COMMITTEE - CITY OF MUSKEGO
MINUTES OF MEETING HELD FEBRUARY 6, 1989
The meeting was called to order at 8:00 P.M. by Chairman Hilt.
Also present were Committee Member Patterson and Police Chief
Johnson.
The Committee reviewed correspondence from Chief Johnson dated
December 19, 1988, and Attorney Molter dated November 28, 1988,
regarding the hours of soliciting as stated in Chapter 12,
Section 12.03(12) 1. and 12.03(12) 2. of the City of Muskego's
Municipal Code regulating Peddlers, Canvassers and Transient
Merchants. Ald. Patterson moved to recommend amending Chapter
12, Section 12.03(12) 1. and 12.03(12) 2. of the Municipal Code
to restrict the hours of operation from 9:00 P.M. to 9:00 A.M.
Seconded by Ald. Hilt, motion carried. Ald. Patterson moved to
recommend amending Chapter 12, Section 12.03(3) to add (1) Any
community organization may petition to the Finance Committee to
waive the fees for annual Community sponsored events. Seconded
by Ald. Hilt, motion carried.
The Committee also discussed the Police Chief's concern as to
whether or not Section 12.03(2)(c) of the Municipal Code
regulating Peddlers, Cavassers and Transient Mechants applies to
the Flea Market in the old Pick & Save building. The Committee J
determined that the above regulations do apply to the displayers l
at the Flea Market and these exhibitors must be licensed by the
City. Chief Johnson will contact the operator of the Flea Markets
and advise of the need for all exhibitors to secure licenses from,
\the City.
The Committee reviewed correspondence from Chief Johnson
regarding correction of the forfeiture schedule in regard to
Chapter 26 - Parks and Recreation Regulations. A suggested fee
of $25.00 was recommended by Municipal Judge Lentz for
restrictions to animals in parks (to be regulated under 26.02).
Ald. Patterson moved to amend the forfeiture schedule to change
26.01 to read 26.02 and to refer all fees for Chapter 26 to the
Parks & Recreation Board for their review and recommendation.
Seconded by Ald. Hilt, motion carried. After the Parks &
Recreation Board has reviewed, the fees will be sent to the
Finance Committee for their final review before Council action.
The Committee determined that all amendments to the Forfeiture
Schedule will be sent directly to the Finance Committee, with the
Judge's recommendation, for review and recommendation to Council.
Correspondence from Attorney Macy regarding amendments to reflect
new gambling laws dated January 20, 1989, was reviewed. Ald.
Patterson moved to recommend Council adoption of the proposed
ordinance. Seconded by Ald. Hilt, motion carried.

Chief Johnson discussed with the Committee his correspondence
dated December 19, 1988, wherein he advises the Committee that
both the Police Department and the Department of Public Works
feel the time has come for Muskego to join virtually all of our
neighboring communities to limit street parking. He felt that
this is due to the number of vehicles parked on our streets which
make it difficult to determine the abandoned vehicles, safety
factors (especially in neigborhoods), the increasing semi-
trailers parked along our roadways and the increasing difficulty
in the speedy clearing of our streets after a snowfall• Chief
Johnson requested the Committee to direct the City Attorney to
develop a parking ordinance prohibiting any parking on city
street between 2:00 A.M. and 6:00 A.M. without Special Permit.
The Special Permit would be issued by the Police Department by
phone for special temporary situations that may arise for our
citizens. The Committee directed the Clerk's Office to notify
the official newspaper and request that an article be put in the
paper alerting citizens that the Rules, Laws & Ordinance
Committee will be reviewing overnight parking and welcome any
citizen input.
The Committee reviewed the correspondence from Chief Johnson
• requesting that the City adopt State Statutes 48.983 - No child
may purchase or attempt to purchase cigarettes and tobacco
products prohibited, 134.66 - Restrictions on sales or gifts of
cigarettes or tobacco products, and 778.25 - Citation procedure;
certain alcohol beverages, tobacco, harassment and safety
violations. Ald. Patterson moved to direct the City Attorney to
draft an ordinance amending Chapter 9 of the Municipal Code to
adopt the above statutes. Seconded by Ald. Hilt, motion carried.
The Committee further reviewed procedure for election of Council
President, Plan Commission Representative and Committee
Appointments. Ald. Patterson moved to stay with existing
procedure of requiring a majority vote for the election of
Council President and a two-thirds vote for the election of the
Plan Commission Representatiavq', with the exception that in the
case of a deadlock, all voting will go to hand or voice vote.
Seconded by Ald. Hilt, motion carried.
