RLO19850725RULES, LAWS, ORDINANCE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD JULY 25, 1985 The meeting was called to order by Chairman Dumke at 7:30 P.M. Also present were Committee Members Nilsson and Taube, Ald. Hilt, Police Chief Johnson and Lt. John Daley. The Committee discussed Special Permit fee for Dance Hall license. Ald. Taube moved to direct the City Attorney to amend Chapter 12, Section 12.04 4(d) and 5(d) of the Municipal Code to state that the $10.00 permit fee will include all events listed on the application. Seconded by Ald. Nilsson, motion carried. A discussion was held regarding formation of a Committee of Lake Aldermen to discuss "Slow -No Wake" ordinance. Ald. Taube is requesting that the three "lake" aldermen (Tomczyk, Hilt and Taube) form a committee to discuss the present ordinance. Mr. Fitzgerald appeared before the Committee and presented a list of suggestions for the Committee to consider. Ald. Taube moved to ask Ald. Tomczyk, Ald. Hilt and Ald. Taube to form such a committee. Seconded by Ald. Nilsson, motion carried. • Ald. Nilsson discussed what he considers to be a continuing problem with fireworks in Muskego. Chief Johnson discussed the fact that the City currently issues permits for individuals who request them. Approximately fifteen permits have been issued this year. Concerns discussed included possible liability for the City when issuing a permit, lack of control over the individual who is issued the permit, the fact that the Fire Departments are not being notified when these permits are issued. The Police Chief stated that he feels that any permits issued should only be issued to groups such as civic organizations, etc. Ald. Nilsson moved to have the City Attorney review possible City liability when issuing Fireworks permits. Seconded by Ald. Taube, motion carried. Lt. Daley expalined the continuing problem the Police Department is having regarding complaints of harassment. The Police Department is requesting that the City adopt State Statute 947.012 which pertains to unlawful use of telephone, and 947.013 pertaining to harassment, in order to be more effective in protecting citizens from those who engage in such conduct. Ald. Nilsson moved that the City Attorney study recommendation and draft an ordinance amending Chapter 9 of the Municipal Code to include these State Statutes. Seconded by Ald. Taube, motion carried. This ordinance will be reviewed by the Rules, Laws & Ordinance Committee at their meeting scheduled for Thursday, • August 15, 1985. `J Rules, Laws & Ordinance - Page 2 July 25, 1985 The Police Department also discussed a suggested change in Chapter 12 of the Municipal Code to bring it into compliance with State Statute 125.07(4). Presently the City's ordinance does not prohibit the consumption of beer by underage persons and states minors rather than underage persons. This amendment would make it illegal for underage persons to purchase, attempt to purchase, possess, or consume any alcoholic beverages. The only exception to the ordinance would be that fermented malt beverages could be possessed or consumed by an underage person who is accompanied by his or her parent, guardian or spouse who has attained the legal drinking age. Ald. Taube moved to recommend that the City Attorney review and draft revised ordinance to conform to State Statutes and send directly to Council. Seconded by Ald. Nilsson, motion carried.
