RLO19850613• RULES, LAWS, ORDINANCE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD JUNE 13, 1985 The meeting was called to order by Chairman Dumke at 8:08 P.M. Also present were Committee Members Taube and Nilsson, Police Chief Johnson, Mrs. Stella Dunahee and Mr. Joseph Seifert. The Committee discussed the proposed False Alarm Ordinance and Attorney Molter's letter of June 5, 1985. Mr. Joseph Seifert appeared before the Committee stating problems that the Historical Society is currently having with their alarm systems. This will be addressed when the lease between the Historical Society and the City is prepared. Ald. Nilsson moved to recommend Council adoption of the proposed False Alarm Ordinance. Seconded by Ald. Dumke, motion carried. The Committee reviewed Chapter 12 - Liquor License with Police Chief Johnson. The following was clarified through correspondence with City Attorney Molter: 1. Waitresses of the City of Muskego do not have to be licensed, however they must be 18 years of age in order to serve any alcoholic beverage. An employee not • serving alcoholic beverages must be at least 16 years of age. Immediate family members of license holders may work in non -serving jobs at 14 years of age. 2. Section 12.01 (4) (d) delete reference to " 20% Rule". Ald. Dumke moved to recommend that Attorney Molter review the current Ordinance 12.01, amend and clarify (4) (c) and (4) (d), and draft an ordinance to incorporate the above, with "dispensing" of alcoholic beverages to be limited to licensed operators, but allowing the "serving" by 18 year old un-licensed persons. Seconded by Ald. Taube, motion carried. The Committee reviewed the minutes of the previous meeting and placed on file. The Committee discussed the City's responsibility to enforce Deed Restrictions. The Committee feels that the City should not attempt to enforce any Subidivision or Homeowner's restrictive covenants. The Committee reviewed area being notified in regard to 2nd Garage Structures as outlined in the Zoning Ordinance, Chapter 17:4.05(2)C(1), which states that notice is to be given to the adjoining property owners that a request for a 2nd garage structure has been received. Chief Johnson indicated that he has created a policy where if an officer finds a situation where descretion would be appropriate, that officer would consult with his superior officer.
