RLO19850422• RULES, LAWS, ORDINANCE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD APRIL 22, 1985 The meeting was called to order by Chairman Dumke at 7:00 P.M. Also present were Committee Member Taube, Ald. Penovich, Mayor Salentine and Acting Police Chief John Johnson. Ald. Nilsson was absent. The Committee discussed the proposed False Alarm Ordinance. The Chamber of Commerce and Scott Krause submitted written modifications to the proposed ordinance. After lengthy discussion, Chapter 12, Section 12.18(1) INTENT was questioned by the Chamber of Commerce regarding the harshness of the wording. The Committee recommended that the City Attorney review the last sentence of this paragraph to determine whether it is necessary. Ald. Dumke moved to recommend the City Attorney include the following in the proposed ordinance: Amend the proposed ordinance to state that all existing alarm systems require a permit but will not be subject to the fee. Section (9) APPEAL PROVISIONS be changed to read "as provided in Chapter 27" instead of Chapter 2, subject to the • Common Council adopting Chapter 27, Administrative Review. Section (10) PENALTIES, second paragraph, be revised to read: 1 - 3 false alarms - No cost 4 - 6 false alarms - $20.00 plus court costs 7 - 9 false alarms - $50.00 plus court costs 10-12 false alarms - $100.00 plus court costs 13 or more false alarms - $200.00 plus court costs Include in the proposed ordinance False Fire Alarms. Seconded by Ald. Taube, motion carried. Mrs. Sharon Erdman, President of the Historical Society, appeared before the Committee stating that the City owns the property and building that houses the Historical Society exhibits and, therefore, she felt that the Historical Society should be exempt from the false alarm ordinance. After some discussion it was decided that the upcoming lease with the Historical Society should address this issue. The Committee discussed a proposed amendment to Chapter 12 - Liquor License. Acting Chief of Police Johnson explained the • problem with the current ordinance and the Committee recommended that he confer with the City Attorney and prepare a proposed ordinance to be presented at the next meeting. • Rules, Laws & Ordinance - Page 2 April 22, 1985 The Committee reviewed proposed Ordinance creating Chapter 27, Administrative Review. Ald. Dumke moved to recommend Council adoption of Ordinance 524. Seconded by Ald. Taube, motion carried. The Committee discussed the burning ordinance with Ald. Penovich. It was recommended that the local newspaper be requested to write a public service article in the Fall reminding people of the requirements for burning. The Police Department took note of the burning problem in the ditches and will increase warnings to citizens. The Committee reviewed the minutes of the previous meeting.
