RLO19840910RULES, LAWS, ORDINANCE COMMITTEE — CITY OF MUSKEGO MINUTES OF MEETING HELD SEPTEMBER 10, 1984 • The meeting was called to order at 7:00 P.M. by Chairman Dumke. Also present were Committee Members Gaetzke and Nilsson, Ald. DeAngelis, Ald. Hilt, Police Chief Scholz and those persons per the attached list. The Committee discussed the proposed policy on hiring relatives with Chief Scholz. Ald. Gaetzke moved to recommend that the policy be adopted as originally proposed. Seconded by Ald. Nilsson, motion carried. The Committee reviewed Hours of Operation of Rifle Ranges and Trap Ranges. The Committee discussed a reduction in hours of operation with the owners of various rifle and trap ranges and with people who were in attendance. Mr. Richard Bennett of Boxhorn Gun Club stated that he earns the majority of his income during a 20 week period (May 1 thru Sept. 1) primarily during the hours of 7:00 P.M. — 10:00 P.M. He stated that any reduction in his evening hours would seriously affect his income. He further stated that he purchased this business, which has been in operation since 1928, knowing what the city's ordinances were concerning gun clubs. Several citizens complained that they felt they should not be subjected to the noise of these gun clubs and felt that the hours should be reduced to either a 9:00 P.M. or 9:30 P.M. closing. Mr. Bennett referred to Wisconsin Statute 182.021 which states that once operating and improved, gun clubs • cannot be restrained as to its exercises at the place so selected on complaint of any private individuals or parties. He further stated that, if necessary, he would seek relief in the courts. Ald. Gaetzke stated that he felt there should be room for compromise. Ald. Nilsson moved to direct the City Attorney to draft an ordinance to amend Chapter 9.02 (c) of the Municipal Code, Hours of Operation, to read 10:00 A.M. to 10:00 P.M. Seconded by Ald. Gaetzke, motion carried. The Committee recommends that all license holders be notified of proposed changes. The Committee discussed proposed changes to Permit Fees for the Building Inspection Department. Ald. Gaetzke moved to increase the minimum Plumbing fee to $15.00. Seconded by Ald. Nilsson, motion carried. Ald. Gaetzke moved to increase the minimum electrical fee from $6.00 to $15.00. Seconded by Ald. Nilsson, motion carried. The Committee discussed the request for a Fancier's Permit. Mr. and Mrs. Waite appeared before the Committee and presented copies of the City of Milwaukee ordinance, Chapter 78, which specifically authorizes, under supervised conditions, keeping more than two dogs in any area. Mr. and Mrs. Waite request that the City of Muskego consider adopting a similar ordinance. Ald. Aid. Gaetzke moved to direct the City Attorney to draft an ordinance to amend the Municipal Code as follows: 12.04(4)(d) "S�ecial Permit" License A "Special Permit" License may be granted o hold not more than one public dance in any structure or premises, Such "Special Permit" license shall be subject to all other provisions of this section. This change would delete the words "not licensed under either 'A' or 'B'. Seconded by Aid. Nilsson, motion carried. The Committee discussed the Time Limit on Licenses. Aid. Gaetzke moved to direct the City Attorney to draft an ordinance to amend Chapter 12.01 of the Municipa Code to require that all license applications must be accompanied by fee at the time of application. Seconded by Aid. Nilsson, motion carried. The Committee reviewed the minutes of the previous meeting. The Committee reviewed Attorney Molter's letter dated September 6, 1984, regarding the Transient Merchant Ordinance and requested that the matter be placed on the October agenda. PURPOSE Employment of relatives of current City employees or elected officials is not in the best interest of the City. it may muse serious problems for managment ranging from pressure to hire, to morale problems in discipline and other possible conflicts of interest. The policy restricting the employment of relatives is based on the principle of achieving a more efficient operation and with reference to equal opportunity, affirmative action, and the ethics!cdde. POLICY The City of MuaYego, as a matter of policy, shall not employ two or more persons of the same family in any one City Department. DEFINITION "EMPLOY`f%NT" shall mean any position which is full-time, seasonal, provisional, or part-time. "EMPLOYEE" shall be construed as any appointed or elected person filling a City position, whether paid or unpaid. • "FAMILY" shall include spouse, parent, grandparent, step-parent, brother, sister, first cousin, nephew, niece, uncle or aunt, child, said relationships may be by consanguinity, or direct affinity. This policy will only apply to employees after the date of adoption of this policy by the City.
