RLO19821014RULES, LAWS & ORDINANCE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD OCTOBER 14, 1982 The meeting was called to order by Chairman Dumke at 7:00 P.M. Also present were Committee Members Treba and Klenz, Mayor Salentine, Police Chief Scholz and those persons as per the attached list. Chief Scholz reviewed proposed Ordinance #442 regarding the operation of motor vehicles while license is suspended or revoked and proposed Ordinance #440 regarding the operation of motor vehicles on premises held out to the public for the use of their vehicles. Chief Scholz recommended the penalty be a $25.00 fine for violations of Ordinance #440. Ald. Klenz moved that Ordinance #440 and Ordinance #442 be adopted by the Common Council. Seconded by Ald. Treba. Motion carried. The committee reviewed the complaint of Mr. Ed Neizgoda, West Tower Drive, regarding the raising of cats at the Peters residence which is adjacent to his property. Zoning Office Gerald Lee and Waukesha County Health Department representative, Harold Elder, had checked the Peters residence on October 12, 1982 and found nothing that violated any health ordinances of Waukesha County or the City of Muskego. Mrs. Peters supplied the committee with the following pieces of correspondence and requested they be included in the • minutes as a formal matter of record: 1. A letter from Mr. Harry Udvare stating his opinions and obser- vations of the meeting held September 16, 1982. 2. A letter from the former animal warden, Pat Feldman, indicating she did not feel there was a problem at the Peters residence. 3. A letter from a neighbor, the Petusheks, stating they have never felt a problem existed. 4. A letter from Town and Country Disposal Service indicating there has never been a garbage or odor problem. 5. A letter from Mrs. Peters stating her position on this matter. Ald. Klenz and Mayor Salentine both stated they had visited the Peters home personally and did not feel there was a problem. Following further discussion, Ald. Klenz moved to table this matter. Seconded by Ald. Treba. Motion carried. The committee discussed proposed Ordinance amendments to Ch. 12.10 of the Municipal Code relating to the parking of trailers. After considerable discussion, the committee instructed Jerry Lee to re- write the trailer ordinance to cover only situations of parking trailers on private property for personal use and omit everything pertaining to trailer camps since the city's zoning ordinance does not permit trailer camps. The committee will discuss this matter further at the next meeting. The committee discussed a proposed ordinance prohibiting the plowing of snow onto city streets from private drives and a proposed ordinance regulating night street parking during the winter months. The committee decided to get more information from other communities and from Public Works Supt. Bertram before taking further action. The committee discussed Sec. 12.01 (2) of the municipal code relating .10 to license fees in the city. This matter will also be discussed further at the next meeting. The minutes of the previous meeting dated 9/16/82 were reviewed and placed on file. Ald. Klenz moved to adjourn. Seconded by Ald. Treba. Motion carried. The meeting adjourned at 8:20 P.M. Robert Klenz, Sec'y. 0 MUSKEGO RULES, LAWS, AND ORDINANCE COMMITTEE October 12, 1982 I understand that the above committee has decided to again discuss the possibility of enacting an ordinance regarding the breeding of showcats in the City of Muskego. I would like to stress the following points to this committee. 1. Show animals that live in cages within the confines of a person's home, do not, in any way, disturb anyone out- side of the home. An amount of land is unnecessary as they live in cages. The idea of enacting an ordinance stating a minimum requirement of 2 acres of land is absurd, as these cats do not roam or use the outdoors in any way. Their 4 to 7 inch coats would be destroyed not to speak of the danger of cat fights, being bitten by a dog, or being inpregnated by outdoor alley cats. • Their kittens would be worthless. 2. Since I am the only show cat fancier in the city, I feel enacting an ordinance restricting numbers of cats is unnecessary. I am not breaking any laws, and my cats are kept clean and fed well. 3. As long as all garbage is kept in sealed in plastic garbage bags and tightly covered garbage cans, the refuse including fecal material and newspapers, the garbage does not smell and is not offensive. 4. A person running a quality breeding program for the betterment of the Persian cat cannot be regarded in the same light as some person who has a number of household pets running all over their house, yard, and barn. These cats are taken much better care of the 75% of your pet cats that people own. They do not bother ANYONE in ANYWAY! • JUDITH J. PETERS �,V I�� N I, Judith J. Peters, an avid Cat Fancier, show person, of top quality show Persian cats, would like to submit the following to this committee: 1. All my cats, with the exception of two that run loose in my house live in show cages. 2. All refuse is placed in sealed large garbage bags daily, and then put into tightly covered garbage cans that are located over 100 feet from any neighbor or my own home. This is substantiated by the enclosed statements from my neighbor on the East (whose back yard adjoins mine) and a written statement from the man who has picked up my garbage for the past 312 years. 3. NONE of my cats EVER go outside! Again this is sub- stantiated by the enclosed statements from my neighbor. These cats cost me 150 dollars monthly to feed, not to • speak of vitamins, vaccines, veterinary care, and show expenses. Anyone who has show animals does not spend two hours a day cleaning, changing litter pans, grooming and feeding them to see them run loose outdoors and be ruined. 4. An ordinance forcing me to go out of cat breeding would be discriminatory, as I am the only showcat breeder in the City. 5. The complaints made by Mr. Ed Niezgoda, are unfounded and untrue. He is "using" this committee and my cats to get back at my family, due to instances that occurred last summer regarding some visiting teenagers in my yard, not not to speak of previous small disputes between our two families. I have been breeding cats for eight years and he has never complained about the cats before these incidences occurred. Also, I have NEVER gotten a complaint • from any other neighbor, any official, or any person who has gotten one of my kittens. They are always immaculately clean, healthy, and well-groomed. Surely, if my home was a public nuisance, someone would have gotten a complaint before this time. • 0 The Muskego City Police were called by me last summer at the time of the teenager disturbance. The officer can substantiate the fact that Mr. Niezgoda made threats to me stating that he would "use" any way in the future that he could to make life "miserable" for me and my family, stating "the cats would go" and ours'water supply would go". (Our drain -off for our well is connected to his untrue- cxlleya-f149176 water supply drainoff.) He has proceded to "drum -up' ^ anyway he possibly could to do so, including using this committee as a source of aggrevation. We have offered to seek a Neighbor Counselor through an agency that trys to settle neighbor disputes, but Mr. Niezgoda refuses to take part. He says he doesn't have time. Peters Patricia Feldmann S 63 W 16669 College Ave. Muskego, Wisconsin 53150 To Whom it May Concern; I have personally known Judy Peters of S 79 W 18150 West Tower Dr. Muskego, Wisconsin, for over five years. I have had occasion to visit her place of residence many times. Both expected and unexpected. Each time that I have been to her home I have found it to be in excellant condition. Likewise I have always found all of her cats in perfect health and in very sanitary conditions. Also her cats are NEVER allowed to run loose. They are always confined to her home. Her cats are fed a very good diet. When she has gone on vacation I have taken care of her cats and fed them so I am justified in my statements. Being the former Animal Warden of Muskego, and formally and presently working with the D.N.R., and also holding both State and Federal Wildlife and Rehabilitation Licenses I have very much experience with all types of animals. I also have persian cats of my own so I am familiar with all aspects of their care. I, as does Judy Peters, take my cats to cat shows all over the Midwest Area. The entry fees in these shows are not cheap, nor is the cost in the feeding and care of these cats. This is a very expensive hobby for both of us. One final remark that I would like to make is, that the biggest problem involving cats are those cats that are allowed to run loose, breed indiscriminately, and to carry and transfer numerous diseases. The person who loves and takes care of her cats and does not allow them to run loose • should be congradulated. Dated this Thirtenth Day of October, 1982. Patricia Feldmann 0 Waste Service Inc. August 31, 1982 I have picked up trash at' -the Peter's residence on s79 w18150 Tower Dr., Muskego for the past three and one half years. They had a problem with animals (dogs and raccoons, etc.) getting into, and spreading their trash around the pick-up area. With the purchase of four new containers and lids and chains to keep them on, they have taken care of this problem. I don't feel there is an excessive odor problem.
