RLO19820118a RULZS, LAWS & ORDINANCE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD JANUARY 18, 1982 The meeting was called to order by Chairman Salentine at 8:05 P.M. Also present was Committee Member Radtke, Ald. Klenz, Building Inspector Lee and Mayor Gottfried Chairman Salentine advised that the ordinance relating to a development proposed by Scott Krause to be serviced with a holding tank will be finalized by the City Attorney in the near future and will be forwarded to Mr. Krause for his review. The committee once again reviewed proposed Ordinance #417 which relates to skin diving and swimming in the city. Chairman Salentine stated he had reviewed the proposed ordinance with several residents on Lake Denoon as to their feelings on the ordinance. Following considerable discussion on the matter, Ald. Radtke moved to amend the swimming portion of the proposed ordinance by having it read as follows: 20.08 (2) SWIMMING -- When swimming without the use of self- contained underwater breathing apparatus, a suitable boat (motor or otherwise) shall accompany any person or persons swimming more than 150 feet from the shoreline or 75 feet from any anchored swimming raft on any waters within the City of Muskego. Motion was seconded by Ald. Salentine and carried. The committee once again reviewed Section 9.055 of the Municipal Code as it relates to drinking in public places prohibited. Ald. Salentine moved to recommend to the Common Council adoption of an ordinance to amend the municipal code by adding Section 9.055(3) as follows: 9.055(3) That this ordinance shall not be in effect within 200 feet of a parade route for which the City of Muskego has granted a parade permit from one hour prior to the scheduled start of said parade and until one hour after the end of said parade. Seconded by Ald. Radtke. Motion carried. The committee discussed the operation of mini -bikes within the city. Ald. Radtke moved to defer action on this matter until the committee has an opportunity to review the Village of Pewaukee's ordinance which was sent to the committee by Attorney Molter. Seconded by Ald. Salentine. Motion carried. Ald. Salentine moved to defer action on the matter of a proposed model ordinance as per a communication from Police Chief Scholz dated 1/14/8: Seconded by Ald. Radtke. Motion carried. Bldg.Insp.Lee appeared to discuss with the committee the proposed schedule of permit fees from the Uniform Housing Code of the State of Wisconsin. Ald. Salentine moved to recommend to Common Council the adoption of the proposed fees with the addition of a new category for pole buildings which would be charged $25.00 for initial fees plus $10.00 for each additional inspection required. Motion seconded by Ald. Radtke. Motion carried. Building Inspector Lee then discussed with the committee proposed changes to plumbing permit fees. Ald. Radtke moved to recommend to Common Council the adoption of the proposed plumbing permit fees. Seconded by Ald. Salentine. Motion carried. New business - The committee discussed the possibility of adopting an ordinance� relating to snow emergencies. No action was taken at this meeting. The minutes of the previous meeting held 12/16/81 were reviewed and placed on file. Rules, Laws & Ordinance Committee January 18, 1982 - Page 2. 0 Mr. Frank DeAngeles appeared before the committee to discuss his concern regarding the city's animal warden transporting stray dogs to HAWS on the same day the dog is picked up. He indicated that he felt that dogs that had been picked up should be held within the city for at least two days. The committee advised Mr. DeAngelis that his concerns would be forwarded to the Safety Committee. Ald. Radtke moved to adjourn. Seconded by Ald. Salentine. Motion carried.
