RLO19810709• RULES, LAWS & ORDINANCE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD JULY 9, 1981 The meeting was called to order by.Chairman Salentine at 9 00 P.M Also present were Committee Members Radtke and Knudsen Also present at the meeting were Aldermen Klenz and Penovich, Mayor Gottfried, (• Chief Scholz, Mr. Larry Fischer, Sun Reporter Vi Joy, Mr Seegar Swanson, Marilyn Gaulke and Mr McAdams. n U • The committee discussed the last sentence of Sec. 20.08 of the Municipal Code relating to skin diving, "For purposes of safety, a suitable boat (motor or otherwise) shall accompany any person or persons swimminf more than 150 feet from the shoreline of any waters in the city'. Ald. Radtke moved to delete the sentence from the code. Seconded by Ald. Salentine. Ald. Knudsen moved to defer action on this matter until the next meeting. Seconded by Ald. Salentine. Motion carried. Discussion took place regarding a possible control of excessive noises. More information will be obtained and the matter will be discussed at a future meeting. The committee directed Mayor Gottfried to obtain costs on engaging the service of an ordinance update service company. Ald Knudsen moved to recommend to the Common Council the adoption of an ordinance which would include the Council President on the �r Committee. Seconded by Ald. Radtke. Motion carried Police Chief Scholz advised the committee that he is awaiting a report relating to language pertaining to disorderly conduct, possession of marijuana, etc. as it appears in the statutes from Attorney Michael Gross. The committee directed Mayor Gottfried to have the report available at the next meeting Chief Scholz reviewed and discussed his report on citation fees. The committee deferred action on this matter and requested Chief Scholz to survey surrounding communities as to their citation fee schedule. The minutes of the previous meeting held 6/11/81 were reviewed and approved. New Business The committee discussed a proposed amendment to Section 12.01 of the Municipal Code. Ald. Knudsen moved to direct the City Attorney to draft an amendment to Sec. 12.01 (b) of the code which would prohibit the issuance of a premises that received no less than 50 percent of the gross revenues from the sales of intox- icating liquor and fermented malt beverage, except no person presently holding such license shall be deprived thereof because of this quota or restriction. Seconded by Ald. Salentine. Motion carried. Ald. Klenz discussed his objection to the proposal indicating the committee should not limit the number of liquor licenses in the city but should have a planned format or formula on the ntmunber of licenses. No action was taken on this suggestion. Ald. Radtke moved to adjourn. Seconded by Ald. Knudsen. Motion carried. The meeting adjourned at 10:35 P.M.
