RULES, LAWS & ORDINANCE COMMITTEE - CITY OF MUSKEGO
MINUTES OF MEETING HELD MAY 14, 1981
The meeting was called to order by Chairman Salentine at 9:05 P.M
Also present were Committee Members Knudsen and Radtke, Mayor Gottfried,
Aldermen Klenz, Dumke and Penovich and those persons as per the attached
list.
Ald Radtke was chosen to be secretary of the committee.
Mr Mike Fitzgerald appeared in behalf of the water ski club re-
questing a change in the ordinance to allow a six-month permit for
a water ski jump. Ald. Knudsen moved to recommend the city attorney
draft the following amendments to Sec. 20.05 of the municipal code:
(1) To allow a six-month permit for a water ski jump.
(2) To provide for the right of revocation of permit for
just cause.
(3) To change the required liability insurance amount to
$100,000.00.
Seconded by Ald. Radtke. Motion carried.
The committee discussed the present charge for a dog kennel license
in the city. It was noted that Waukesha County now charges a
$25 00 fee. Ald. Radtke moved to recommend the Dog Kennel License
fee be increased from $20.00 to $30.00, Seconded by Ald. Salentine
Motion carried.
The committee deferred action on the proposed ordinance to amend
the municipal code which would provide the Council President shall
be a member of the Finance Committee and that Sec. 2.09 be amended
to include Sewer Committee
The committee discussed the request of Pick & Save to have Section
12.01 of the city's municipal code amended to raise the quota of
Class "A" Fermented Malt Beverage and Intoxicating Liquor licenses
from five to six.
Mr. Rick Swan spoke in behalf of the request for Pick & Save.
Mr. Larry Fischer of Muskego Beer and Liquor Store spoke against the
request and provided the committee with copies of the state statutes
prohibiting a corporation from holding more than two Class "A"
Liquor licenses. Mr. Swan indicated that Pick & Save of Muskego
was a separate corporation which did not have any liquor licenses.
Mr. Fischer also provided the committee with copies of an ordinance
from the City of Waukesha which provides that Class "A" Liquor
licenses will be granted only to stores dealing primarily in the sale
of liquor,'beer or soda, etc. and with a copy of a Milwaukee ordinance
which provides that no Class "A" liquor licenses shall be granted
to an establishment which does over 50 percent,of its dollar volume
in retail food sales.
The committee also discussed whether or not the present quota should
be totally removed. Mayor Gottfried was directed to contact the
city attorney regarding the questions raised over a corporation
holding more than two licenses. The matter will be further dis-
cussed at their next meeting.
The committee reviewed r suggestion by the police -department that
additional markers be placed on Little Muskego Lake. Ald. Knudsen
moved to recommend to the Common Council that the following
additional water markers be placed on Little Muskego Lake:
(1) A "Slow - No Wake" sign 150 feet from each point of land just
west of the entrance to Kingston Bay.
(2) A "HazoLe&' marker between George's Island and the west shore
of Little Muskego Lake
(3) A "Hazard" marker 150 feet north of Little Muskego Lake dam.
Seconded by Ald. Radtke. Motion carried.
