MINUTES OF MEETING HELD OCTOBER 22, 1979
The meeting was called to order at 7:45 P.M. by Chairman Ald. Van Lanen.
Also present were Committee Members Salentine and Pietruszynski and
Mayor Gottfried and persons as per the attached list.
Ald. Van Lanen moved to have the City Attorney attend all future
Rules, Laws & Ordinance Committee meetings. Seconded by Ald
Pietruszynski. Motion carried.
The committee reviewed the letter Mayor Gottfried had written the
City Attorney regarding the Adult Theater in Muskego.
Several citizens were present at the meeting to discuss the adult
theater. Mrs. Koester questioned the legality of protesting the
adult theater. Mr. James Ramsey felt a limited access to the type
of films shown is limiting our children to the movies.
Police Officer James Budish stated the Mayor has directed the police
department to investigate the twin theaters. He further indicated
the District Attorney's office has been contacted and is awaiting
the Supreme Court''s decision regarding the Princess Theater in
• Milwaukee. That decision should be made in the spring of 1980.
The question was raised if the 18 age limitation is a state law.
Lt. Zabel indicated it was a guide established by the Theater Guild.
Mr. Masce, Manger of the Theaters, responded to the audience as to
the problems of the theater.
Mayor Gottfried reported that in the City Attorney's opinion the
city need not concern itself with the recent Ex -Offender Laws
Mr. James Ramsey requested the floor to discuss pornography in the
City of Muskego. He indicated that the ditches in the area of Circle
Drive where Middle School children are picked up by buses contained
hard core pornography on two different occasions. Ald. Salentine
requested Mayor Gottfried to discuss this problem with the Supt of
Schools
As a result of a considerable amount of discussion between the
committee and individuals in the audience and Mr. Masce, owner of
the Countryside Theaters, Mr Masce agreed to have one of his
theaters show a current movie which is not X-rated during the
coming week. He further indicated that if sufficient support were
shown by the public he would not have to resort to the use of
X rated movies.
• In answer to a question as to what can be done in the event the
operators of Granny's Tavern violate the conditions of their
license Mayor Gottfried indicated that proof of such violations
would be required. He suggested that a signed affidavit by the
complainant probably would be sufficient.
The matter of the Humane Officer was again discussed. It was
suggested that a variance bQ requested which would permit the
temporary holding of stray or unwanted animals in a residential
district. Mayor Gottfried and Ald. Salentine reviewed provisions
of the Zoning Ordinance regarding this matter.
The committee reviewed a communication from Mr. John Erenz, S63
W16623 College Avenue, submitted by Patricia Feldman, stating he
would have no objections if the Feldman property is used as a
holding place to keep animals until they are taken to the Waukesha
Humane Society. Ald. Salentine moved to have the dog kennel matter
sent back to the Safety Committee. Seconded by Ald. Van Lanen. Motion
carried. Ald. Van Lanen requested that the Safety Committee make
a specific recommendation to the Council.

Mayor Gottfried reviewed with the committee the difficulties which
would be encountered if the City Attorney were required to attend
all future meetings of the Rules, Laws & Ordinance Committee as well
as other committees.
Ald. Salentine moved to adjourn.
