RLO19770323• RULES, LAWS & ORDINANCE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD MARCH 23, 1977 The meeting was called to order at 8 45 P.M. by Chairman Ford. Also present were Aldermen Constantineau and Wallner, Mayor Gottfried and Parks and Recreation Director Pischke and approximately 40 citizens who wish to express their concern over the possibility of the city prohibiting the use of snowmobiles in any park or recreational facility or area under the jurisdiction of the city. The committee reviewed proposed Ordinance #325 (Re: holding tanks), which had been submitted to them by the Welfare Committee with a recommendation for approval. After considerable discussion Ald. Ford moved to recommend approval of Ordinance #325. Seconded by Ald. Constantineau. Motion carried with Ald. Wallner casting a dissenting vote. The committee reviewed with Mr. Pischke the proposed amendments to an ordinance proposed by the Parks and Recreation Board to repeal and recreate Chapter 26 of the Municipal Code (regulating conduct in public places). Persons in the audience raised questions as to what affect the ordinance would have on the use of snowmobiles on city - owned lands as well as the accesses to the lake. They were partic- ularly concerned with Section 9 (E) of the proposed ordinance. After considerable discussion Ald. Ford moved to amend Section 9(E) to isread as follows- "It shall be unlawful to use snowmobiles on any park land or recreation facility except in those areas specifically designated by the Park Director." Seconded by Ald. Constantineau, motion carried. Ald. Constantineau moved to amend Section 3(8) by deleting (A) relating to wading in designated areas and further to amend Section 3(8)(B) by including the word "wading" immediately after the work "swimming". Seconded by Ald. Ford, motion carried. Ald. Ford moved to amend Section 3(8)(C) by deleting the words "or floating device". Seconded by Ald. Constantineau, motion carried. Ald. Ford moved to recommend Common Council approval of Ordinance #326 as submitted by the Parks and Recreation Board. Seconded by Ald, Constantineau, motion carried. Librarian Kathy Horton appeared before the committee to discuss non- payment of library fines. The library has 239 books and magazines outstanding. The committee agreed to have City Attorney Buckley determine whether or not a citation could be issued for non-payment of library material. The committee will also request City Attorney Buckley to see if there would be some way the library staff could detain someone that has been observed vandalizing or stealing library material until the police • can be summoned.
