RLO19730509RULES, LAWS & ORDINANCE COMMITTEE - CITY OF MUSKEGO • MINUTES OF MEETING HELD MAY 9, 1973 The meeting was called to order at 8:55 P.M. by Chairman Foldy. Also present were Aldermen Ford, Knudsen and Wallner. Chief Richard Martin, Chief Fred Utpatal and Mr. Robert Chapman, representing the fire departments of the city, appeared at the • meeting to discuss the proposed Buring Ordinance #248. The committee reviewed the ordinance and several amendments will be presented to the Common Council for consideration. The committee reviewed communication from City Attorney Buckley regarding the city being able to defend the present Section 12.01 (5) (a) & (b) of the Municipal Code (re: the limiting of Class "A" Fermented Malt Beverage and Class "A" Intoxicating Liquor Licenses in the city. Attorney Buckley noted in his letter of May 8, 1973, that the ordinance could be defended in court. Ald. Ford moved to recommend that the Common Council defeat Ordinance #252. Seconded by Ald. Knudsen, motion carried. Ald. Ford moved to recommend to the Common Council the adoption of • the proposed Land Division Ordinance, dated 7/19/72, as amended by the Rules, Laws & Ordinance Committee. Seconded by Ald. Foldy. The motion carried with Ald. Knudsen voting "nay". Mr. Ray Wallner ex- pressed his opposition to the proposed Land Division Ordinance.
