PSEM19860327• PUBLIC SEWER COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD MARCH 27, 1986 The meeting was called to order at 7:00 P.M. by Chairman Penovich. Also present were Committee Members Dumke and Taube, Mayor Salentine and those per the attached list. The Committee reviewed Attorney Molter's legal opinion regarding interest on sewer assessments that was requested at the February meeting. Attorney Molter stated that he believes that the City's current practice of charging interest on sewer assessments is clearly within the policy discretion of the City. In regard to charging from the time of occupancy instead of the physical connection date as is presently the policy, it is his opinion that as long as the sewer is going to be operational within a reasonable length of time, that these decisions are within the scope of the City's disrection. Ald. Dumke moved to direct the City Attorney to establish a policy which would set a uniform starting date for all properties involved in assessments. Seconded by Ald. Taube, motion carried. Mayor Salentine discussed the status of Boszhardt Lane with the Committee. The City Engineers are in the process of follow-up with MMSD for approval. • The Committee reviewed the Forced Hook -Up quotes for properties in Bass Bay, Woods Road and Kurtze Lane. The only quotes received were from John Lang as follows: 2217.975 Robert H. Kallin $1,661.00 2218.985 Jack Verburgt $4,830.00 2217.953 Jeff Verburgt $1,170.00 Ald. Dumke moved to recommend acceptance of the above quotes. Seconded by Ald. Taube, motion carried. Mr. Stan Potrykus appeared before the Committee to discuss the Ludwig/Strampe property. He is doing the engineering work for sewer approval. When completed, the plans will be sent to the City Engineers for their review so that the plans can be reviewed at the next sewer meeting. Mr. Ed Finger appeared before the Committee to request sewer service for his property on Woods Road. The Committee indicated that the property would not be receiving sewer service in the foreseeable future. Mr. Finger indicated that he will be contacting the Waukesha Health Department to pursue installation of a mound system. 11 • Public Sewer Committee - Page 2 March 27, 1986 Mr. Bob Klenz appeared before the Committee to discuss the availability of sewers and the Sewer Assessment on the Masch/Mahn property (Durhamswood Subdivision). The Committee approved the request for providing sewer service to the plat. The Committee also recommended to Council that assessment be pro -rated for the seventeen (17) lots and become the liability of the seventeen lots (17), (this would remove the present assessment from the balance of the property) with a five-year time limitation for deferral. The Committee reviewed the request of Robert Klenz to adjust the sewer usage fee for a property addressed W172 S7413 Lannon Drive. The Committee recognizes error in billing by the City and directs the City Clerk to bill the prior owner for portion from July 15 (connection date) to the end of November 1985 at a rate of $31.25 per month, and an adjusted bill to the new owner for the month of December 1985. The Committee discussed pro -rating assessments & forced hook-ups for Kurtze Lane as requested by Mr. James Verburgt. Ald. Dumke moved to recommend to Council to pro -rate the sewer assessments and to allow those homeowners that purchase the lot to continue • the present payment plan. Seconded by Ald. Penovich, motion carried. The Committee reviewed the FLOW contribution invoice dated January 29, 1986 in the amount of $21,000. Ald. Dumke moved to recommend approval. Seconded by Ald. Taube, motion carried. The Committee reviewed the request of Robert Klenz for a pro- rated deferred assessment for the Oschmann property in the amount of $62,624.00. This assessment will be allocated to the thirteen lots and removed from the balance of the property , with a five year time limitation for deferral. Attorney Molter's proposed resolutions for the changes to the assessment policies (Controlled Access) were reviewed by the Committee. Ald. Taube requested the Committee to defer action until meeting with the landowner to review his future intentions for development. The Committee was receptive to this request. The Committee reviewed correspondence from the Sewer Utility Clerk informing them that the Retzlaff property, S106 W20475 North Shore Drive, has only been charged for two sewer connections from 1981 to the present and it has been discovered that they have three connections (2 houses and 1 boathouse). Ald. Taube moved to bill the property owner for the three • connections. Seconded by Ald. Penovich, motion carried. 0 1J • Public Sewer Meeting - Page 3 March 27, 1986 Proposed sewer service for the area of Wentland Drive was discussed. The Committee requests that the property owners adjacent to Wentland Drive be invited to attend the April Sewer Committee meeting and the City Engineers are asked to review the unsewered area on Wentland and Hillendale and determine the feasibility of sewering. Correspondence from the Town of Norway regarding Gallonage adjustment charges for 1985 was reviewed and placed on file. The Sewer Utility Foreman appraised the Committee of the need for the calibration of meters for Lake Denoon. Ald. Dumke moved to have the meters calibrated. Seconded by Ald. Taube, motion carried. The Commitee discussed the Reserve Capacity Assessment escalation and decided to review at the end of 1986. Correspondence from Beatrice A. Kraemer, S68 W12699 Bristlecone Lane requesting her property be reclassified from a mother-in-law unit to a single residence was reviewed. The Committee requested the charges that have been paid on the unit to date and to have the Building Inspector report on the status of the property and determine if it should be classified as a mother-in-law unit. Seconded by Ald. Penovich, motion carried. Alderman Penovich moved item #15 from the agenda regarding sewer service to a property on College Avenue . Attorney Pachucki appeared before the Committee to request sewer service to a piece of property on McShane owned by Mr. Tom Carter. Attorney Pachucki will seek approval for a private interceptor to service both homes. Front foot charge determination will be made at the next Sewer meeting.
