MINUTES OF MEETING HELD JULY 11, 1985
A Tour was made of the Northwest Treatment Plant Lagoons.
The meeting was called to order at 7:30 P.M. by Acting Chairman
Dumke. Also present were Committee Member Taube, Mayor
Salentine, Ald. DeAngelis and those per the attached list.
The Committee reviewed Cameron Bruce forced hook-up and agreed
that an additional 30 days would be required since the Building
Inspection Department had not acquired the costs for review.
The Committee reviewed the Kurtze Lane Cul-de-sac sewer
assessment and determined that the Ludwig/Strampe property should
not be assessed $990.28 for the lateral which was installed on
the cul-de-sac in error. The lateral was required on the
engineering plans and the contractor was unaware of the main
which was requested by the property owner and approved by the
Sewer Committee. When the project was completed, the main was
installed along with the lateral and the Committee recognizes the
duplication of connections. The Committee further indicates that
a copy of these minutes be placed in the property's address file
so that in the event that this lateral is used to connect a home
• in the future, the Committee will make a lateral charge at the
time of the request. This request is subject to the City
Attorney's review since it requires amending an assessment roll.
Ald. DeAngelis' report on 30 day connection notices dated July 5,
1985 was discussed. Ald. Taube made a motion to assess the land
owner if future hook-up costs are incurred. Seconded by Ald.
Dumke, motion carried. This decision is because the homes which
may require forced hook-ups are located on land owned by someone
other than the home owner. The City Engineer's letter dated July
29 1985 stating that Mr. Paepke's septic system currently is
within the Kurtze Lane right-of-way. In order to construct the
proposed Kurtze Lane roadway, it is necessary to abandon and
remove the existing septic system. This means that Mr. Paepke
must be hooked up to the sanitary sewer prior to the commencement
of construction of this road. The Committee directed the Clerk
to proceed with the 30 day sewer connection notice. The Finance
Committee is requested to furnish an opinion as to allowing a 10
year deferred assessment for the assessment cost on the Verburgt
property.
After considerable discussion on abandonment of the treatment
lagoon, Ald. Dumke moved to accept Jalovec Construction, Inc.'s
proposal to make a determination on the feasibility of
stockpiling sludge and condition of the bottom of the lagoon as
. follows:
1. Transportation and mobilization charge of $1,100.00
Hourly rate with man, fuel and lubrication $75.00/hr.

2. City of Muskego will provide $100 of funding to remove Bear
Cub should it become stuck in lagoon bottom.
3. If the Bear Cub works to the City's satisfaction, machine
will be worked a minimum of 66 hours. If worked for this
minimum the transportation and mobilization charge will be
cut to $55.00
4. If the City is not satisfied with the Bear Cub's
performance, the original mobilization and transportation
charge would apply plus 8 hours at the hourly rate. At
this point the City would have no further obligation.
Seconded by Ald. Taube, motion carried.
The need for sewer service for the Madsen property on Ann Drive
was determined. Ald. Dumke made a motion to obtain an easement
for lateral installation from Valley Drive to the Madsen property
addressed at S77 W18244 Ann Drive. Seconded by Ald. Taube,
motion carried. Mr. Gratzek will be notified of this action.
• Mr. & Mrs. Szpek and Mr. Harold DeBack appeared before the
Committee to review policy requiring summer cottages to be
hooked -up to sewers. Ald. Taube moved to request the City
Attorney to clarify his legal opinion of May 10, 1985 and the
Zoning Officer to supply cost figures that would be involved when
a summer cottage connects. Seconded by Ald. Dumke, motion
carried.
Ald. Taube moved to allow Gold Gym and Central Credit Union to
connect to the manhole located at the city limits on Lowell Drive
and recommended that the City enter into a separate agreement to
reimburse the City for any costs incurred by providing sewer
service beyond what the New Berlin agreement would provide.
Seconded by Ald. Dumke, motion carried.
Mr. Bostater and Mr. DeBack appeared to allow the Committee to
review a sketch for the proposed development on Racine Avenue and
Muskego Dam Road. The request was made to remove the assessment
on the swamp land from both property owners deferred
assessment. Ald. Dumke moved to ask the City Attorney for a
legal opinion to determine how this request could be granted.
The Attorney representing the Elroy Kurth property appeared
requesting a proration of a deferred assessment in proportion to
the intended sale. Ald. Taube moved to recommend to Council that
the request be granted for principal and interest involved for
the 225 ft. of front foot requested. All costs relating to
prorating the assessment will be the responsibility of Mr. Elroy
Kurth. Seconded by Ald. Dumke, motion carried.

The Committee reviewed the sketch presented for pumping
alternatives by the City Engineer and will be reviewing a report
at the next sewer meeting scheduled for August 1, 1985.
The Mayor updated the Committee as to Muskego's involvement in
the FLOW case before Judge McGraw's court. Attorney Dale Arenz
representing the Sewer Committee, Peggy Farrow representing the
FLOW coalition, Seegar Swanson Financial Advisor, and the lead
attorneys involved in the FLOW litigation concurred with the
Mayor that there was merit in requesting FLOW to include
Muskego's proposed court action against MMSD in the litigation
presently pending before Judge McGraw. The Committee agreed that
Muskego's previous funding of the FLOW coalition benefited other
communities but did not affect Muskego.
