PSEM19820624IT- PUBLIC SEWER COMMITTEE -- CITY OF MUSKEGO MINUTES OF MEETING HELD JUNE 24, 1982 The meeting was called to order at 7:30 P.M. by Chairman Klenz. Also present were Committee Members Tomczyk and Nilsson, Ald. Penovich, Mayor Salentine, Supt. Bertram, Sewer Treatment Plant Operator, James, Kibbe and those persons as per the attached list. The committee discussed the questions and concerns of Mr. and Mrs. Glenn Pellmann relating to sewer installation and reconstruction of Kurtze Lane as follows: 1. In regard to a sewer assessment and road assessment, they feel that any assessment should be deferred until their land is used for frontage. If it is not used for development, they do not wish to pay any assessment. The committee feels that TIF will pick up the assessment on Kurtze Lane and if the land is developed it will be assessed to the owner and repaid to TIF. The sewer and road assessment will be deferred unless their land is used for a frontage road. 2. Since there is going to be an assessment for Woods Road, • Kurtze Lane and 230 feet on Kurtze Lane cul de sac adjacent to their land, they have asked how could that be treated. The committee determined there would be an assessment for Woods Rd. and the Kurtze Lane cul de sac which would be purchased as in the same manner as was used in the purchase of the lands from David Ludwig. 3. The Pellmann's have asked, how will a future land division affect their assessment since they plan to sell the farm house to a family member? The committee has determined that the assessment would not be affected. 4.The Pellmann's have asked, if a home were built on a lake lot which would require a land division, how would that affect their deferred assessment if they themselves were the ones to build a home and can there be any assurance that the deferred assessment will stand beyond the ten years if they wish to continue farming and not sell the property? The committee has determined that there would be no affect on their deferred assessment and that the past prace has been to grant a second ten-year deferment. 5. The Pellmann's question how does the city plan to acquire the right-of-way for the cul de sac to the Hernke property - they recognize there is a value on the easement which must be granted for the sewer installations on the 20-ft right-of-way. The committee . feels the same formula as was used in the purchase of the David Ludwig land would apply. The same concessions as listed above would apply in that they will not be assessed for Kurtze Lane proper for sewer or road. This should offset the value of the easement. 6. The Pellmanns also place a value on the storm sewer right-of-way on the lake lot. They have asked, could fill be part of the agree- ment from whatever project to fill the front of the lake lot? The committee determined that in regard to the fill needed to fill the front of the lake lot (with DNR approval) that if the Pellmann's signed the necessary easement for storm drainage fill could be acquired for the front part of the lake lot. 7. Bay Lane Road property of the Pellmann's was discussed. It has a sewer assessment for two sides (approximately fifty (50) acres. The Pellmans' would be assessed on Woods Rd. and Bay Lane since the parcel of land is large enough to warrant the assessment. The policy established for the Mahn property, the Koeferl property and the Schaefer property would be used. Public Sewer Committee June 24, 1982 Page 2. Gerald Lee appeared at the meeting to discuss with the committee the cost effectiveness of the manhole rehabilitation. The committee discussed the status of the Demshar hookup. Mr. Demshar had received a letter ordering him to take action with hib� septic problem on June 10, 1981. If after 30 days action has not been taken appropriate legal action will be taken by the health department. A survey presented to the committee regarding a request to extend sewer service to property owned by Richard Knudsen indicated the majority of people were not in favor of sewers. Ald. Tomczyk moved to reject the request. Seconded by Ald. Nilsson. Motion carried unanimously. Chairman Klenz reviewed a communication directed to Mr. Fred Meinholz of MMSD, dated 6/15/82, from Ruekert and Mielke requesting an opportunity to disusswith him design and completed field work relating to the Muskego interceptor and a letter from Mr. Meinholz of MMSD advising that at this time they have no plans for the Franklin interceptor and will have no information for Ruekert and Mielke until there is a signed contract with the City of Muskego. The letter also indicated that their facilities plan does not call for completion of the interceptor until 1990. • The minutes of the previous meeting were reviewed and placed on file. Gerald Lee advised the committee of the septic problem of Mr. Robert Matthes on Bellview Dr. The committee advised Mr. Lee that the problem would be resolved when the Bay Lane sewers are installed. Treatment Plant Operator, James Kibbe, advised the committee of Ruekert and Mielke's suggestions and how the plant has been functioning. Ald. Nilsson moved to stop all dumping of septic tank or holding tank waste in the northeast plant. Seconded by Ald. Tomczyk. Motion carried unanimously. Mr. Senft and Mr. Walters to be notified. Ald.
