PWM19931006PUBLIC WELFARE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD WEDNESDAY, OCTOBER 6, 1993 The meeting was called to order at 6:40 PM by Chairman Patterson. Also present were Committee Members Dumke and Schneider, Mayor De Angelis and Ald. Sanders. Patterson moved to convene in Closed Session pursuant to Wis.Stats. 19.85(1)(e), Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session; or more specifically meeting to discuss proposed recycling contract. Dumke seconded, carried. The Committee reconvened in open session at 6:58 PM. Also present were City Clerk Marenda, Chuck Ott, BFI, Ken Briglevic, Best Disposal, and Don Ripp, Willow Pond Apartments. Chairman Patterson asked Chuck Ott if BFI would be willing to exclude multi -family residences over 4 units from the contract until their existing contracts with haulers are terminated. Mr. Ott stated that in another community BFI was required to give up some of their contracts. Mayor De Angelis stated that he had discussed that with that community, and they changed their policy to allow those with existing contracts to be phased in upon termination of the contract. Don Ripp of Willow Pond Apartments objected to entire annual charge being paid at the start of the year, compared to their existing monthly payments. Chairman Patterson explained to Mr. Ott that the City is providing the service, and if a property owner chooses another hauler, they would still pay to City. What has come up is the situation where someone is locked in contractually to another hauler. Mayor stated there are about 400 units total. There is also one condo project with a long term contract, but it appears they can get out of their contract. Mayor stated Brookfield included all multi -families, but phased them in over a period as their contracts expired. Mr. Ott responded that they have all but one complex which we are negotiating to get them on our program. Mayor stated that the City wants to charge everyone a flat rate. Patterson added that the City is being charged so much per unit by the hauler. Mr. Ott asked who's going to follow-up when contracts expire? The Mayor responded that the City will notify all multi -family owners to given us their contract expiration dates so we know when they will come on line with the City • service. • Patterson stated that then if they choose to maintain their own service beyond that date, they would also be charged by the City. Mr. Ott stated he would go along with that, but would be checking further with his office. Mr. Ott questioned still picking up recycling. Mayor advised the recycling pickup with start the same time as the refuse pickup. Ken Briglevic, Best Disposal stated they have exclusive rights to their contracted customers for refuse and recycling. As to the state mandate for recycling not applicable to 6 unit and over multi -families, Mayor stated the City can set our own criteria when recycling will be mandated in the City. The Committee determined the Assessor will be requested to delete all the codes on multi family units over 4 units so the charge will not appear on the tax bill. Those customers will receive their bills when their contracts expire. Those without a current signed contract will still have to be hand billed. Patterson stated the program has been established to be most fair for the entire City. Mr. Don Ripp stated they would prefer to stay with an independent contractor until the State mandates recycling for multi -families. • Mayor reported on the following concerns received by phone: Val Halbrucker (Hillendale Drive). House sits quite a distance back from road. Gravel road from Hillendale to house is private. How will his garbage be picked up? Mr. Ott responded it would be.picked up on the City road. Pickup on private roads such as Bass Bay Lane, Gregory Dr., Harbor Circle, etc? Mr. Ott requested a list of the roads and he would go out and look at them to make a determination. Chrisman (5110 W20370 Denoon Point). House has been under construction for several years - has not received occupancy. Also there is a cottage on the property. It is now coded as two properties scheduled to receive refuse/recycling service. How will this be handled? Mr. Ott will go out and look at the property to make a determination. Hazardous waste containers, paint cans, etc? Mr. Ott stated hazardous waste would not be accepted. They recommend taking the lids off of paint cans, either latex or oil based paint, and allowing the residue to harden. Once hardened, the hauler will take it. Many residents who presently contract with BFI use large . plastic garbage bags. Will this be allowed? The City's grdinances do not currently allow bags to be used. Research • into the Contract language and the City Ordinance will have to be done. Patterson questioned Mr. Ott on the controls to be in place once recycling is mandated. How will we know if recyclables are placed in with the refuse? Mr. Ott stated that in other communities the hauler places a sticker on the refuse container left behind because it contains recyclables. The Mayor was requested to call Mr. Ott with the number of multi -family units requested to be removed from the contract and phased in. Meeting adjourned at 7:40 PM.
