PWM19830912PUBLIC WELFARE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD SEPTEMBER 12, 1983 The meeting was called to order by Chairman Tomczyk at 9:15 P.M. Also present were Committee Members DeAngelis and Nilsson, Mayor Salentine, Ald. Penovich, Ald. Gaetzke and those people as per the attached list. The Committee reviewed the comments made regarding the request of RVS to transfer its cable TV franchise to Ingersoll Cable �i Corporation at the public hearing held at a Special Meeting of the Common Council just prior to this meeting. The Committee also reviewed the proposed ordinance #465 to amend Chapter 12.19 of the Municipal Code regarding the Cable TV Franchise. Ald. Nilsson moved to amend Chapter 12.19(18) to add: The City shall not be liable for damage caused to Ingersoll equipment located in the basement of the Police Station. Seconded by Ald. Tomczyk, motion carried. Ald. DeAngelis moved that Ingersoll not be permitted to use the basement room in the Police Station. The motion lost for lack of a second. Ald. Nilsson suggested that the Police Department run a security check and issue an identification card to the Ingersoll employee who will need occasional access to the room in the Police Station. • Mayor Salentine questioned what the charge to a property owner would be if he were a long distance from the public road. Mr. Ingersoll stated that he will run 350 feet from the road for no additional charge. The Committee recommended that Chapter 12.19 (9)(a) 10. be added as follows: The Grantee will include service to subscribers locatediwithin 350 feet of the initial service area at the normal installation charges, with a time and material cost basis per foot for those subscribers beyond 350 feet. The Grantee will provide the subscriber with a written quotation prior to performing the installation. Mayor Salentine stated that the ordinance included a franchising fee of $6,000 which included attorney fees in addition to the 1983 budget amount. Ald. Nilsson moved, Ald. Tomczyk seconded that the Common Council agree to the re -franchising fee of $6,000. Motion carried. Ald. Nilsson moved that Chapter 12.19(5)8. be amended to read: The Grantee shall furnish the Public Welfare Committee of the Common Council with monthly progress reports commencing with the first Public Welfare Committee meeting after the acceptance and effective date of Ordinance #465. Seconded by Ald. Tomczyk, motion carried. Ald. Penovich questioned when the old tower located next to the Police Station will be removed. Ald. Nilsson moved, Ald. Tomczyk seconded, to amend Chapter 12.19(17)(a) to read: The Grantee will lower to the ground and dismantle the original police tower located next to the Police Station within two weeks after publication of Ordinance #465. Motion carried. Ald. Tomczyk moved, Ald. Nilsson seconded to amend Section 12.19 (7)(b)6. to add: "at no charge to the City". (regarding additional local origination channel.) Motion carried. Ald. Nilsson moved, Ald. Tomczyk seconded to recommend that a citizen committee be appointed by the Mayor to receive citizen input regarding CATV. Motion carried. Ald. Tomczyk moved, Ald. DeAngelis seconded, to amend Section 12.19 (7)(b)4. to add: The Grantee will provide 52 broadcasting hours per year within the Muskego City Limits. Public Welfare Committee 9/12/83 - Page Two • Ald. Nilsson moved that Section 12.19(9)(a)9. be amended to add a fourth paragraph: If Grantee is constructing on a private roadway, Grantee is not required to construct if ease- ments cannot be obtained. Seconded by Ald. Tomczyk,motion carried. • Ald. Nilsson moved, Ald. Tomczyk seconded to recommend to the Common Council that all the above amendments be included in the proposed Ordinance #465. Motion carried with Ald. DeAngelis voting "no". The Committee reviewed the minutes of the previous meeting.
