PSCM20030106APPROVED PUBLIC SERVICES COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD ON MONDAY, JANUARY 6, 2003. Chairman Patrick Patterson called the meeting to order at 6:30 PM. Present were Committee Members Ald. Chuck Damaske and Ald. Eileen Madden. Also present was Public Works Superintendent Wayne Delikat. Engineering and Building Director Sean McMullen was excused. Ald. Patterson noted the meeting was posted in accordance with the Open Meeting Law. REVIEW OF MINUTES OF PREVIOUS MEETING: Ald. Damaske moved to approve the minutes of December 2, 2002. Seconded by Ald. Madden, motion carried 3-0. UNFINISHED BUSINESS: Update on Parkland Mall — Nothing new to report. Status of Refuse/Recycling — Superintendent Delikat reported no problems or concerns • with refuse and recycling. Status of Cable TV / Concerns of Customer Service — Nothing new to report. Status of proposed nolicv for traffic calming — Superintendent Delikat informed the Committee he had received 35 Keep Kids Alive, Drive 25 plastic signs, and had one for the Committee to view. The Committee agreed to post the signs in spring and that Officer Mrotek had some locations in mind. Street Naming in MRED Planned Development District — Committee discussed memo from Plan Director Brian Turk. The street right-of-ways within the Redmond /Boehm property, to the south of Janesville Road at Moorland Road, were not named on their CSM's. Mr. Cummings of Redmond Development has indicated that the City can name these streets. Streets to the east and west are named after "Ivy League" institutions. Staff recommends the names "Princeton Drive and Penn Lane. Ald. Damaske moved to approve Princeton Drive and Penn Lane. Ald. Madden seconded. Motion carried 3-0. Review modifications to Chapter 12.03 — Peddlers, Canvassers & Transient Merchants — Committee reviewed the memo from Chief John Johnson. The United States Supreme Court ruled that an ordinance that requires a church or a political party Public Services Committee Page 2 January 6, 2003 canvasser to register with a community is contrary to the First Amendment of our Constitution. Therefore, a community cannot include religious or political canvassers in their transient or canvasser ordinances. Chief Johnson recommends the following modifications: - The word `religious" must be removed from Section 12.03 (2) (d); - The word `religious" removed from 12.03 (5); - Under 12.03 (3) Exemptions, `religious organizations" needs to be added as (1); - And "political canvassers" also needs to be added as an exemption as (m). Aid. Madden moved to approve the above modifications to Chapter 12.03, Peddlers, Canvassers & Transient Merchants. Seconded by Aid. Damaske. Motion carried 3- 0. Communication and any other business as authorized by law — Ald. Damaske asked the Committee to discuss cars with `for sale" signs being parked on City streets. Ald. Patterson asked that it be placed on the agenda for the February meeting. Ald. Damaske asked members if they felt the Public Services Committee should be looking at contracts and leases, for example, the Historical Society. Ald. Madden felt it would not be necessary since they do go before Finance and in the case of the Historical Society, which went before the Park and Recreation Board and anyone interested could attend these meetings. Being no further business to discuss, Ald Damaske moved to adjourn the meeting, seconded by Ald. Madden. Carried by all and meeting adjourned at 7:00 PM.
