PSCM19961007PUBLIC SERVICE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD MONDAY, OCTOBER 7, 1996 • The meeting was called to order at 7:05 P.M. by Chairman Patterson. Also present were committee members Pionek and Rasmussen, Ald. Salentine, Ald. Suhr, Building Inspection Director Chuck Dykstra, Public Works Superintendent John Loughney, Chief John Johnson, and those per the attached list. The committee reviewed update on status of condemnations/citations with Chuck Dykstra, as attached. Building Inspection Director Chuck Dykstra informed the committee of revised electrical code and minor revisions to erosion ordinance that he will bring to the committee for their November meeting. The committee discussed status of recycling and a suggestion that was given to one of the aldermen on possible monthly recycling pickups because of the large containers and cost, also a request for additional time at BFI for dropping off of yard waste. Ald. Rasmussen indicated that he is hoping to include an additional drop-off at Emerald Park Landfill site and is working on it through landfill negotiations. Mr. Dan Kinnick appeared at the meeting but due to time restraints, had to leave prior to discussion of Cable. It was understood that Mr. Kinnick was here to complain about the recent 40 airing of referendum tapes. The committee requested that Mr. Kinnick be invited to attend the November meeting, along with a representative from the Recreation Department and to have the department bring the airing schedule in question with them to the meeting. A discussion was held on the present Burning Ordinance and the problem with smoke; particularly during the burning of leaves in Fall. The committee determine that they will not do anything at this time until a program is in place for additional drop off times/places for yard waste disposal. Ald. Suhr, two of his constituents, and Mr. David Taube appeared before the Committee to discuss their concerns with possible changes to fireworks ordinance. Chief Johnson reiterated his concerns regarding safety of fireworks and if a complete ban is not possible, he requests that the time period be reduced from the present seven (7) day period to a one day or couple day period to allow for better enforcement. Ald. Rasmussen requested that the City Attorney submit a written opinion on the liability of the City issuing permits when it results in damage that is not covered by adequate insurance by the permit holder. The committee also requested Chief Johnson to research information on safety of fireworks in general, particularly in the City and outside of the • City. A short discussion was also held on possible elimination of sale of fireworks in the City. Discussion will continue at the November meeting. Public Services Committee - Page 2 October 7, 1996 • The committee discussed Temporary Trailer Ordinance #446 (Chapter 12.10) and the possibility of eliminating ordinance completely because of limited use and the lack of benefits for the community. A discussion was held regarding changing the ordinance to make it more specific as to what emergency needs would be. Ald. Pionek moved to recommend amending the Municipal Code to repeal Ord. #446, and amend Chapter 17, Section 6.04 (4) G. 5. to strike the following "except that the Common Council may grant a special permit for the temporary habitation in accordance with Chapter 12.10 of the Municipal Code." Seconded by Aid. Rasmussen, motion carried 2-1, with Ald. Patterson casting the dissenting vote. Building Inspection Director Chuck Dykstra further explained that this would not affect trailers being used for businesses as that approval could be obtained through Building, Site 6 Operation Plan approval, this will just eliminate residential dwelling or habitation. Betty Czarapata appeared before the committee to discuss list of undesirable weeds she had put together at the committee's request. Committee discussed various weeds recommended for placement on list. Ald. Pionek moved to include the following weeds by resolution and that the list be informative only and will not be part of the noxious weeds ordinance and will not be enforceable. Seconded by Ald. Rasmussen, motion carried 3-0. Prior to Council voting on the resolution, it was requested that • this list first be sent to Mr. Kelly Kearns, Native Plant Manager of the DNR, for his opinion if these weeds are appropriately on this list: Garlic mustard (Alliaria petiolata) Common buckthorn (Rhamnus cathartica) Glossy buckthorn (Rhamnus franqula) Exotic honeysuckle (Lonicera tatarica/Lonicera x bella) Spotted knapweed (Centaurea maculosa) Dame's rocket (Hesperis matronalis) Common teasel (Dipsacus sylvestris) Black locust (Robina pseudoacacia) The committee discussed placement for waterway markers for Little Muskego Lake. Ald. Pionek, motion carried 3-0. Ald. Sanders and five constituents appeared before the committee to request placement of "no thru" sign on Green Haven Court. Ald. Rasmussen moved to approve sign and directed Superintendent to install. Seconded by Pionek, motion carried 3-0. • The committee requested the Plan Department to send all final plats for new subdivisions, prior to approval, to the Police Department for assigning proper signage. Ald. Salentine appeared on behalf of Mr. Fischer, Muskego Beer and Liquor regarding a City alleyway adjacent to his property and Mediterranean Gardens that he maintains. Employees from Mediterranean Gardens are parking on alleyway blocking access to the rear of Mr. Fischer's, particularly for delivery vehicles and fire trucks. Salentine requested no parking signs be placed in alleyway. A question was asked of Chief Johnson if this meets definition of alley and if the law provides for parking in alley. Chief stated he thought it was an extension to parking lot but will check into it. Salentine will check with property owners regarding possible vacation of City alley and report back to the next meeting. The meeting adjourned at 10:20 P.M. Rescheduled to September 30th, motion for injunction at Circuit Court. Judge Mawdsley allowed Kriel 30 days to complete fencing and gravel work. Judge Murphy (Circuit Court) sent matter back to Judge Lenz; Judge Murphy ruled case not yet ripe for appeal. Scheduled to be heard in Muskego Court September 7, 1996. Parties could not agree on forfeiture matter set for trial October 5, 1996.
