PUBLIC SERVICES COMMITTEE - CITY OF MUSKEGO
MINUTES OF MEETING HELD WEDNESDAY, SEPTE14BER 11, 1996
The meeting was called to order at 7:05 p.m. by Chairman
Patterson. Also present were Committee members Pionek and
Rasmussen, Ald. Suhr, Public Works Superintendent Loughney,
Recreation Director Jacobson, and Chief Johnson, and those per
the attached list.
The Committee noted that the meeting was posted in accordance
with the Open Meeting Law.
The Committee noted that discussion on the burning ordinance
will be placed on October meeting agenda.
The Committee reviewed report by Chuck Dykstra regarding
condemnations/citations, as attached.
Chuck Ott advised that BFI is working on new route schedules.
BFI will advise when changes are complete and provide City with
new route maps. Rick Krajcik has replaced Jeff Kay, and will
be the City of Muskego contact person regarding garbage and
• recycling problems. Low wire and trees on Sobek Lake affecting
pickups were discussed. Tire pickup was explained. Ald.
Patterson explained problems that have occurred with attempts
to coordinate the printing and distribution of the City
newsletter with the BFI newsletter. Gordon Jacobson, the
coordinator for the City newsletter, stated than an effort will
be made next quarter to coordinate both.
Ald. Patterson informed the Committee that Muskego Regency will
have their independent -living units served by BFI, and will
hire a private contractor to service the remaining units. Ald.
Rasmussen moved to direct BFI to service units at Muskego
Regency as noted above. Seconded by Ald. Pionek, motion
carried 3-0.
The Committee discussed garbage and recycling pickup rates for
1997. Ald. Rasmussen moved to set refuse pickup rate for 1997
at $60.61 for 5 units and under, and $54.51 for 6 units and
over, and recycling pickup rate at $16.80 for 5 units and
under, and $11.40 for 6 units and over which is the same as the
1996 recycling pickup rate. Seconded by Ald. Pionek, motion
carried 3-0.
Ald. Rasmussen expressed concerns regarding cable on Groveway
Lane being exposed. Supt. Loughney was directed to call Warner
. Cable and follow-up with written communication regarding this
complaint.

• There was nothing new to report on the landfill agreement or
the PRP status - East Troy landfill.
The Committee reviewed speed concerns on Durham Drive with
Chief Johnson. Ald. Rasmussen moved to provide additional and
larger speed limit signs. Seconded by Ald. Pionek, motion
carried 3-0. Ald. Rasmussen requested that Chief Johnson
investigate the purchase of a radar camera and traffic counter
to include in the 1997 capital budget.
The Committee reviewed speed concerns on Muskego Drive with
Chief Johnson. The use of larger signs and their placement
will be coordinated between Chief Johnson and Superintenent
Loughney.
The Committee discussed possible changes to Fireworks Ordinance
with Chief Johnson, and deferred further discussion til next
month's meeting.
The Committee discussed MMSD Household Hazardous Waste
program. Ald. Rasmussen moved to continue with Waukesha County
Hazardous Waste program. Seconded by Ald. Pionek, motion
carried 3-0.
The Committee reviewed 1997 Operating budget for the Muskego
Public Access Channel with Jeff Jones. Membership has
isincreased in 1996, as well as the Club having had a greater
involvement with the Community Festival and School Board
meetings and school functions in 1996. Ald. Rasmussen
requested that it be noted that the additional $500.00
requested will be used for one-time electrical work and
furniture. Ald. Rasmussen also suggested that Cable Club
consider a stipend for operators in the future. Ald. Pionek
moved to approve 1997 Operating Budget as presented. Seconded
by Ald. Rasmussen, motion carried 3-0.
The Committee reviewed 1997 Capital budget for the Muskego
Public Access Channel with Jeff Jones. Ald. Pionek moved to
approve 1997 Capital Budget as presented. Seconded by Ald.
Rasmussen, motion carried 2-1, with Ald. Patterson voting "no"
The Committee discussed options for Trick or Treat hours. Ald.
Patterson read a letter from Mr. 6 Mrs. P. Herbst expressing
their desire to limit Trick or Treat hours. Ald. Rasmussen
moved to designate 1996 Trick or Treat hours as Sunday, October
27th from 1:00 - 4:00 p.m. Seconded by Ald. Pionek, motion
carried 3-0.
The Committee discussed a request to ban duck hunting on Little
Muskego Lake with Barb Farmerie. Mr. Mike Morack, Mr. Jim
Ross, and Mr. Ken Fries spoke in favor of continuing to allow
• hunting. It was suggested that the Little Muskego Lake
Protection and Rehabilitation District newsletter include an
article regarding safety concerns related to hunting. Mr. Ken

• Fries will expedite. It was also suggested that a request be
sent to the Parks Department requesting better signage on Holz
Island.
A waterways marker request was reviewed with Mr. Ken Fries, as
well as a request for additional patrolling on Little Muskego
Lake.
The Committee reviewed proposed amendment to Chapter 9 - New
Chapter 9.38 Wisconsin Statutes - New Juvenile Code with Chief
Johnson. Chief is requesting that Chapter 9.38 Wisconsin
Statutes be included in our Municipal Code in order to allow
prosecution in our municipal court. He explained that under
the new code 17 year olds will be considered adults, along with
many other changes. Ald. Rasmussen moved to add Chapter 9.38
Wisconsin Statutes to our Municipal Code. Seconded by Ald.
Pionek, motion carried 3-0.
The Committee discussed proposed "Request for Action" form.
Ald. Rasmussen and Ald. Patterson expressed concern with five
minute time limit for residents wishing to speak at Committee
meetings. Ald. Patterson suggested that Chairman be allowed to
deviate from five dAt minute time limit for time sensitive
issues. Ald. Patterson suggested that department head involved
with issue provide pertinent information and provide information
prior to meeting. Department heads will review at next
• Department Head meeting.
The Committee deferred discussion of Temporary Trailer
Ordinance til the October meeting.
The Committee discussed proposed list of undesirable weeds.
Ald. Patterson shared letter received from DNR supporting
adoption of the proposed list. Further discussion will take
place at next month's meeting.
Supt. Loughney questioned if the City is required to place stop
signs at all intersections in new subdivisions. A request for
a stop sign in Plum Creek will be placed on next month's agenda.
Ald. Rasmussen moved to adjourn at 12:05 a.m.. Seconded by
Ald. Pionek, motion carried 3-0.

Forfeiture issue not yet resolved by Court.
Judge Murphy (Circuit Court) sent matter back to
Judge Lenz; Judge Murphy ruled case not yet ripe
for appeal. Scheduled to be heard in Muskego Court
September 7, 1996. Parties could not agree on
forfeiture matter set for trial October 5, 1996.

permit. Mrs. Duklas applied for permit to allow
illegally placed fill, permit denied, however,
permit issued to allow illegally placed fills to
be removed. Triple fees paid, building department
will request citation be dismissed if fill removed
and site seeded/mulched prior August 18, 1996.
Compliance achieved, citation dismissed.
