PUBLIC SERVICES COMMITTEE - CITY OF MUSKEGO
MINUTES OF SPECIAL MEETING HELD THURSDAY, AUGUST 29, 1996
The special meeting was called to order at 6:35 p.m. by Chairman
Patterson. Also present were Committee members Pionek and
Rasmussen, and Building Director Dykstra.
The Chairman noted that the meeting was posted in accordance with
the Open Meeting Law.
Discuss application for Temporary Habitation of a Trailer - Knudsen
Director Dykstra gave brief update on ordinance. Richard Knudsen
further explained his request - to get a new permit now that the 12
month maximum has expired on the existing permit. Reasons project
not yet started: Mr. Narloc has not come up with money for drainage
study, land division underway to free future homesite from
requirements of drainage study, home plans not yet picked out,
personal finances not yet adequate to swing project, expect changes
to personal financial situation early 1997 that will enable project
to get underway.
Ald. Pionek inquired if there were other trailers plugged -in and
• occupied on this property. Mr. Knudsen confirmed and stated they
were the property of people he had befriended, who live elsewhere
and work in this area.
Ald. D'Acquisto explained his involvement to date and requested the
committee give consideration to Mr. Knudsen's extenuating
circumstances, but also be careful to include specific criteria or
conditions that must be met to insure timely completion of this
project in consideration of nearby property owners.
Director Dykstra warned of the potential for setting a precedent
that others could use to get around the intentions of the code.
Chairman Patterson explained the need to temporarily adjourn to
another location so that Capital Budget Committee, who is next in
line for this room (Alderman's Room) can get started. Temporarily
adjourned at 7:07 to reconvene in Jean Marenda's office at 7:15.
Public Services Committee reconvened at 7:15 in Jean Marenda's
office.
Ald. Rasmussen reviewed applicable zoning and municipal code
sections and questioned original intent of ordinance. Chairman
Patterson provided historical background. Ald. Rasmussen informed
Mr. Knudsen other trailers cannot be occupied and the number of
• trailers at this site, occupied or not, exceeds zoning allowances.
Mr. Knudsen requested several weeks to get trailers and occupants
removed. Committee allowed till September 10, 1996 to remove illegal
trailers, Plan Department to follow-up and verify compliance.

• Director Dykstra was called from room at 7:23 P.M. to provide
information to Capital Budget Committee regarding copier request.
Director Dykstra returned at 7:39 P.M.
Ald. Pionek suggested that Mr. Knudsen could meet certain
contruction criteria, regarding construction progress, financing,
etc.
Ald. Pionek excussed himself at 7:50 P.M.
Chairman Patterson asked Director Dykstra to explain modular
construction and time frames for construction of same. Director
Dykstra explained that "closed construction" modular homes, of the
type Mr. Knudsen has said he is considering, can be constructed in 3
months or less, start to finish. This includes digging basement
constructing same, setting components on foundation and finishing
all necessary work required to obtain occupancy.
Chairman Patterson stated he may consider some type of conditional
approval if Mr. Knudsen could produce the following: Plans for
closed construction modular home, signed contracts with general
contractor, home supplier and subcontractors, within a reasonable
time frame, say 3 to 6 months.
Ald. Rasmussen questioned why City issued original permit if there
• was no intention to get started on the home and the drainage study
was not done to allow the construction of the home. Chairman
Patterson questioned if Mr. Narloc had completed the drainage study
would Mr. Knudsen have been in a financial position to start the
home anyway? Mr. Knudsen stated maybe.
Ald. Rasmussen does not feel confortable issuing permit if no plans,
financing, etc. are available and is concerned this project will not
progress in a timely manner, too many loose ends. Chairman Patterson
stated, realistically this home won't be completed for another year.
Ald. Rasmussen concerned with Mr. Knudsen's ability to get financing
acomplished in light of difficulties he has explained.
Mr. Pat Terrill (W198 510993 Racine Ave) spoke in opposition of a
position Mr. Knudsen had taken on a previous matter concerning Mr.
Harold DeBack. Chairman Patterson explained the issue was not
relative to Mr. Knudsens request and as such the committee could not
provide any assistance in that regard.
Ald. Rasmussen made a motion to grant a permit which would require
review at the January Public Services Committee meeting (permit is
to expire on that date). Mr. Knudsen shall bring an approved
certified survey, home plans, contract for home, contract with
general contractor and all required subcontractors, timetable for
project, proof of rezoning and financials verifying monies available
• for completion of the project, to the January Public Services
meeting. Motion seconded by Chairman Patterson, motion carried.
