Minutes of Meeting Held Monday September 19, 2005
Chairman Eric Schroeder called the meeting to order at 7:02 p.m. Also present
were Committee members Pat Patterson, Eileen Madden, Utilities
Superintendent Scott Kloskowski, Ruekert-Mielke Representatives Rich
Eberhardt and John Jansen and those per the attached list.
It was noted that the meeting was posted in accordance with the Open Meeting
Law.
Those present recited the Pledge of Allegiance.
APPROVAL OF MINUTES OF PREVIOUS MEETING
Aid. Patterson moved to approve the minutes of August 22, 2005.
Seconded by Aid. Madden. Motion carried 3-0.

SEWER UNFINISHED BUSINESS
Status of notifications for proposed Taxing Districts/MMSD/Norway Capital
Charges — This item was defeated at Council and should be removed from the
agenda.

0 SEWER NEW BUSINESS —
Discuss no fault back up insurance — Superintendent Kloskowski explained the
City has insurance for no-fault sewer back-ups due to large rain events. The City
also has liability insurance for back ups that are caused by the City. The
McShane storage facility was built to handle large rain events. There have not
been any no-fault claims since the storage facility was built. Superintendent
Kloskowski suggested placing the money in a dedicated account to pay any
back-up claims in place of the insurance.
Review deadline to connect — Martin Drive — Superintendent Kloskowski
explained sewer is available in this area. In November 2004, residents who were
not connected were given a nine -month extension to connect. The Lindeman
home is scheduled to be razed tomorrow. Charles Schulz of S69 W16632 Martin
Drive is the only property left to connect. Letters have been sent to the property
owner. The last step is for staff to receive bids from a contractor and do a force
connection. Aid. Patterson moved to direct staff to receive bids for a force
connection for next meeting. Aid. Madden seconded. Motion carried 3-0.
Request to amend sewer service area to include entire parcel MSKC 2241.999 —
Superintendent Kloskowski explained this property is off Woods Road near
Nature Estates. A portion of the property is already in the sewer service area.
This area is proposed to be added in 2007as part of the 2020 Facility Plan. Aid.
Patterson moved to deny the request to amend the sewer service area to
include 2241.999. Seconded by Aid. Madden. Motion carried 3-0. Ald.
Schroeder requested discussing the MMSD 2020 Sewer Service Area Plan at the
first Committee of the Whole after the budget. Superintendent Kloskowski
recommended inviting Bill Mielke for discussion.
WATER UNFINISHED BUSINESS —
Further discussion on Booster Station for Hillendale Drive Watermain — Aid.
Patterson moved to defer. Seconded by Aid. Madden. Motion carried 3-0.
Status of Acquisition of Lake Lore (Tudor Oaks) Water Trust — Superintendent
Kloskowski reported he will be meeting with Tudor Oaks on Wednesday night at
7:30 pm. Tudor Oaks will be giving a presentation for the membership to vote.
Status of 17t" Amendment to WCA District (Racine/Hillendale) — Aid. Patterson
moved to defer. Seconded by Aid. Madden. Motion carried 3-0.
Status of possible connection to municipal water for Pioneer Court — There has
been no response since the cost estimate was sent. Superintendent Kloskowski
will contact them before the next meeting. Aid. Patterson moved to defer.

Establish policy on how to deal with private wells that are affected by municipal
wells — Dr. John Jansen was present to discuss the studies that were requested
by the Committee at the last meeting. Monitoring wells were installed at Well 9,
Boxhorn and Thode Dr. Comparing pumping tests to the cycling of pumps 10
and 11 there was no response by Well 9. Dr. Jansen noted there has been a 15
-foot decline in water levels in that area related to the drought. Looking at the
data from around wells 10 and 11, well 11 is not affecting private wells. Well 10
is affecting nearby wells according to the data there is a clear connection. Wells
further out are not being affected by Wells 10 or 11. There is a 10-15 foot draw
down, but does not match the cycling of wells 10 and 11. A closer high capacity
well could be affecting these wells.
Ald. Schroeder noted at last months meeting Muskego Lakes Country Club was
mentioned as a high capacity private well in the area. This was for information
for the consultants only, and was not meant to make any accusations of being
the cause of low water levels.
Dr. Janson first received the data last week and will be putting together a
complete list of wells that have been affected and wells that have not been
affected based on significant impact. Ruekert-Mielke will also be drafting a policy
for the Committee to review. This information will be available for next month's
meeting.
Liz Lesher, W 152 S9901 Thode Dr — questioned if Ruekert-Mielke was unbiased
in their testing and reporting. Ald. Schroeder explained Ruekert-Mielke is hired
by the City of Muskego to give accurate information. If a claim should result of
this issue Ruekert-Mielke will have to back up their information with data.
Dick Oberman, W151 S9940 Thode Dr— stated in June during the test pumping
his neighbors well went dry and in July his well went dry. During the initial
pumping there were more gallons pumped than during the recent test pumping.
Dr. Janson explained the information that was found and stated the reports will
show the cycling and should clear up questions.
David Lesher, W 152 S9901 Thode Dr — questioned the length of time of the test
pumps.
Burt Duff, S81 W12895 Hi View — homes within a block of his were affected days
after the wells were turned off. Suggested monitoring wells in this area.
Tom Schilz, S81 W12904 Hi View — questioned the procedure for using a
monitoring well and what is being looked for. Dr. Jansen explained they are
looking for changes in the aquifer.
Ald. Patterson suggested placing another monitoring well in the Hi View Drive
0 area.

Ald. Schroeder clarified for the next meeting Ruekert-Mielke will prepare a report
of wells affected and not affected and a draft policy. Staff will determine a
suitable private well in the Hi View area for Ruekert-Mielke to monitor. Aid.
Patterson moved to defer. Seconded by Aid. Madden. Motion carried 3-0.
Review bills from residents claiming damage to their private wells (Well 9, 10 and
11) — Aid. Patterson moved to defer. Seconded by Aid. Madden. Motion
carried 3-0.
WATER NEW BUSINESS -
Janesville Road Water Service — TID #9 — Reno Berg was present to discuss a
water lateral for a property on Janesville Road. Mr. Berg explained the County
owned the land and is now selling. Mr. Berg explained he has requested
paperwork from the County requesting the City install a lateral on this property.
The City may have determined at that time the lot would be unbuildable and
would not need a lateral. Superintendent Kloskowski stated he requested a
report from the Finance Director on the availability of funds in the TIF account.
The report was available for this meeting. Staff will research the project files for
any documentation of the County requesting a lateral. Ald. Patterson moved to
defer. Seconded by Aid. Madden. Motion carried 3-0.
Authorize Ruekert-Mielke to bid out Well #13 — Superintendent Kloskowski
explained due to the problems with Well 9 and the drought, staff is
recommending developing the well site in Quietwood East. Before the DNR test
pumping is done on Well 9, the aquifer needs to recover. Aid. Patterson
moved to approve Ruekert-Mielke to bid out Well #13. Seconded by Aid.
Madden. Motion carried 3-0.
Review amendment to Champions Villaae Off -Site Watermain Recapture Roll —
Superintendent Kloskowski noted in the Agreement there is a statement "the City
shall amend Exhibit C based on the actual cost". There is no action need by this
Committee. Director McMullen has the authority to adjust Exhibit C, the
Assessment Roll. Director McMullen will have a policy in place by next month's
meeting.
SUBDIVIDER'S EXHIBITS - none.
REVIEW DRAFT OF 2006 SEWER & WATER BUDGETS — The Committee
received the draft 2006 sewer and water budget. Superintendent Kloskowski
explained there are some numbers that are missing. Once the missing numbers
are added the Committee will be able to set the rates and determine what
subsidy, if any, will be needed.
