SPECIAL PUBLIC UTILITIES COMMITTEE MEETING
Minutes of Meeting Held Friday, April 9, 2004
Chairman Eric Schroeder called the meeting to order at 9:03 A.M. Also present were
Committee members Aid. Pat Patterson and Aid. Rick Petfalski as well as
Engineer/Building Inspection Director Sean McMullen, Mayor Mark Slocomb, Finance
Director Dawn Gunderson and Sewer Utility Clerk Renee Kowalik.
Aid. Schroeder stated that the meeting was noticed in accordance with the Open
Meeting Law.
Aid. Schroeder led those present in the Pledge of Allegiance.
Review Intermunicipal Agreement Between The Town of Norway Sanitary District No. 1
And the City of Muskego
Director McMullen stated that he would explain the major points of the agreement that
has been signed by the president of the Town of Norway Sanitary District No. 1 and will
be going to the City's Common Council for approval at their meeting scheduled for
Tuesday, April 13, 2004.
The major points are:
DEFINITIONS: Article 1.11 and 1.12 have the word "consecutive" added. For
Peak Daily Flow it will be "during any consecutive 24-hour period" and for Peak Hour
Flow it will be "during any consecutive 60 minute period".
Article 1.16, Residential Equivalent Connection, defines 300 gallons per day of
average flow, including all infiltration and inflow resulting from such connection.
SERVICE AREA: The legal on page 3 coincides with exhibit A and B showing
the defined service area. Mayor Slocomb noted that this defined area is very important.
SERVICE TERMS: This article defines actual reasonable flows from the City of
Muskego into the Town of Norway District's system. The flows that are shown are
realistic and the City of Muskego has never exceed the listed daily flow or hourly flow. It
also has both parties agreeing to pay their proportionate share of the cost, at that time.
RATES: The same with defining one REC as 300 gallons per day per residence
for non -metered. Mayor Slocomb pointed out a typographical error in the last sentence
of paragraph one. It should read "treatment plant" instead of "treatment plan".
FUTURE COST SHARING: Defines City's proportionate share of cost of any
construction or upgrade/refurbishment of any lift station or appurtenances thereto
constructed to service the City of Muskego or the City of Muskego and the District.

REIMBRUSEMENT FOR LIFT STATION #8. Upon signing of the agreement, a check
will be sent to the Town of Norway Sanitary District in the amount of 65.5% of the cost
of that lift station which is $74,105.57.
DISPUTES: This has been added and is similar to all agreements entered into
by the City of Muskego to allow for a discussion before dispute resolution and
subsequent mediation.
PENALTIES AND REMEDIES: In the event the City discharges any wastewater
to the District sewerage system that is injurious of detrimental to the sewerage system,
the District may recover compensation from the City.
TERM OF CONTRACT: In full force through December 31, 2019 with
negotiations to begin approximately January 2018.
BINDING AGREEMENT: This was added which is binding upon the parties
hereto and their respective successors and assigns.
Director McMullen also pointed out Ordinance No. 32. An Ordinance to Amend
Ordinance No. 28 Relating to Limitations on Quantity and Quality of Wastewater and
Rats for City of Muskego, adopted on March 11, 2004, which charges the City for
,.. adjustments to their 2004 rates from $3.30 per 1000 gallons to $4.79 per thousand
gallons. The balance due for additional gallons is $64,377.24.
Director McMullen stated that as the flows go up through area growth, the City's costs
would go down.
Aid. Petfalski moved to recommend approval of agreement. Seconded by Aid.
Patterson. Ald. Patterson questioned if Director McMullen and Mayor Slocomb felt that
all areas of concern have been addressed and both agreed that the proportionate share
language eliminated City's concerns along with the rate change decreasing with
additional growth. Motion carried 3-0.
Sewer Utility Clerk Renee Kowalik suggested that the City request an audited budget
from the Town of Norway Sanitary District on an annual basis in order to have actual
costs along with budgeted.
ADJOURNMENT: Petfalski moved to adjourn the meeting at 9:45 AM. Seconded
by Aid. Patterson, motion carried 3-0.
