PUBLIC UTILITIES COMMITTEE MEETING
Minutes of Meeting Held Monday March 15, 2004
Ald. Rick Petfalski called the meeting to order at 7:01 p.m. Also present
Committee member Ald Pat Patterson, Utilities Superintendent Scott Kloskowski,
Engineer and Building Inspection Director Sean McMullen and Ruekert & Mielke
representative Steve Schultz. Ald. Schroeder is excused.
It was noted that the meeting was posted in accordance with the Open Meeting
Law.
Those present recited the Pledge of Allegiance.
APPROVAL OF MINUTES OF PREVIOUS MEETING
Aid. Patterson moved to approve minutes of February 16, 2004. Seconded
by Aid. Petfalski, motion carried 2-0.
STATUS OF PROJECTS
Steve Schultz updated the committee on the attached status of on -going projects
as follows:
• Janesville Rd Box Culvert — Officially delayed by the County until
2005.
Well exploration project — Completed surveys on selected
properties in Quietwood Creek East and South, Peterson Property
south of Woods Rd east and west of Durham Dr and Kurer Property
east of Durham Dr. Of these locations 6 primary sites were
chosen. Director McMullen explained the Quietwood East and
Quietwood South locations may not be available for possible well
sites any longer. The plat for the Quietwood Creek East
subdivision has been approved, and the lot in Quietwood South has
been sold and construction has begun. Aid. Patterson moved to
begin the process of testing the primary sites on the Peterson
property. Aid. Petfalski seconded. Motion carried 2-0.
• Stoneridge Ground Water Remediation — Stoneridge has returned
their response to the EPA. City is dependent on the EPA doing the
review in a timely manner. Director McMullen received a fax of a
draft agreement for well test sites from the Attorney of Waste
Management. Waste Management is taking steps to keep the
process moving.

Lakewood Meadows — The request for PSC approval was sent in
this week. Situation similar to Freedom Square. The Lakewood
Meadows system was developed under the new DNR rules
however it was developed just after the new rules came out and the
DNR did not hold the developer to as stringent a standard as they
do now. A wellhead protection plan and well site investigation will
have to be submitted. The DNR will review the system again.
Submittal should be in to the DNR by end of next week.
• Kenwood Estates — According to the code the development could
be hooked up to the Lakewood Meadows system. The Lakewood
Meadows system can support it and meet the fire flows.
• Champions Village Acquisition Well Head Protection District —
Moving ahead with process similar to Lakewood Meadows.
• CCV/Stonebridge Watermain Extension — Final plat has not been
received. Nothing new to report.
• Proposed Development — Valley Sand and Gravel site — Steve
Schultz was present at the March 1 st City of New Berlin Plan
Commission Meeting and gave a presentation on ground water
availability, hydrology, recharge methods and impact of
developments.
SEWER UNFINISHED BUSINESS
Status of Town of Norway Contract - Superintendent Kloskowski reported the
Town of Norway passed the ordinance approving the agreement between the
Town of Norway and the City of Muskego. The City's concerns had been
addressed and the City is satisfied with the Agreement. Staff will supply the
Committee with a copy of the Agreement.
Status of claims from West Lake, Lake Lore and Lake Brittany — The Lake
Association's questions have been answered by the Aqua Science and
Technology, and has been sent to the Insurance Company. The Insurance
Company will contact the Lake Association.
Review Invoices for water treatment — West Lake Homeowner's Association -
Nothing new to report.
SEWER NEW BUSINESS —
Review connection order — Paul Lindeman — The property owner is asking for a
maximum of three years to be allowed to keep the property without connecting to

�. sewer. Multi family plans are at Plan Commission and Common Council. If the
plans are approved the time period may be moved up. Superintendent
Kloskowski recommended waiting until the deadline to connect of nine months
expires and consider an extension at the November meeting. Aid. Patterson
moved to defer to the November meeting. Seconded by Aid. Petfalski.
Motion carried 2-0.
Review correspondence from School District requesting Utility to waive late fees
The School District is requesting late fees on the fourth quarter water and sewer
bill to be waived. The School District received the bill on January 6, 2004. The
due date was January 30th. The school board passed the voucher on Feb. 2nd
and was hand delivered on Feb. 3rd. Superintendent Kloskowski noted the
School District has paid late fees in the past. Finance Director Gunderson in a
memo to the Utilities Committee recommended not to waive the late payment
fees to be fair and consistent with all of the utility customers. Aid. Petfalski
moved to defer when all members of the Committee are present. Seconded
by Aid. Patterson. Motion carried 2-0.
WATER UNFINISHED BUSINESS
Further discussion of water service — Kenwood Estates — Mr. Schultz reported
the existing Lakewood Meadows system, according to the code, can provide the
,.,. amount of water for the total number of homes. The system can also provide
adequate fire flows. The developer requested the City to consider treating the
tannins. Director Kloskowski will contact the association to set up testing for fire
flows and Mr. Schultz will look into treatment of tannins. Aid Patterson moved
to defer. Seconded by Aid. Petfalski, motion carried 2-0.
WATER NEW BUSINESS
Discuss State Legislative Bill LRB3797/3 — Radium Compliance —
Superintendent Kloskowski informed the Committee the City of New Berlin
passed a resolution supporting the legislative bill LRB3797/3. Mr. Schultz
explained when the EPA developed the radium rule they included the option
called flow rated averaging. If a community could show the water a customer is
drinking is below the radium standard the well would not have to be shut down.
The bill did not make it to the last legislative session. There is resistance from
the governor's office and the DNR came out against it. Senators involved are still
pushing the bill. Several communities are also in support. Ald. Petfalski
recommended to watch the bill.
